  1. Hello! My fiancé and I are thinking of appyling for CR1 or K1 - I have my tourist visa (I'm Mexican) and I want to be able to come up and visit him (he's American) in the time we are waiting for the visa. Is one visa (CR1 or K1) more advantageous than the other, when it comes to entering the US to visit as a tourist? We want to be together and don't want to face the risk of deportation. Thanks for your help, very much appreciated! Good luck to all VJers! ;)

  2. No, you cannot move to the US without a visa even after you are married to a US citizen. If you want to marry in Mexico then I think filing the I-130 for your Cr-1 visa is your best bet. After you marry in Mexico and file, you may visit using your tourist visa but you cannot live there in the US on your tourist visa.

    Hi and thank you for your response! I already have a visitors visa, so does that by any chance mean that we can apply for K3 or CR1 now in July, and during the time I have to wait, I can visit the US?

    David, my boyfriend, lives in the US. Thanks for clearing out our doubts about the DCF. I was hoping that was the fastest way... our desire is to get married before October... could you please tell me how long (give or take) the K3 would take to process?

    :no: You are not married; so you are not eligible for either K-3 or CR-1. Only for K-1. And indeed, considering wait times it is highly unlikely you would have your visa by October.

    Len, one quick question: if I already have a tourist US visa, can I visit the US while my K1 is processing?

    If you enter the US with a K-1 visa (your only option at this point); you have to marry in the US within 90 days of arrival. so no, you cannot get married in MX.

    Unless you plan to wed in Mexico, it's going to be nearly impossible to get married by October. K-1 visas are taking about 200 days from sending in the paperwork to getting the visa. This can vary signficantly from case to case, but it's unlikely anyone is getting through the entire process in less than three months.

    Once you file K-1, you shouldn't enter the US. It's only 6 months...okay I know it long time for lovers...but it's worth the wait.

    Look around on this site for more stories about coming after filing but before approval.

  6. Hi, this is a wonderful Web site! My boyfriend and I found it and are learning all about our options and requirements to get married soon. He is American and I am Mexican. We're considering the ramifications of getting married in Mexico, applying for the Spouse Visa, then I as a Mexican resident with a US Tourist Visa, 'visiting' my husband using that while we wait for the Spouse Visa. Can someone be kind enough to tell us if that's the way we should proceed? What is the best option for us - the Spouse Visa or the Fiancee Visa? Or, could we apply for the Direct Consular Filing?
