  1. My situation is kind of similar to yours....My advice is: when you return to the US, just apply for an AOS.

    I was laid off in Toronto. My wife who is American, got a job in DC about the same time I was laid off. We flew down, found a place and then returned to Toronto, packed and shipped our furniture and then drove down.

    I was kind of going back and forth between the US and Edmonton, so had to wait before I do the AOS thing. I applied in late May and got my GC last week...so all in all about 3 months!!!

  2. Seems like you might be wrong on this...I have seen many threads that seem to indicate that it is legal fro me to do so....My intention was not to MARRY and IMMIGRATE...I am already married to a USC before coming here. Also, I didn't need a visa to come join my wife...

    While there are those who have done what you're suggesting (or your attorney suggested) and been successful - that doesn't make it legal.

    What is being suggested is a method of circumventing US immigration law(s). I've said this to many people before - as long as you're aware of what you're doing (in other words not being naive about it) then at least you know what you're getting in to. Make no mistake, there are potential risks which I hope your attorney explained to you.

    The choice is yours. :thumbs:

    yup..just got my Green Card approval...I think you are scaring people off...and you should not post your opinion!!!

    I don't think I coud have asked for an officer who was this nice. She even said: Oh...you're Canadian...Of course they don't stamp your passport and never asked a question other than simple formalities.

    To all of you folks going though this: THe USCIS officers are nice people and they are only doing their jobs, nothing more than that. They aren't trying to go after people and to be inquisitive about their personal lives

  3. so...here's the scoop:

    We get the letter from USCIS...

    They need proof of my wife's income!!! My wife's income is over 100K and yet the letter says that her income is below the poverty line....wow!!!

    Is this some kind of default thing since her income in Canada last year was pretty small only doing part time consulting work and her declared US income tax was pretty tiny?

    I'm really confused how the US system works.....But our combined income in Canada last year was quite high...Are we able to submit this as evidence???

    At any rate, they are asking my wife for 6 months of pay stubs , but we only moved here in February!!!

    I am sensing a long and difficult process!!!!

    I am not sure - I was also wondering if the EAD and AP were administered at NVC or at the local field office. I still haven't been touched since May, and did my biometrics 3 weeks ago. Who else is with me? I am at the Memphis field office.

    I don't have any news yet either. But I am at the Detroit field office. I checked the EAD and AOS timelines here in VJ. We are still not the only ones not having the EAD, there are others who went about the same time as we did and are still waiting. So I hope we will have good news soon.

    The AOS timeline for Detroit is also pretty long. I guess that office is just not the fastest one...people who applied beginning of this year are still waiting for interview dates or for being forwarded....so I don't know, maybe there are some local offices which are just slower than other ones. I hope that this is the only problem I got with my case.

    Hi everyone,

    I'm a Canadian citizen, who started the AOS process IN THE US (through marriage to a US citizen) back in 2004... In the summer of 2005, I went to visit my family in Montreal for 2 months. I haven't been back there since then.

    So I've got a question... I'm going back to Montreal very soon (after not going back since 2005), and wanted to know if I should be concerned about anything on the CANADIAN side when i enter borders... For instance, why do they ask how long I've been gone for (what is there to this question that i'm feeling uneasy about for some reason).... Do they get upset if i say i've been gone for 4 yrs, and why is it their business? Does it send them red flags when they see the stamp on my canadian passport showing i'm a permanent resident of the US?? Will they have a problem with the fact that I married a US citizen (my husband's not coming with me though)....

    I'm just stressed out about leaving, so if anybody can ease my mind by telling me what should and/or could be asked and why, then that would be so great!

  6. Just looked at my case online. It shows that there was an update on June 12, but the message only refers to them having received my application and should they need anything, I will be contacted and made no reference to my Biometric appt taken last week?

    Anyone knows what I should make out of that?

  7. Having looked at the EAD timelines, I was just wondering why in some cases it takes less than a week to approve the EAD after the biometrics appointment and in other cases it takes over a month??

    It would seem to me that it's the same procedure applied to everyone...isn't it?

  8. I'm glad you are pointing these issues out to me....It's just a bit confusing sometimes....

    I could still cancel my I485...get a job and then get a TN visa...which is a possibility to avoid all the hoops I guess

    I suppose when you come to visit with the intention to marry AND Immigrate, is when it becomes illegal. Also - circumventing immigration law(s) by using one type of visa/entry-method in order to immigrate is called visa fraud - whether you had to actually apply for a visa or not (this includes those from VWP countries and Canada).

    In my case, I'm already married to a USC and we have lived together in Canada before she moved back and then I came here to join immigrate.

    My intention when I crossed the border was to be with my wife (for my allowed time) and obtain a TN visa if possible - which is not illegal for Canadians. I then decided to do an AOS immigrate as pointed out by a lawyer and by an officer the Washington field office. You asked the question "What are the typical issues that might come up in terms of processing my AOS?" and have been given the answer - you may not like them.

    It's all subject to interpretation of the law!!!! Not really - things do tend to look great when you have rose-colored glasses on though.

    For others who may read this - it is not legal to visit and then adjust status (immigrate) - people have been successful doing it and there have been those who have severely regretted the decision. Good Luck :thumbs:

  10. As I said you cannot adjust status but have to do a spouse visa. Fire your lawyer!!! Do a I-130 for a CR-1. After filing the i-130 check out "Ling Che's " NVC shortcuts. They will help speed things up when you get to the NVC stage.

    Don't consider a K3.

My intent was to find a position and then get a TN visa which is extremely easy to get once I geta a job offer - But I spoke to a lwayer and went to the USCIS Washington, DC field office and spke to an officer...They both said: just send in a copy of your canadian passport (which is not even stamped for an entry) and the other docs for i 485...and don't go through TN visa....they recommended the AOS rather than a CR visa or whetever it is called and having to be away from my wife

    I have been trying to get some info on the AOS process for people with similar cases like mine...

    My wife and I have recently moved to the US. She is a US citizen while I am Canadian.

    We got married in Maryland (our marriage was registered in MD) and then moved to Canada where we lived for a year and a half. Last month (May 09) we moved to the US.

    I simply entered as a visitor (using my NEXUS card) and then applied for an AOS.

    I already got an appointment scheduled for biometrics (EAD) next week. I might be accepting a job inn the next two weeks or so.

    My questions is: Should I tell my potential employer that my EAD is being processed? And how long does it take to get a SSN after getting the EAD?

    What are the typical issues that might come up in terms of processing my AOS?

    You cannot adjust status but will have to go thru spouse visa process.
