  1. Since I'm filing the I-130 and I-485 together, along with G-325A, I-765, I-131 and I-864 I'll be sending them to the Chicago lockbox.

    -Is it correct that I should include four copies of G-325A to go along with the I-130 and another four copies to go along with the I-485, all in the same package? Should the G-325A also go with any other forms?

    -Is it preferable to include the I-864 in this package or wait for them to request it? My preference is to include it in this package because my income for 2009 is going to be borderline.

  2. Guys & gals,

    I am about to send out my I-130/485 packages today. Yesterday I checked the version of each of my forms against the latest on the USCIS web site as I initially filled these out in May of this year. They were all still the latest except the G325. No biggie, I just downloaded the latest version and began completion for my wife and myself last night by typing everything in. The problem is that the formatting of the later version is terrible. I can't even fit some of the information like my employers' information in the form without some serious abbreviation and using two lines for each employer. In the old form I was able to do so. I also don't think I can change the text size so that does not seem to be an option. Does anyone know how to do this?

    The USCIS web site states that "Edition Date: 6/12/09. Previous versions accepted".

    Can I just use the earlier version of the form without worry about it being rejected?

    I had the EXACT same problem with the G-325 when using Adobe PDF. I decided to try opening it in another PDF application called Foxit and everything fit. Foxit is free, fyi.

  3. Did you get married BEFORE or AFTER she entered on the B2 visa?

    We married in Mexico before she entered the USA. Her residence is still in Mexico. Bank accounts, return airplane tickets etc. Our plan was to come up here and put together our documents for CR-1 filing and then she (we) would return to Mexico until it's finalized, then we discovered that she could stay here if we file the I-485.

  4. Hi VJers. My wife and I are working on our CR1 Application and would appreciate the help of experts. In the USCIS site we found that if she is here in the US when we apply, that we should concurrently file for I485, Adjustment of Status. Any comments or suggestions?

    Now, regarding the forms, our questions are:

    - In form I-130, do we state her address in the US (mine) if she applies from within the US? Or do we use her permanent residence?

    - In form G-325A, 'This form is submitted in connection with an application for', do we include the I-130 Petition AND the I485 (Adjustment of status), as well as the Affidavit of Support?

    - In the I-485, what should we fill out as the current USCIS status? And where can we locate her Non-immigrant visa number?

    - Finally (and thanks for your patience) the affidavit of support. Do we first pay the $70 fee and THEN send the form?

    You would need to give a bit more information about what type of visa your wife is here on..

    She is here on her Bi B2 Visa (visitor visa?). It was stamped for six months when she entered one month ago.

  6. I am a US citizen, engaged to a Mexican. We're weighing our options of K1 vs. CR1. If we get married (in Mexico) and file for a CR1, we were wondering if she would be able to use her Tourist Visa to visit me while we're waiting for the CR1 to process. Although her Tourist Visa has a time limit of 6 months I think if she came here and told them she was staying until we received the Spouse Visa cr1, or the full six months whichever came first, that they would probably not allow her to enter.

    What would a reasonable time for a visit be that they would permit?

    Would they limit the number of visits she could make?

  7. Hi and thank you for your response! I already have a visitors visa, so does that by any chance mean that we can apply for K3 or CR1 now in July, and during the time I have to wait, I can visit the US?

    David, my boyfriend, lives in the US. Thanks for clearing out our doubts about the DCF. I was hoping that was the fastest way... our desire is to get married before October... could you please tell me how long (give or take) the K3 would take to process?

    :no: You are not married; so you are not eligible for either K-3 or CR-1. Only for K-1. And indeed, considering wait times it is highly unlikely you would have your visa by October.

    I'm assuming your question of applying for the K3 or CR1 in July is based on getting married first. You can apply for the K3 or CR1 only ONCE YOU ARE MARRIED. After you are married and file for the spouse visa I see no reason why you couldn't use your visitors visa to enter the US while waiting for your K3 or CR1. Anyone else?
