  1. I don't believe there is a statutory requirement for the petitioner to attend the interview, but the IO has the discretion to require it. Unlike a K1, a K2's eligibility to adjust status is not based on a relationship with a US citizenship, but is derived from their K1 parent's eligibility. Generally, if the K1's adjustment is approved then the K2's adjustment is approved unless an inadmissibility has been uncovered. Even so, the IO has the discretion to insist that the petitioner appear at the interview, but they won't deny AOS just because the petitioner and K2 don't get along.

    What AOS documents are you referring to? You should have submitted everything required with the I-485 petition.

    I am so relieved to know that my daughter can AOS even if my husband would refuse to come at the interview.I just pray that he'll change his mind though or the IO would approve the AOS even without my husband's presence.

    The AOS documents I was referring to are the items listed on the letter requesting the applicant to appear for the interview (I-797C NOA).

  2. I need advice for the AOS of my 19-yr old daughter who came to the US in April 2010 as K2. We filed her AOS only last Nov. 10, 2010. She has done her biometrics and her AOS interview is on March 28, 2011 . The problem is, my husband and my daughter don’t get along very well. I must admit that my daughter has some attitudes and behavior that irritate my husband so much. When I told my husband this morning to include in his schedule about the AOS interview, he said he is not interested to come unless she change her behavior, and make peace with him. I don’t think my daughter would change her behavior overnight just because of this interview and my husband, it seems to me is not kidding either...I’ve managed to stay calm and avoid all things that could put a strain in our relationship. My question is, Does the petitioner need to be present during the AOS interview for K2?. I haven’t prepared the AOS documents for my daughter yet, but I think I could use the ones I used before when I did my AOS. ( I already have my 2 yr greencard.) Thanks.

    My fiance's recent tax returns shows that his income is below the poverty guidelines but his pay stub for his part time job (in sales) exceeds the amount stated in the poverty guidelines. He is petttioning me for K1.

    I can't help but feel very very worried and stressed out. What are our chances of being approved?

    This is a call that must be made by the consular officer conducting the interview. They may be reluctant to consider a few pay stubs if the work is part time. If he can get a letter from his employer stating what his sustained income is expected to be, and if that income is comfortably above the level required for his household size, then it may be enough. Otherwise, you might be better off getting a co-sponsor.

    The safest route would be to get a co-sponsor anyway.

    Thank you Jim for replying to my question. I appreciate your reply, but I heard US Embassy in Bangkok does not accept co-sponsor..

    We have exhausted all means just to increase the poverty guidelines level, Think all I can do now is pray for a miracle..

    In the Execution of Affidavit of Support,(I-134) it says “If you are sponsoring more than 1 alien, you must submit a separate form I-134 for each alien”….

    My fiance is petitioning me for K1 and I have a daughter who is coming with me. Would that mean, we have to submit two sets of form I-134?. Please anyone, enlighten us about this.

    I've been reading the VJ forum everyday for quite sometime now and with all these many information available, it just made me more confused. Can anyone here,please tell me how many days is the medical exam in Bangkok hospital be?

    I read that it there were applicants that has two come back the next day. Or some wrote two dates for their medical exam in their profile here in VJ..Please, I need some clarification on this.

    I received the Letter of Employment from my fiance sent through the mail along with all other original documents required for K1 interview. My concerned is that, his job (sales job) is not really a full time job and thus, he does not have a fix income. My fiance said not to worry because he'll attached his pay stub as proof that he is earning. (he is the USC).

    Would this work against us in our visa application?

    I'm a newbie here. We received our NOA2 for K1, a week ago and anytime soon, the packet 3. As I understand I have to undergo a medical exam. My problem is, I have develop severe skin allergy a month ago. The allergy is now under control but it left ugly marks all over my body. My worry is that I might not pass in the medical exam because of this. Please, I want to hear from people who might have experienced the same problems. Thanks for all your response.
