  1. Can anybody advise on the i 485 application status? My husband filed for AOS and EAD on May 10th 2010 and our case was transferred to CSC on June 4th 2010, went for biometrics on June 15th and have been waiting for an update since. He has received his EAD and his case has been in the initial review stage for the past 5 months.

    We didnt hear anything so contacted our Senator's office for an update and since then our case has been "touched" several dates.

    -We just received an update that our case has been transferred to the California Service Center and it has been listed as in the acceptance stage again. This is a step back so we are wondering what is going on. Has this happened to anyone else?

    Below is the explanation from USCIS website on our case status update

    Acceptance

    On October 2, 2010, your fingerprint fee was accepted and we have mailed you a notice describing how we will process your case. Please follow any instructions on this notice. Your case is being processed at our CALIFORNIA SERVICE CENTER location. You will be notified by mail when a decision is made, or if the office needs something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283.

    Applications and petitions that are not properly filed are rejected with an explanation of why the application is rejected and the corrective action needed. Rejected applications or petitions do not retain their filing date.

    The acceptance step is typically completed within 2 business days of when the application is received. With mail time it may take several weeks for you to get the receipt or rejection notice in the mail. If you do not receive your notice within 30 days of mailing your application, please contact our national customer service center at 1-800-375-5283.

  2. Hi all,

    So its the 7 to 10 days before our interview and my fiance is turning in our documents to the VFS office. I thought we had run out of questions but apparently there will always be more. lol. Is the 131.00 fee due on the day of your interview or do you pay that when you present your documents to the VFS? Also are we supposed to submit our proof of relationship to the VFS as well or does he take that with him to the interview? help!!

  3. Well at long last Pavan and I have our interview scheduled... Now just to gather all of our documents in time. It seems to good to be true that we will no longer have to live separate lives on different continents. Thank you to everyone who has provided help and assistence here on visa journey. This is a wonderful forum here. We will keep you posted once we receive the results of the interview.. Approval all the way!! wish us luck

  4. We have received Packet 3 and I am working on collecting all the required documents for the interview. However, I am quite confused about the Police Clearance Certificates needed in my case. I am Indian Citizen and have been born and living in Bombay till 2006 after which I moved to Pune and currently living here. My Indian passport was issued to me in 2004.

    According to the guidelines posted here http://mumbai.usconsulate.gov/ivpolicecertificates.html I need to apply for a PCC in Bombay Passport Office and another one with local Police in Pune (for the 3.5 yrs I have been living here), correct? Recently I visited Bombay passport office for the PCC on which they instructed me to visit Pune Passport Office for PCC since my 'Present' address is the one in Pune. Can somebody give me correct guidance here?

    Also, do I need to apply for a PCC with Bombay Police as well for the 2 yrs I was living in Bombay after my passport was issued?

    Any help on this would be greatly appreciated.

  5. Question on the I 134.

    I see on the bottom of the DS-2001 form that my fiance has to send in the I 134 form along with the DS 230. My question is whether he has to include the evidence, (ie; letter of employment, W-2's, etc) for the Affadavit of support along with this .. or should he send copies and keep the originals for when he has the interview?

    Sometimes the Embassy's make things seem more complicated, don't they? And no, you don't send them the I-134 with the DS230 and Appllicants Statement. You will submit the I-134 at the VFS with your other documents. Note that it also say's 'Photo Instructions'. It is just telling you that these were included in the packet 3.

  6. My fiance and I are trying to collect all the documents needed for our interview.. yay!! but we are a little concerned about the I-134 document and supporting evidence. My current income is 40,000. a year and I have been with the company for a year now, but I started Sept of last year. Prior to that I was a student so my income was very low. My 2008 tax return only shows an income of 20,000. for the year and the prior years were closer to 10,000. I have a letter of employment from my company stating my income, position, etc.. My question is will this be satisfactory.. and should I include the prior years tax returns with my "student's income"? Also I don't have a large savings account balance to make up the difference.

    What did you send in the packet 3? This is what I believe needs to be sent...

I have been reading posts saying that once you know your petition has been received by the consulate you can contact them re: setting your interview appointment. My question is do you have to contact them to schedule the appointment or does my fiance have to wait until he receives packet 3 and 4 before the interview can be scheduled?

    The Embassy themselves will shcedule you your appointment.

    Once you get Packet 3 and return the 'DS-230' and 'Applicants Statement' (which verifies that you have obtained all required documentation), then the Embassy will mail you the packet 4 with your interview date. :)

    You can actually download the Packet 3 and 4 from the Embassy's website rather than wait for it. You may if you want start on Packet 3 now if you want to be ahead, especially when getting the PCC from the passport office.

    What does 'especially when getting the PCC from the passport office' mean?

  11. Help! Me and my fiance have filed the I-129F form. It has been approved by the CSC and the NVC has received it, but when I called to confirm the NVC had it I realized I had put the wrong date of birth on the I129 F. In addtition to this my fiance does not have his actual birth certificate. He does have an Indian passport and can provide all the secondary evidence necessary to confirm his actual date of birth though. What should we do? Will this mess up our petition?

    Your petition has already been approved, so NO it will not mees up your petition. I would offer to correct the mistake at the consulate interview. He will need his birth certificate at the interview or a good reason he does not have one. Birth certificates are not just an easy thing for some countries and the consulate understands this. If he cannot get a copy of the birth certificate before the interview, then get whatever documentation he can to prove his date of birth and that the certificate is not available.

    "inconvenience" is NOT a valid excuse for not having a document, they do not care if it is EASY to get, only if it is impossible to get.

    Thank you so much. I have been stressing about this ever since I realized my mistake. I figured that since the petition has been approved they haven't had a problem doing the initial background checks, but this is too important to make mistakes. Now I'll just make sure he gets all of his documents for the interview and hope that it goes well? Does it help the interview at all if I am present?
