  1. My wife Manuela from Romania is a US citizen that applied for a I-130 both her parents. They sent a request for additional evidence (certified translations of Manuela's birth certificate) for both her parents in the same envelope. We paid for a certified translation and sent both letters and translations together in the same envelope to USCIS in Des Moines IA where they requested. They approved her Mom on Nov 1 and we just found out that her Dad was denied because they didn't receive the request for evidence. We sent both in the same envelope but separated by paper clips attached to their respective letters. Evidently they put both in her Mom's file. But now the only way to reopen the case is to pay $585 and file a request to reopen the case. Is there any other way to contact them? This is total incompetence. Why should we have to pay another $600 for their mistake? We have 30 days to file. How can you contact them to correct their mistake? What can we do?

  2. IMBRA is being challenged in court as we speak. Don't worry, that won't make your visa's take any longer. This law is overbearing and not of our constitution as it's written. Most of all it implies all men to be abusers and forces men to disclose all their personal information to a woman even before they can say one word to each other. A speedy receival to all of your visa's. Please let your representatives in Congress and Senate know how you feel about this law. It will help future VJ'ers.

  3. There is a way to set up some kind of payment scheme if you can't afford to file, but I don't know much about it.

    Turns out that they did marry within the 90 days. She misunderstood that the 90 days starts once she arrives in the U.S. Now she just needs to send the AOS paperwork with payment even though it's several months late?

    I didn't call it love or anything else. We're just trying to help my wifes friend in Maine that also had her K-1 visa around the same time as ours.

    Then he hedged on getting married until the 91st day. Then he did't make any attempt to do the AOS paperwork. Well the immigrant wife did the paperwork and he made out the check and said he mailed it. Well now it's been 5 months and we are sure he never sent anything.

    What if he did mail everything? AOS processing takes a while in some cases; theirs might just be one of those. How can you and your wife be so sure he never sent anything? What do you base that assertion on? Even though the wife never told you her husband didn't mail the paperwork at all, you boldly come here and state you and your wife are sure he hasn't.

    And once again, here's everyone already wrongly judging the husband and suggesting that the wife use the VAWA waiver to obtain her green card, based on a 3rd person's (OP) version of the situation. People, this is all HEARSAY! If the husband truly didn't, nor hasn't mailed the paperwork by now, he must have his reasons, valid or not. But since no one here knows for sure, including the OP, suggesting the use of the VAWA act is totally ridiculous and uncalled for!

    If what you contend might be true, when the wife prepared a second set of AOS documents to mail, what reason would there be for the husband not to simply say, "there's no need to resubmit".

    Exactly right. Now he says that he doesn't have the money. Well from what all of you have said. It appears that she won't be able to stay because she has no money to file for anything on her own and me and my wife don't have the money to give or loan her. It's a real sad situation.

    Paperwork was never sent because the checks were never cashed and she called and they haven't recieved anything from them and it's been 5 months. No notices, no nothing.

  6. Hello all. Something very bad has happened to my wife's friend who is married to a U.S citizen in Stratton Maine. Thing is they've been married for 8 months and the husband said he sent the AOS papers and payment. Well turns out that he lied and never sent the papers. What can she do? She has two very young children. Now she has all the papers ready again but he won't pay now and says that she doesn't like his animals.

    My wife is very good friends with her and wants to help but we don't know the exact law to help her. She is very scared to be illegal and wants real help.

    The whole story is he's a farmer and he acted very nice until they got here to the states. Then he hedged on getting married until the 91st day. What can this poor girl do? Is there a someone she can call? She only knows Romanian well still. We really want to help her. Anybody know the law here and what she can do? She's stuck on a farm in the middle of nowhere with two young children.
