The problem is I did filed 1040 2014 with married filed separately, put my wife SSN as NRA. However, i got checked list from IRS saying that i need to put my wife SSN in 1040. What should I do?
Should i just not filed for the year 2014 and 2015? and included the written statement explain no income with I-864 package?

I have no income in 2015. Im currently filing petition for my wife in Vietnam. I have stayed in Vietnam for 3 years now. Our I-130 approved already. I try to filed tax for the year 2015. When i filed 1040 to IRS, i chose filed married separately with my wife SSN typed as NRA (non-resident alien). However, I got IRS request for my wife signature and her SSN, even though she is in Vietnam and has no SSN and no income in the US.
Should I not filed tax for 2015 and write a statement saying that I have no income? or what else could i do if i want to filed tax as married.

I currently live in Vietnam with my wife for 2 years now. I am filing IR1 for my wife. For the I-864 package, which address should I put down, the Vietnamese address or US address?
I know that I need to prove my domicile intention in the US. Which I will have some document to support it.

Do you think I should complete the AOS package first, and then let the IV bill package delay until after my baby was born?
Or should I just let the AOS package and IV bill package delayed altogether?

Hello everyone,
I'm applying for IR 1 visa for my wife in Vietnam. We've been married for 1.5 years. However, we found out she got pregnant after USCIS approved our I-130 application. So her interview date should be around April 2016. Her baby due date is May 2016. Should I go ahead and proceed my application to NVC as normal? Or should I delay the process at NVC stage so that after she deliver the baby, we will continue the application?
I am afraid that the vaccination and medical exam for IR1 application will affect my baby?
If we want to delay the process, when is the deadline that we should pay the AOS fee, IV Bill Fee, send I-864 package, send DS-260 package?

I am USC now. My wife and I currently live in Vietnam. We're expecting a child in May 2016. I would like to apply CRBA in Vietnam. I want to know the 5 years physical presence requirement in the US. Is the 5-year requirement count after I became US Citizen or after 14 years of age?
I came to the US in 2002. However, I became US Citizen in 2010. Then I came back to live in Vietnam 2011 until now.

Hi everybody
I am USC, in the process of sponsoring my wife to the US. My wife and I currently live in Vietnam. So I don't have any income in the US for I-864.
I need a sponsor for my wife. For the document that come together with I-864, is the tax transcript of the sponsor from the IRS in the last 3 years will be enough? Do I need include the form 1040, w2, 6 months pay stubs as well? I don't want to bother my sponsor with too much paperwork?
For worst case scenario, i cannot find a sponsor. if I put in $60000 in saving account in the US, will it be enough for my I-864 application?

My wife and I have been married for 1.5 years. I'm planning to file petition for her. I lived and worked in Vietnam, so I would like to ask that in the I-130 form, where do you put your address? US address or Vietnamese address?. I'm afraid if I put in Vietnamese address, all of the notice of action will be sent to Vietnam and it can get lost. Is it worth the risk for auto expedited process?
Do you really need the hard copy of I-797 Approval for filing with NVC later?

Here is my situation. My dad is LPR. He has filed the I-130 and the USCIS has accepted. I came to the US since I was 13 years old. I left the US before I was turning to 18. I am currently 18. Now I need to filed the DS-230 and civil documents so that my case can get completed. While filing the DS-230 part II, page 4, question h "An alien who was previously ordered removed within the last 5 years or ordered removed a second time within the last 20 years; who was previously unlawfully present and ordered removed within the last 10 years or ordered removed a second time within the last 20 years; who was convicted of an aggravated felony and ordered removed; who was previously unlawfully present in the United States for more than 180 days but less than one year who voluntarily departed within the last 3 years; or who was unlawfully present for more than one year or an aggregate of one year within the last 10 years"
In my situation, should I mark my question "yes" or "no"? I understand that if I leave the US before turning 18, all of my unlawful presence in the US will be forgiven?
So how should I proceed?

I am back. Thanks you for helping me out earlier.
My I-130 got approved, now I am in step of filling out the DS-230. In the DS-230 form, there is a part asking where has my son lived since his 16th birthday. Should I honestly say that my son is staying in the US from his 16th birthday to his 18th birthday illegally.
My son is about to leave the US to continuing his F2A immigrant visa. Do I need to tell the immigrant officer that my son has overstayed his tourist visa. But since he left the US before his 18th birthday, the 10-year ban won't kick in?
Please help me out.

My father is a LPR. He file a petition for me under F2A visa. I am currently 17 years old. And my application has reached to NVC already. Now I am in the process of sending DS-230.I have paid both IV-Bill and I-864 Bill. So I need to know what other documents do I need to send along with the DS-230 form?

So after NVC received my application package. After my PD become current, do I need to do anything? like call NVC to notify my PD become current or what?

My passport will expired soon so I have sent my passport application to the Vietnamese Embassy in Washington DC. When I mail the envelope, I used the Priority mail with tracking number. However, there was nobody to accept the package when the post office was there. And the post office left the notice in the Embassy. I would like to know if the Embassy will pick up the package at the Post Office?
Anybody that was in similar situation like me please help.

I'm in the same situation like mikumi. I have applied for reentry permit on May 18, 2010. Gone to biometric appointment on July 12. Until now, my case is still in Acceptance stage. My case did not get any touch or update whatsoever. Should I call the USCIS and ask about my case? Thanks

I don't know if my post will offer any help to you but I have many expat freinds that work oveseas. I have not heard of single incidence where any has received trouble at POE for being out over 6 months. I know people that stayed 363 days outside using only a greencard and entered without a problem. Those staying over 6 months are subject to additional inspection but I think this applies to "high risk" and "high fraud" countries only.
On your re entry permit, you should be able to get your biometrics completed in about a month's time. You can always walk in sooner than the appt time and explain your situation.
However, do expect to wait more than 4 months to receive your re entry permit. My wife applied on June 1 and it's now October 6. Still hasn't arrived. USCIS estimates processing time to be about 3 months. This is not the case.
I expect to receive it any day after seeing many touches in the case status check website.

I am thinking about let my son leave the the US before he turns 18, meanwhile, I file the I-130 for him and get his visa via consular processing. So should I file I-130 now, or do I wait until after my son leaves the US and then file?

I am 10-year US green card holder. I would like to petition for my son whose tourist visa is expired. He came in the US when he was 13 with tourist visa. Now he is 16. I would like to know can I still file the petition I-130 for my son? I still have 4 more years to become US citizen. Do you know how long it will take to petition for my son.
I'm just worry about his illegal status would effect on the I-130.
Please help me. I am in dire situation.

Thank you for all of your support. God Bless you all. It's been a emotional months for me. The only worry in my mind is about my son illegal status. Right now, I am LPR. But I think if I become USC, my son out of status issue will be forgiven once I file the AOS for him. I just don't know that I should file the I-130 and get his application in the waiting list. OR I should I wait until I become USC and file I-485 together with I-130.

But I heard that the overstay is forgiven if you are immediate relatives of US Citizen by filing through AOS procedure. Im just worry that I won't be US Citizen before my child turn 21. So by filing the I-130 now, this will give us the "Aging Out" protection. Please help me if Im wrong

My son is currently 15 years old. He came to the US in B2 visa when he was 13 years old. Now I have a Green Card in 2009. I will planning to obtain US Citizenship in 2014. Can I filed I-130 for my son and waiting until his priority date become current. Then I can file the AOS for him. Or should I wait until I get US Citizenship and file the AOS for him.
I worry that because my son is overstayed, by filing I-130 for him, we will run into the risk of deny.

I just do some research on the Medic Aid issue for green card holder. I found out that Medic aid and Medicare DOES NOT consider "public charge" for green card holder as long as they don't use Medicaid and Medicare for long-term healthcare. Therefore, the green card holder CAN apply for Medic Aid and Medicare if they are eligible for.

unless she is a permanent resident she won't be covered for Medicaid but rather emergency Medicaid...all it covers is delivery....the appts up till then aren't covered....but the baby will be covered after delivery for a year.....so don't lose your insurance!
I'm going through this right now....we're paying all the dr costs out of pocket....its very expensive!
An ultrasound alone is $300....it sucks not to have insurance!

I am currently in Vietnam, got married in vietnam 2014. my wife has no ssn and we are in the middle of IR 1 applicaiton. I want to file MFS and put NRA under her social security. Does she need to sign the 1040 as well, or just my signature on the 1040 is enough? thank you so much
