  1. Hello all,

    I filed I485 along with I131 and I765 after got married in January (K-1 visa). I received the NOA1 on Feb 2nd indicating the receiving date of Jan30. I haven't received any communication regarding my biometrics from USCIS and the case has not been updated since then. I saw that many people got their biometrics appointments in 1-2 weeks after NOA1 and I am getting worried about my case. I wonder if there is any other VJ member that filed in January and has not received the biometrics appointment, yet.

  2. Impossible... NVC is the gateway to the consulate delivery system and is responsible to assign the appropriate consulate and new consulate case number. The USCIS has NO IDEA which consulates do or do not do the type of visa being petitioned for.

    For example, if you put on your petition that you want an interview in Mexico City and the USCIS sent it there you would be out of luck as Mexico City does not do K-1 visas, only Ciudad Juarez does...

    How do you know that USCIS has no idea about the consulates processing I-129F? Is it too difficult to have a list of the processing consulates?!!! They can simply get it from NVC.

    Although I don't want to insist, but it makes so much sense to me that they send I-129F directly to the related consulate. It saves so much time for NVC and payment to DHL (from USCIS to NVC and from NVC to the consulate). After all, NVC doesn't do anything except giving a case number, which is basically useless when the designated consulate is already known.

    It was also mentioned in my letter of approval that if we want, we should contact the consulate for transferring the case to another consulate, or the petitioner can file I-824 with USCIS for change of consulate. It didn't say anything about NVC. Do you still think it is Impossible?

  3. My NOA2 (July) for a K1 from the Vermont Service Center stated my petition was being sent to the Consulate. I called the NVC today and they informed me that not all Petition's go through the NVC (I thought they did.) I was informed if it stated "being sent to the Consulate" it was. Some go directly to the consulate. Did your NOA2 state it was going to the consulate?

    Yes! I received my NOA2 on July,28th and it says that the petition has been forwarded to the listed consulate. I called USCIS and the operator told me that I-129F petitions are directly sent to the consulates whereas I-130 petitions are sent to NVC. I'm not sure if it's a new policy or the guy in USCIS just wanted to get rid of me!

  4. We received our k-1 approval via email on 28th. I called NVC this afternoon to see if they've received our case and the operator told me that I should have the actual letter in hand and read the first paragraph to her!! She said that there are different instructions for different cases. What does the first paragraph of approval letter says? Is it possible that the instruction says that your case goes directly to the consulate?

  5. My father filed I-130 for me (unmarried son above 21 in 2005, type F-2B). Last week, I received a letter from USCIS saying that my petition approved and NVC will send me further instructions. I wonder how long it will take to complete the process and get the green card. I've already waited for 4 years and don't know how much more I have to wait. The cut-off date on Visa bulletin says that NVC is processing April 01. It is confusing to me because California Center Website was showing that they were processing Feb 02, while I got my approval! Does anyone have any idea what is the real time frame?
