NO ABUSE as far as I know... They married within 90 days - here less than a year - maybe 7 months. They just can't agree.

I told her to do her best to adjust to the living conditions here and both of them should adjust to each other, otherwise, just leave and start over somewhere else.

The best move for her and the child is start over without this guy... Go back home to the Philippines, find another country where it's easier to get work visa - this way she can support her child, and maybe try to immigrate to the US again a few years later.

The guy's parents are the least bit worried about their son? I hope they are doing all they can to find him. Maybe they know where he is. He sucks for not facing up to his respnsibility, this is a child another human being we are talking about here. I hope he'll have a change of heart and mind and grow up - maybe what his parent wants to happen.

I have a friend who came here on a K1 visa. They got married but now they can't seem to agree on anything. Now the USC is not going to file AOS. When I did it, I filed the AOS for my wife and I'm the USC. The instructions don't say that USC must be the filer. I'm wondering if she can file herself based on marriage to USC via K1. Even if she gets the temporary green card, she'll have problems with lifting the conditions right?
Without a valid marriage the USC who petitioned her and the USC signing the I-864(needed for AOS), your friend cannot adjust status. She would have to divorce and leave the country.

I told her to just divorce the guy and start over... she will probably be deported because USC will probably report the divorce.

She would not necessarily be deported, but she would need to leave the country to on incur a ban for too much unauthorized presence.

Has anyone gone through this, divorce before AOS? What happened with the person, AOS, and I-751? Did you get your GC even though you were divorced before AOS? NO, this is not possible w/ K-1 visa. if you divorce before AOS, no GC, no chance to AOS w/ anyone else but the petitioning USC.

My advice to her was to get divorced and leave the country so that she'll have a "good record" with the USCIS. She gets to see her daughter (3 or 4 y.o.) and try to immigrate to some other countries - UK, Canada, Dubai, etc - and then try US again after a few years... If she overstays and hide, she won't be able to physically see her daughter for a long time. But then again, it's a sacrifice both of them faces for the betterment of their future. She'll have to work hard on making her daughter understand their circumstances. I still think though that she should NOT go into hiding after divorce.

I have only received the mailed approval notice - no touches or emails since biometrics. I'll wait and see if I get a similar email - I was approved June 22.

Same thing happened to us. We got letters in the mail first and the green card before they updated the website or sent us email.

Four months ago I called the uscis telling them that my one year extention will expired in August and the lady told me that my one year extention is good for a year and I don't have to worry about my status, because I told her that it's been more than 6 months and still not receive my 10yr GC. She then told me that the processing takes a year not 6 months and their system has problem from the backlog. But until now, I still don't have my 10yr GC. I'm getting worried. I tried to call them again this month but there's no way I can speak to a live person, so I made an InfoPass today and my appointment will be on July 10th. Hopefully I'll get another extention or the 10yr GC.
Any one of you here is on the same status?

Nothing to worry about but for documentation purposes better to get an I-551 stamp on your passport. Make sure your passport is not expired or expiring. That stamp is useful for renewing drivers license and other documentation requirements. Also, on the 13th month after filing send a letter to the ombudsman. find one of my posts under DNALERI, it has info on how to reach ombudsman. I got my green card after writing to the ombudsman for help. We waited 16 months.

We contacted our local congresswoman's office, we got a response from USCIS within about 3 weeks, granted it was an RFE but at least that means it wasn't gathering dust anymore....

About 2 weeks after I got a letter from the Ombudsman, we got approved. Thanks guys!

Does anyone want to share their experiences renewing their DL in New Jersey with a 1 year extension letter while they are waiting for their 10 year GC? I sent my 751 in to VSC in January, and my DL expires in July. Will I be able to renew or is the infamous MVC in NJ going to cause me trouble? Any advice appreciated!

Yes. Just bring all documents required by the 6-point verification system plus your old green card and extension letter. If after one year you still have not received your permanent green card, have your passport stamped with I-551 to prove your status as green card holder.

MVC did not give us a hard time.

This is a bit of a tricky situation that I would appreciate help from anyone who's been in it.
My wife has a green card and she needs to go home to the Philippines next week to attend a family service. Here's the problem--her passport has her first name and her maiden name since it's the one she had to get her into the country in the first place.

So, we ordered her round trip plane tickets tonight and put her first and maiden name on them to match her passport.

Here's the problem....she needs to get her passport renewed in the Philippines since she's now married to me and she told me that her Philippine passport will put her first name and new last name of mine. So, our dilemma is that when she starts to leave her country she will have a passport with her first name and my last name but boarding passes with her original maiden name on them. Will this cause any problems with customs?

She can get an amendment from the Philippine Consulate/Embassy near your residence. Or, if the passport is about to expire, just get a new one. The only thing is you have to register your marriage through the embassy. The embassy will forward your Report of Marriage to the NSO in the Philippines.

As for your travel now - just bring marriage certificate.

Or give me some kind of update as to what is going on with the case. I did not get any RFE's from USCIS. I got the NOA, bio appt for me, bio appt for my son, that's it. NO RFE.

Hello guys... we submitted our application to remove conditional status back in December 2007 but have not received a decision - it's been 16 months.

We went to USCIS Newark to get the stamp on the passport to prove legal status. We got that... but no one there could tell us what is going on.

In January 2009, we received a fingerprint request for our son - 12 months after submission of application. Our son is only 5 years old so I don't think they'd need to do FBI background check on him. I think the delay was because they did not have our son's fingerprint. I hope it won't take another 12 months from January 2009.

Anyway, the officer there told us that my wife can apply for citizenship even if she doesn't have her permanent green card. The only problem with this is that it will further delay the green card process. Of course, if she gets the citizenship then they'll save money on not having to produce her green card, so they want the green card to wait for citizenship result.

Should I contact my senator? How do you do this?

My application was received on December 17, 2008 and nothing still... 1 year and a couple days now. I hope and pray we will get it soon. I wonder what we are considered now since we still don't have any word from them.

Anybody in same situation? I checked out the processing time and it said December 20, 2007 - and mine was received December 17, 2007. USCIS did not even send anything saying that they are aware that the one-year extension expired and this is what's going to happen next or it's been extended for one more year. I have to go back and read the letter again - it might have said "valid for 12 months or when application is approved"?

What should I do now?

Also, USCIS customer service is no help. I can't seem to get a person to talk to me... I press 0 and it hangs up. Any advise?

My question is; Are K1 holders, who received the conditional status, considered lawful permanent residents with regards to the citizenship application? The N400 guide says LAWFUL PERMANENT RESIDENT married to and living with a USC for the past three (3) years.
Does this mean we start counting the 3 years from the time conditional status is lifted or from the time conditional status was approved?

I thought after 3 years of marriage (actually, 2 years and 9 months) to USC, regardless of conditional status, he or she can apply for naturalization.

Can someone who went through k1-conditional-lifted-citizenship confirm this, or anyone for this matter?

Look at your greencard... it has on it "Resident Since mm/dd/yyyy" that is the date you need to work from.... so you are eligiable for Citizenship 3 years from that date... the earliest you can apply is 90 days before the 3rd anniversary of your Resident since date.... I have my 3rd wedding anniversary in April 2008 but I am not eligiable for Citizenship until Nov 11 2008 and the earliest I can apply is Aug 11 2008....

Hi all, my husband just received his EAD and found a job. His SSN states that he is not work eligible without DHS authorization, which I'm assuming the EAD is. Do we need to go back to the SS office with his EAD and get his SS card updated or can we leave it till we get his greencard (hopefully middle of Feb!)? I dont want him to get into any trouble with his job with a stupid SS card misunderstanding. Thanks!

The EAD is the authorization from the DHS. Get his card updated after he gets green card.

It really depends on how quickly your service center is processing. Perhaps a search for other I-751 filers under VSC will give you a better answer.

Looking at the timelines started by eau_xplain, VSC normally takes over four months. The USCIS website says that as of Dec 14, VSC is processing I-751's received March 1, 2007. This is a ten-month lag.

Thought I would throw this out there regarding a cruise we've got planned for Aug 2008. We're going to the Mediterrenean (Italy, Greece, Turkey) and we're assuming we won't have our 10 yr GC by then. If that's the case and we're traveling with the expired GC and the 1 yr extension NOA leltter and a Mexican passport will we need to get visas to enter any or all of the countries we'll be visiting? I'm assuming these countries won't accept an expired GC so if traveling on a Mexican passort...how does this work? Does any one out there have personal experience they can share?

Hamburgapples is correct. Your Green Card is for US entry only. You will need to ask your travel agent or the cruise customer service for the answer. When we went on our cruise for the first time, we had the same questions. The cruise company took care of everything including temporary entry to the countries we visited. As long as you have sufficient identification, you will be ok. Read more about this on your cruise's website or call them and ask.

Anyone here know about derivatives? Do derivatives (children included in application) have separate biometrics appointment than the principal applicant? My wife, principal applicant, received the appointment and had the biometrics done this weekend. I asked the person there about my son and he said that my son will receive his own appointment. Is this true? Can anyone confirm? Thank you!

It looks like VSC is the only that takes over a month from biometrics to approval. VSC is taking over four months.

We received a letter, not an NOA, from the USCIS telling our son (it was addressed to him) that he is being included in our petition to remove conditional status. The letter includes their ARC #s, EAC #, and all other info relating to the petition including the confirmation that he can stay and work here for up to one year or while the petition is being processed, whichever comes first.
Also, the check was cashed Dec 13 but only cleared today. Looks like everything is in good order. The only thing is my wife did not receive an NOA or formal notification of receipt. It may have burned up with the mail truck that caught fire last week. I have to verify this and call USCIS.

We received my wife's NOA stating that her conditional status has been extended for one year and that she will receive an appointment from ASC for biometrics.

I'm a little bit confused and please help me. the NOA has this paragraph and I hope you guys had it too.

"If you have not already done so, provide supporting documents to assist USCIS in processing your petition and to establish eligibility to remove the conditional basis of your permanent residence. PLEASE INCLUDE A COPY OF THIS RECEIPT NOTICE WITH ANY SUPPORTING DOCUMENTS YOU SUBMIT. Such evidence may include, but not limited to the following items:

- Lease of joint tenancy or joint ownership of assets

- Joint mortgage agreement or property deed

- Tax returns

- Birth Certificates of children born from the marriage

- Joint policies of life, medical and car insurance."

This is not an RFE, right? This is just a reminder. I will still bring to biometrics what we submitted originally.
