    I am in a similar situation where my husband is a US citizen and I am a student on F-1 visa. For Form I-485 question 2 why is option b not appropriate for my case "My spouse or parent applied for adj of status or was granted lawful permamnet residence in an immigrant visa category that allows derivative status for spouses and children".

    It might be the right box to check in your case. I married a U.S born citizen. Was your husband born overseas? If so, your case might be different from what I understand. But again, I'm not an expert. Try posting your question in your own thread and give some more details about your case and I am sure someone will be able to tell you what to do.

  2. Hi again everyone!!

    I am applying for Adjustment of Status (got married in the U.S in August), and I am putting this in the mail tomorrow and wanted to make sure I have everything in order so I don't get any RFE's. I have the checklist in front of me, but have some questions:

    -Coverletters: Is it ok if I (the immigrant and husband) sign the coverletters, or does my wife (the U.S citizen) have to sign also? She's out of town for a week, that's why I ask.

    -Form G325A: The checklist (nr 14) tells us to attach 1 passport photo of foreign spouse (me, the husband). But then it says to write the full name of beneficiary on the back. Who is the beneficiary??

    -Form I-485: Which box do I check in Part 2? The form asks why I am applying for adjustment of status. I am thinking it's gotta be either one of the following two:

    A) An immigrant petition giving me immediately available immigrant visa number that has been approved, or a special immigrant visa petition filed with this application that will give you an immediate available visa number, if approved.

    H) Other basis of elegibility. If so, explain.

    I am in the U.S on an F-1 VISA currently on OPT. My work permit expires in December. So which one do you guys think I should check??

    After reading through the instructions for I-765, I have a few questions:

    1) Since I am also filing the i-485, do I not have to pay ANY filing fee for i-765?? If so, thats awesome!

    2) The instructions of the form says: If you are a lawful non-immigrant authorized to be employed with a specific employer under 8 CFR 274a.12, please do not use this form. Well, I actually already have an EAD card (expires 12/2009) from being an F-1 student and working here on OPT for a year. Can I still file?

    3) If I file, am I checking the box that says permission to accept employment, or do I check the box that says renewal of permission to accept employment?

    I have tried calling the USCIS to find information or help with filling out these documents. They have the WORST customer service department I have ever dealt with. They are just like robots reading off a paper telling me to contact a lawyer with any help that I need. I am so glad this website exists!!

    Know that I appreciate all you guys's help and input! Thanks again everyone for taking the time! This is all very overwhelming!! :(

    Real quick, thank you all for helping me out with my application! I really appreciate that!

    I am an F-1 student on OPT from SWEDEN who just got married here in the U.S. I am now filing for adjustment of status, and have a question. My question is on form I-765:

    The instructions of the form says: If you are a lawful non-immigrant authorized to be employed with a specific employer under 8 CFR 274a.12(B), please do not use this form.

    I am a non-immigrant authorized to work for a specific employer, but only until December 2009. WHAT FORM DO I FILE IN ORDER TO RECEIVE AN EAD CARD (WORK PERMIT) WHILE I WAIT TO RECEIVE THE GREEN CARD, IF I AM NOT ALLOWED TO FILE THE I-765??

    I do need to work while I wait to receive the green card, so can I still apply for the I-765?? Anyone else had the same situation??

    My girlfriend and I just married last Saturday, so now I have to get used to the idea of saying "wife" instead of girlfriend. It feels weird, but good!! :)

    I am here in the U.S working on my OPT (optional practical training) after receiving my college degree. I have a work permit (EAD) that expires in January. I am on an F-1 VISA. I have started filling out the documents that I have downloaded, and I would like to send everything in this week. Can someone please tell me if I have the correct paperwork? Is there anything else needed when filing for Adjustment of Status when I am currently on an F-1 VISA? The forms I have downloaded so far are:

    I-130

    I-485

    I-765

    G-325A

    Is this it? Any other suggestions or tips? Any response would be helpful. Thanks alot!!!

  6. My husband and I got married in Florida, all they wanted to see was my Swedish passport.

    Call or Email the Swedish Tax department and ask them to send you a birth certificate a.k.a. a "Personbevis 120 med alla relationer" in English, you cannot order that particular form online. It is also a good idea to ask them to attest (vidimera) it to make it look more "official" as Americans loves stamps. If you are going to adjust status in the U.S. you might want to ask them to send two copies just in case since you will have to have one copy for the AOS process.

    Btw. the marriage will be recognized by Swedish authorities but send a copy of the marriage certificate to the National Registration office at the Tax Department (Folkbokföringen på Skatteverket) in Sweden.

    My girlfriend since 4 years and I just got engaged (!), so I am just starting my journey!! :) We are about to apply for a marriage license, and then get married in mid august. What paperwork do I need in order to get married here in the U.S (or even to apply for the marriage license)? Do I need any papers from country in order to legally marry my girlfriend here?

    I am here in the U.S on an F-1 VISA, currently on OPT working full time.
