  1. Hi guys,

    My parents Green Card has been approved. :dance: They both got their approval stamps today. Interview was completed today. Per the officer they should have their card in the next 2 weeks time frame.

    Interview was good. Officer verified all the questions answered on the I-485. Asked for additional documents (police clearance certificate etc) and verified their intention to maintain their residence in the US. The interview lasted about 15-20 minutes. Officer was very cordial and helpful.

    Online Case Status has also been updated promptly. I am impressed.

    My parents are scheduled for an interview. We had filed their Adjustment of Status in July 2009. Couple of clarifications needed from the team here.

    1) My moms fingerprints turned out to be fine, however my dad had to go to fingerprints twice and even then a 'fingerprint rejected' notice came. Then we got an interview notice for may dad and he has been asked by the field office to provide a police certificate from the townships where he has lived in the US in the last 5 years. Unfortunately, our township does not issue 'Good Conduct' certificates (read no arrest records etc) if the person has not lived more than 180 days in the town. Since this is the first time my dad has stayed for more than 6 months, they issued a letter for only this trip. We could not get any certificates for his previous stays with us (each one of them was shorter than 6 months). Is this ok ? Does anybody have any experience in this regard

    2) My Parents have been given 2 different interview slots (one right after the other) - I found this odd - since I thought that both the parents are typically called in together for an interview. Any experiences you could share in this regard would be helpful. Like what are the typical questions they ask in these kind of cases (adjustment of status in the US for parents)

    3) As a petitioner for their I-130, can i accompany them during their interview? My parents can speak and understand English, however sometime the accent throws them off. Do you think the officers would let me accompany my parents during their individual interviews? Any suggestions

    Appreciate any early response on this matter. Thanks in advance for the guidance.

  4. No I did not. My understanding was that you need to send G-325A only with I-485 applications. Technically, I am not the one applying for I-485, it is my parents who are, hence they need to send it for themselves only.

    However, on this forum, I did read that when you are sponsoring your spouse and he/she is adjusting for I-485, then you have to send the G-325a for yourself as well as your spouse. I believe the instructions for the form I-485A say the samething.

    You might want to carefully check the instructions on Form I-130, I-485 and G-325A

  5. According to Page 4 (item 13) on the I-485 instructions document, one needs to submit G-325A for the folks submitting I-485.

    In the I-130 instructions document Per Page 2 - Section 1-D, if you are submiting a petition for your spouse, then you need to submit G-325A as well.

    Note all forms are cumulative in nature. e.g. If you are a husband sponsoring your wife, and are submiting an I-130 and I-485, then you need to submit 2 sets of G-325A forms (one for I-485 and the other set for I-130)

    Hmmm - you have an interesting point about the excessive amount. The $70 checks that I had sent were meant for domestically reviewing the I-864 forms. Here is the quote from the Immigration forms link on the USCIS.gov site that I had referred to when sending the package

    'I-864 - Although USCIS does not charge a fee for this form, the Department of State does charge a fee of $70 when the Affidavit of Support is reviewed domestically. This does not apply when the Affidavit of Support is filed abroad. '

    Looks like my interpretation may have been off. Any ideas when this applies?

    Submitted my parents AOS (they are in US - B1/B2 Visa) - July 29th

    Received by Chicago Lockbox (on July 30th)

    No news since then....

    They haven't encashed the checks nor have they sent any NOA ($1010,$355,$70 etc). It has already been 2 weeks since they received the I-485, I-130, I-864 etc...

    Any ideas what might be happening? I do see a lot of other folks on this forum have received their NOA (difference being that they are all filing for their spouses?)

    Any insight is appreciated

    Just when i thought i had all the ducks in a row, here is another question -

    Since I am filing my parents I-130 and I-485 concurrently (while they are here in US) and the supporting I-864 form, it seems that i need to send additional fees of ($70) for the domestic review of the I-864 form.

    "Affidavit of Support Review (only when AOS is reviewed domestically), Form I-864 : $70.00 " - text extracted from the Department of State website.

    Could anyone confirm if I am interpreting this correctly. please advise - who should i write the check to ? USCIS or Dept of State?

    Almost ready with my paperwork for filing I-130 and I-485 concurrently for my parents. One last question (hopefully) for the group

    - Do I prepare 2 separate packages for my dad and mom and send them separately via Courier? or can i bundle the 2 packages into one Courier envelope?

    Please advise ASAP. Need to wrap this up tomorrow

    I am completing the forms for my parents 'Adjustment of Status' while they are in the US on B1/B2 Visa. Couple of questions on form I-485

    1) In Part 1 - What should we answer in the question 'Current USCIS Status'?

    2) In Part 3A of the form, there is a question 'Were you inspected by a US Immigration Officer?'. I am not sure what they mean by 'inspected'. My parents, while entering into US breifly (which is customary for every visitor) talked to an immigration officer for getting their I-94. Is this considered 'inspection'?

    3) In Part 3B , there is a question "List your present husband/wife, all of your sons & daughters ...". Clarification required - we are applying the AOS for my mother as well. Her application is a separate I-485 form. Do i need to answer the sub-question 'Applying with you' - Yes or No?

    4) In Part 3B , there is a question "List your present husband/wife, all of your sons & daughters ...". Clarification required - Do I need to mention my name as well as other sons/daughters of my parents who are citizens of the US?

  11. To understand better and have you get correct information, your parents are Currently in the US? Therefore you will file the AOS from here?

    Yes that is correct.

    I think this changes a few things as far as filing. The I-864 is very confusing to say the least especailly when you are sponsoring 2 people. When I did it for my step kids I just put the same amount on each I-864 as gratefully I was able to cover that many.

    Not sure i understand this clearly. Could you elaborate here - for eg - if you are a family of 4 already, adding your parents would make it 6. But given the choice of questions on the I-864, it seems like that you can count for only 5 on each of the parents I-864.

    If you are adjusting from within the US then you will not get the DS-3032.

  12. Thanks for the clarification.

    Also I noticed in your timeline that you seemed to have filed I-864 only after some time. Is this what is expected ? Are we supposed to NOT file I-864 along with the entire package of (I-130, I-485, G-325A etc) unless asked to do so? My parents are here in the US and we expect them to do their AOS here in the US.

    BTW - What is DS-3032?

    Please advise.

  13. I am not sure. Maybe I need to understand this paragraph better from the Form I-864's instructions. Please help...

    "Separate affidavits of support are required for intending immigrants for whom different Form I-130 family-based petitions were filed. For instance, if you are sponsoring both parents, each will need an original affidavit of support and accompanying documentation since you were required to submit separate Form I-130 visa petitions for each parent."

    Per this it seems we have to submit 2 different I-864's for each parent (one for mother and one for father).??? :help:

    I am in the process of putting together the paperwork for filing my parents Green Card. My parents are currently in the US and we plan to do an adjustment of status here in the US.

    What documents need to be submitted as one package? I have the entire list of forms (G-325a, I-130, I-485, I-864 - 2 sets - 1 for each my mother and father). I am trying to understand what items have to be submitted together as a package?

    Any insight and experiences shared are appreciated.
