  1. Like NArocks said, I would think they would have sent you away if they weren't satisfied. They took his biometrics, right? Picture and prints? I wouldn't worry too much about it, if they let you get it done.

    I had my biometrics taken at the ASC in Brooklyn. Biometrics for my I-485 and Work Permit. I followed the instructions and bought only what was requested on the letter that they had sent me. I took my passport (as requested). When I arrived the receptionist asked to see my marriage certificate....which i had not been asked to provide.

    As I was attending the biometrics as a result of a marriage-based visa application (thus a name change) and because they had not asked to bring along my marriage certificate.

    I was told by the receptionist that because my application letter was in a different name than my passport then I would have to make another appointment (at a later date) and bring in the marriage certificate as well.

    I asked to see the manager. He gave me some poor excuse, saying it was my responsibility. But in the end he was able to see the absurdity of it, as the notice sent out from USCIS clearly stated that I was to only bring my application letter and my form of ID. THEY TOOK MY FINGER PRINTS...so it all went ahead. No REF's. If your husband had his finger prints taken then you shouldnt be worried and if they do need more information then you'll get a lovely yellow REF in the mail. (I hope you dont)

    So, the moral that I learnt from this adventure is carry all important documents together when going to USCIS. So many different departments handle our Immigration paperwork. Better you be prepared than have to deal with their incompetency.

    That's crazy about the marriage certificate. It should have stated that on the appointment form. Especially when the form is for a female that may be changing her name. Well, I'm glad it all worked out for you.

    I too have learned to always bring all important (and even not so important) documents to USCIS.

    I guess it wasn't necessarily a mistake we made if they didn't need those forms but they did state in the instructions to bring them. So then I was thinking they took his fingerprints simply for the appointment form and wouldn't process the AOS and EAD without us having brought those forms also. Anyway, I guess everything should be fine... thanks!

  2. Hello! Hoping someone can help! We were very stupid! :crying:

    My husband just had his biometrics appointment a few days ago and we only brought with us the biometrics appointment sheet. Well, I just sat down and was reading his Notices for the I-485 and I-765 and they say to bring those to the biometrics appointments!!! I know, I know, super super stupid that we didn't pay attention to them and bring them along!!! But can anyone tell us if this is bad??!! or if they will still be able to process his AOS and work permit?? Oh, we feel so stupid for making this mistake!!!

  3. Can anyone help?? We received this notice from USCIS. Is it good or bad?? When they say "Another Office" what does that mean? Where did it go? We already had the notice that it was sent to the California processing center and now... ?

    The grass is always greener on the other side of the fence, eh. My wife is currently back in Ecuador for her first visit since emigrating (I will join her soon on a brief trip); her friends are most interested in how I treat her in the marriage. In her country (and much of South & Central America), men are "machistas," meaning that they exhibit macho behavior -- the ultimate double standard. The men can stay out all night with their friends, cheat with mistresses, not lift a finger to help around the home, and (yes) punish their wives if the wives dare take a night "off" to go out with their girlfriends, for example: "Where were you? What were you doing? Who were you with? You were cheating on me!" It's a facet of society there. My wife's girlfriends are fascinated that I will do laundry & dishes, for example -- a new concept, eh.

    Here we go with stereotypes again ... is it possible for people to write without making stupid generalizations?

    I don't know anything about you and your relationship, but just because you are married to an Ecuadorian does not give you the right (or the knowledge) to trash Ecuadorian (and South American) men in general. Maybe men in her family are like you say, but that does not make all South Americans what you want to qualify them.

    I know plenty of South American families and in none of them the husband is a "machista" who stays out at night cheating while their wives are punished if they take a night off. That happens only in your dreams. In fact, if we want to continue with generalizations, these South American husbands are a lot better than most USC husbands that I know (who do indeed go out to drink with their buddies at night while their wives are at home caring of their children).

  5. Hello everyone, im new here. Well, theres not much information about this. I want to petition for a k1 visa, I receive supplemental security income and social security disability income, 730.00 a month, definitly i dont meet the poverty income guidlines, but i do have my brother and his wife as co sponsors jointly, but they do not live with me. Would that be a problem for me? Also a lawyer told me that if i use a co sponsor it will decrease my chances of success by around 20%, is that true?

    Your brother not living with you is not a problem. Immigration just wants to know that there is money that will support this person being brought to the USA. Whoever that lawyer was that told you that should not be practicing law... Using a co sponsor will NOT decrease your chances of success. If you can not meet the federal poverty income guidelines YES you need a co sponsor.

    I have been emailing some lawyers to ask them a couple of questions about my AOS, but all of them are asking me to pay from $150 to $250 for the first phone consultation, and for just a 10-15 min chat :wow: . I think that's ridiculous, so I was wondering if you can post here some lawyer's contact info (email) who are willing to accept a first free consultation, that way we don't have to spend such a fortune.

    If you have not found a lawyer yet... don't... unless you have a complicated case with legal problems, police record or a visa overstay. Otherwise it really is a waste of money when you can do everything yourself. I know it can be overwhelming but you can get a lot of answers here on VJ. If you have any specific questions send them to me. My husband and I would be more than willing to help if we can.

  7. Hello fellow VJers!

    I am outraged at the fact that VSC is operating at such a slow pace. In the last few months they have slowed in aproving petitions drasticaly. Our lives are tied in this, our finances, our jobs, future, even our health. I myself I am putting off buying a home and loosing a lot of money in finance charges and the $8000 goverment stimulus because they are moving so slow. CSC is working on petitions from May while VSC is still November and December. This is not acceptable and unless we bring this to their attention nothing will happen.

    I know that we are at their mercy but we can stir the waters and write some letters to USCIS ombudsman, to senators, congressmen, even to the white house. I believe that if they get enough letters maybe someone might take a look at this problem and try to do something about it. One: it is our right as US citizens to pursue hapiness and two: it is a service we paid for. If we do nothing about it nothing will happen but if we draw some attention to this problem, maybe something might happen and have them hire more, train more, or at least try to do something to rectify the situation. If we don't write, call, complain they will not act on anything.

    Mr. President spoke about "change" lets ask for change in this department!

    One of the problems of why the process is so long and complicated is because USCIS has hired more and trained more since 9/11. It's just gotten too big. The system is supposedly protecting us from terrorism when it's really just hurting the good people... terrorists can go where they want when they want because they are, well, terrorists. What we need is for the system to become less complicated not more and unfortunately the government plans on expanding the USCIS which probably means the fees will go up.

    In addition to this I would like to add a story that is truly angering and making the legal immigrants process that much more painful...

    I met a Polish girl that came to the states about 5 years ago, loved it and wanted to stay but her Polish boyfriend was back in Poland. So she returned home, they got married and then planned on moving to the States. They bought tickets and arrived in the US. Didn't bother going through any legal immigration, no that's too complicated... as we all know. Well, she is happily living here with her husband and two children (that are US Citizens because they were born here and all was paid for by the State when they were born in the hospital). They both have jobs being paid under the table and... this it the best part... receiving welfare checks every month since, of course, they are poor and have no jobs. I also found out that it is against the law in these welfare offices to ask if someone is illegal. My blood was boiling when I heard this.

    So, will change come for us?... No. Should we fight?... Yes. How?... Don't know, because no one in any position of authority cares about us.

  8. I find it funny when you go through the change of address option the CSR responds with your options indicate you would like to change your address, and you go, "NO, I would like to get a status on my case" :)

    It is pretty classic.. like: "AHA, CAUGHTCHA NOW ANSWER MY QUESTIONS DAMMIT!" :lol:

    Yeah, but they never tell you anything. They cant even tell you if your case is being worked on. I sent my packet on the 17th of March, they received it on the 25th and sent out NOA1 on the 31st. Now it is July 11th and still no NOA2. So I called and asked when to expect it and they said "Well, we expect maybe between 90 and 106 more days". How they hell can they be so specific (106) days? Weird. So, the guy was like "You mailed your i-129f kinda late" and I was like "Yeah, I was under the impression I had to have form I-797 before I could mail the I-129f with the I-130." So, the guy was like, "You're looking at about October before you would get your NOA2" at first, the guy didn't even know what the hell an NOA2 was. He was like "You already got your notice of action." and I said "I got the first one." He was like "Well, ma'am, it may be another 90 days or so before you hear anything. You need to wait for the alotted time." and I was like "Your website changed the projected wait time from 6 months to 5 months. So that means that it should be within the next month, right?" and he said "Thats just an estimate. If they knew the exact date, they would post it."

    Sometimes, they are so frustrating.

    I'd rather deal with a crappy website than deal with a long haul wait to get cases done. When you look at their current processing timeframes, it shows that they process H1B or any employment related visa faster than family related visa. What that tells me is it is more important to get work done than reuniting with your families. Pfff a website improvement is supposed to make things better? I'd have to revisit that in the next few month.

    You are sooo right. It's sad but true. If a company wants someone here, they can get it done but if it's family related, there's no help and takes forever.

    I sent the White House a letter with our experiences and I suggest more people here on this site do the same. Maybe nothing will come of it but it's worth a try. If they start noticing some force behind the group of "Legal" immigrants maybe we will gain a voice. We don't have one because we are such a small population of people in comparison to the "Illegal" immigrants, which is why news programs will give so much attention to one illegal persons sad story of possibly getting deported. That group has force and it's how they pull votes from the rest of the population... show that they care. Washington has done nothing to help stop illegal immigration but done so much in the last decade to restrict legal immigration, so you gotta ask yourself, what's their real agenda?

    Applicants can already do that.

    I listened to the discussion Obama gave about the revamp of USCIS and here I quote him...

    "In the next 90 days USCIS will launch a vastly improved website that will FOR THE FIRST TIME EVER allow applicants to get updates on their status of their application via e-mail, and text message and online"...

    As most of us here know this is not true, the USCIS website already allows you to sign up for online status updates that you can check online and also receive e-mails. The problem is that it is inefficient and just does not help or work. Especially if you end up getting an RFE. The information that is provided on the website is so very vague and unhelpful. Maybe there is a plan to improve the website but since Washington believes that this online service will happen for the FIRST TIME EVER, I am very skeptical to believe so. My biggest concern is that this "revamp" is going to just cause more delays because they will probably be too busy revamping the system to do what really needs to be done which is simplify the system.

  12. OK.. I spent a few hours trying to find an answer and I'm confused.. The instructions for I-864A state it needs to be notzrized. I read other posts where people say it doesn't need to. I'm not sure who to believe since the USCIS websites might have been updated since the time those people who didn't not notzrize the form filed for AOS.Recent filers(spring-summer), could you please share the experience with me whether you notarized the I-864A or not and if not notarizing it was a problem? It's not that I don't want to notarize it(it's free at a bank), i just don't know what to tell a notary when he asks me where to stamp and sign the form. I don't want to get an RFE because a notary stamped the last page of I-864A...Thanks in advance.

    P.S. Please don't confuse I-864 nad I-864A. On uscis website it DOES NOT say that I-864 must be notarized. However, it says so about I-864A.

    Especially, want to get answers from people that submitted I-864 WITHOUT notarization.

    Hi, Yes, you should get I-864A notorized and it should be by both the sponsor and person filling out the I-864A that jointly files there taxes with the sponsor because they both need to sign this form. I know they don't give room to notorize it but we had it notorized along the side of the page that both of them need to sign.

    I know you wanted to hear from people that didn't have it notorized to know what happened but it does say in the instructions to have it notorized.

  13. Besides The actual I-864, this years most recent tax info and the accompaning W2, and the birth certificate showing that the joint sponsor is an american citizen, is there anything else that is required? soooo...

    1) I-864 form signed and filled out

    2) This year tax info and W2

    3) Birth certificate proving citizenship

    Is anything else required besides the above? It says that you can put in aletter from your employer, but it doesnt say it is required, and the joint sponsor makes more than enough above the 125% poverty line.

    I would go ahead and put in a letter from the employer of the joint sponsor. We did with our paperwork and I have read about people getting RFE's for not including a letter and or copy's of pay stubs.

  14. hi folks..just found out that my friend cheated by not doing K-1, and instead married his fiancee/gf of 2 YEARS while she was here on a Tourist Visa, and now they are happily living together without ever having been caught!!!

    He should have gone through K-1 and waited like the REST OF US......

    My question is can I do anything to rat him out (I dont care about friendship anymore--we were never really that close anyway)....

    It just boils my blood knowing his story and how he got away with it!!!

    Actually I know someone that did it that way, getting married in the US on a tourist visa, and it wasn't good for them. The girl got sent back to her country until they filed the proper paperwork. She had to apply for a CR-1 visa I think, or whichever visa is for a couple that is already married. Thing is your "friend" can probably go about living with his now wife just fine, their problems will come when they want to leave the US for trips because I don't think she can get issued a green card without going through AOS. If I were you I wouldn't worry too much, it will catch up to them. What I don't understand is being so vengeful... what's the point? what a waste of time

  15. Good job reporting that CS. We had a terrible time where we are in Chicago to find an honest civil surgeon. But we called around so many times and to the same people asking tons of questions until we became totally annoying but found an honest CS's office that did the transfer of 3025 to the I-693 for $20, any additional vaccines were extra. My husband just needed one, the Tdap. One thing that helped us though from avoiding the full medical was probably that we brought with us the instructions for the I693 and showed them the part where it says a K-1 visa does not need to repeat the full medical.

    I don't think that civil surgeon's are required to keep up to date with the rules and laws so they just do what they want assuming that "WE" don't know what we are doing, and then they make money.

  16. Lots of good advice here and some bad but be sure you visit the USCIS website (uscis.gov) and read all the details. It can be intimidating and it's a whole lot of bureaucracy but it has the guidelines that you will need to follow for whatever route you choose to take. The best advice I can give you is read everything you can on that site that could potentially pertain to you and then when you have questions come back to this site and ask around. At least that way you will have your own knowledge to weed through the true and false info.

    For sure don't have her just come to the States and get married unless her life is in some kind of SERIOUS danger. Since the USCIS does not give it as an option it's just a bad idea. She could be at a much higher risk of being deported or "sent away" until you file the proper paper work and bring her in the right way. I know someone it happened to. She was sent back to her country for about 8 months until the proper paper work was filed and processed.

    Don't know for sure but if you can prove some kind of relationship and have seen each other in person in the last two years then the I-294F sounds like your best option. Here is the info from USCIS on who is eligible...

    Who is Eligible

    U.S. citizens who will be getting married to a foreign national in the United States may petition for a fiancé(e) classification (K-1) for their fiancé(e). You and your fiancé(e) must be free to marry. This means that both of you are unmarried, or that any previous marriages have ended through divorce, annulment or death. You must also have met with your fiancé(e) in person within the last two years before filing for the fiancé(e) visa. This requirement can be waived only if meeting your fiancé(e) in person would violate long-established customs, or if meeting your fiancé(e) would create extreme hardship for you. You and your fiancé(e) must marry within 90 days of your fiancé(e) entering the United States.

    You may also apply to bring your fiancé(e)'s unmarried children, who are under age 21, to the United States.

    I'm finishing all the paper and I just find out this 70$ fee with the I-864 Afiidavit of support !

    they say we have to send it to the Department of state but can we make a check en enclose it with the AOS( I-485) package ?

    I'm currently in USA !

    Yes you can put the check in with the I-864 form and mail it

    You don't have to pay for this form with the I-485 AOS. Please don't write something that you are not 100% sure about.

  18. But what can you guys say about mine, I paid $300 for the civil surgeoun to transcribe my medical, sign the I-693 and put it in a sealed envelope and sign it again. It was there with my AOS application. Good thing the civil surgeon gave me a copy. I called the USCIS and they told me that its ok to just send the copy. I have my EAD and AP already. Done with my biometrics which I had to do twice because apparently, there was something wrong with my fingerprints the first time. How could they misplace my I-693? Sigh...

    I'm so sorry they lost your medical. You should not have had to do another to begin with. I hope everything gets resolved for you somehow. We are about to send in my husbands AOS papers and we are so worried that they will lose his medical. From all the story's I have read I am beginning to think it is no mistake they lose the medical. There is some reason, like they have some commission with the civil surgeon's or something. I would really like to see a bunch of us ban together at some point and fight for Legal Immigrants Rights. What they are doing is wrong and costs not only us going through this AOS but tax payers that have no idea this is all going on.

  19. When they "lost" my medical file and sent me an RFE the VERY FIRST thing we did was call the Senator's office! It took the immigration liason a couple of weeks, but they eventually got the Charlotte district office to admit that they had miraculously "found" the lost file and it was their mistake. During that 2 or 3 weeks, I called the panel physician in Toronto and got a duplicate copy of my original medical for $40 (much less than the $400 local civil surgeons want for immigration medicals!) and sent that in reply to their stupid RFE. With of course, a harshly worded letter for them to pay attention to their own freakin rules and regulations :P

    I hate government bureaucracy, and hate it even more when people just roll over and take it, just because it's government. You CAN fight it. You just have to do it in a timely manner, or pay the consequences.

    Thank you for writing that people should not "Just Roll Over and Take It". I was getting a little frustrated reading people say just do the medical again. WE DON'T HAVE TO! We the people have to stand up for our rights. The people are the government and we are getting closer and closer to forgetting that. That's why government has so much control now, the people have let them have it.

He is just continuing the destruction Bush started, but even worse. He is leading this country right down the drain. With what he is doing we are going to see huge tax increases, which have already been started by what Bush let congress do. Now Obama hires a Pay Zar to control how much CEO's get paid! Sure they probably get way too much but why not hire one to control how much congress is spending, or how much it costs to hire a new federal agent (millions).

    Sorry for my rant but I just get sick to my stomach when I hear someone say Obama is going to save us... barff

    Anyway... Obama's talk of amnesty was just one way to get votes and he sure got them. There's no guarantee that the amnesty bill will pass anyway but if it does read it... there are all kinds of fees that illegals will have to pay like someone posted above... I read $5,000.

    My heart goes out to you for having to go through this. I can't imagine how hard it is. I wish I had an answer that would help. All I can do is wish that this process was made easier for those people trying and wanting to be legal, since most people trying to be legal are just good hard working people.

    I, on the other hand, fully believe in Obama's Salvation and believe that the He :innocent: has now Arisen. At any moment now I expect to be personally saved. So too should you! :P

    Ok, Ok, sorry :crying: I admit I went a little nuts last night. I was extremely tired from going through all the AOS papers and was just getting so angry with the whole process, so when I read that little line I took it too seriously. Last night "sarcasm" was non existent in my brain.

  21. I can't comment much on your situation because you have problems to address that I haven't studied much about. Off hand, I can't think of any way to resolve this without him either receiving a ban, or you having to lie substantially on the petition (which could land you in jail).

    However, I will say that I wouldn't hold my breath for an amnesty program in the very near future. In this economic environment, giving legal status to illegal immigrants is not a politically popular move. People don't like the idea that there are illegal immigrants working in this country when unemployment is already very high for people who are here legally.

    If and when Obama's immigration reforms DO happen, there are a few things you can expect. First, the penalty for hiring illegal immigrants is going to get a lot stiffer. Second, immigrants who are here illegally are going to have to pay a substantial fine in order to seek legal status. The fine will probably be based on the length of time they've been here illegally. In the case of EWI immigrants, that length of time may end up being determined by when they can prove they were last in their home country, and not on their own statements. Otherwise, people who've been here a decade are going to say they arrived just before the cutoff date.

    I understand your concerns and sympathy for the economic conditions of your fiance's home country. Many of us have the same concerns about our fiance(e)'s, but we are trying to help them in their own countries while trying to bring them to the US legally. Many people here are going to be offended by your desire to work an "end run" to legalize your illegal fiance, while they've played according to the rule book and have endured months, and sometimes years of separation from their own fiance(e)'s.

    My recommendation is if your fiance entered without inspection, he can probably leave the same way. Have him go home to Guatemala, and then file for a petition to bring him here on a legal visa. Be honest about his illegal stay in the US, and file for a waiver along with the petition.

    Anyway... Obama's talk of amnesty was just one way to get votes and he sure got them. There's no guarantee that the amnesty bill will pass anyway but if it does read it... there are all kinds of fees that illegals will have to pay like someone posted above... I read $5,000.

    My heart goes out to you for having to go through this. I can't imagine how hard it is. I wish I had an answer that would help. All I can do is wish that this process was made easier for those people trying and wanting to be legal, since most people trying to be legal are just good hard working people.

    Would really appreciate if anyone could help with a few questions for the I-864 forms...

    1) In form I-864A Part 2. Sponsor's Promise... 13. I, THE SPONSOR, bla bla bla (indicate number) bla bla bla. This may be a stupid question but just want to make sure. Where it says indicate number do we just put 1 on the line for my husband being sponsored?

    2)Next: I read this in the info about the I-864...

    Although USCIS does not charge a fee for this form, the Department of State does charge a fee of $70 when the Affidavit of Support is reviewed domestically. This does not apply when the Affidavit of Support is filed abroad. For more information, please see the Department of State, Affidavit of Support Review Fee, in the Related Links of this page.

    Can anyone tell me if it is true that we will need to pay $70 for this form? It does not mention this in the I-485 instructions so I'm wondering if it's included in the $1010 we have to pay?

    3) Does the federal incometax return information need to be "officially stamped by someone"?

    4) OK so I don't have enough money to prove I can support myself and my husband so I know I have to fill out a copy of the I-864 anyway and my sponsor another one... Question is... In Part 1. am I the a) Petitioner and my father (our sponsor) d) the only joint sponsor?

    5) Last question!! I hope!! In Part 5. I'm having difficulty filling this out on my form because we are living with my parents since we both just moved back from Europe. If I fill it out correctly I end up with 2 in my Household and on my father's form he ends up with 3 in his Household. So I'm worried that they will add those two together saying there are 5 in the household... This is probably a crazy question, it's sounding crazy to me now but I think I have lost my mind reading so many instructions... Oh why, oh why does the paper work have to be so insane :wacko:
