  1. We had not checked for a while, so randomly I checked this morning and was shocked to find that the status had changed. My wife got the letter in the mail later on this morning:

    If that link does not work, go to www.uscis.gov and on the left hand side, click on "Check my Case Status"

    Type in the MSC number (no dashes) and it should give you the latest.

    I was really shocked that she didn't have to do the interview - I guess that the months of checks getting the K1 visa as well as our strong backup paid off.

    Carmen's Canadian citizenship (she is very excited!) came up for tomorrow, so she will lose her Can green card and will have to expedite her new Canadian passport. I asked the Vancouver Consulate and they told us that we had to wait until she had her Canadian passport to submit Packet 3. Apparently you can expedite a passport up there and get it in a couple of weeks - I really hope so as we will be travelling to South America at Christmas !

    The other puzzling thing is that although we supplied evidence (in our original I-129F) that she was a legal permanent resident in Canada, apparently they did not pass this information on to the Consulate, so we have to do that again.

    Hopefully we can get a late January interview - that would be perfect...

  3. I emailed the US Consulate in Vancouver and they responded within 2 hours !

    This was their response

    1. We received the file today and mailed her a letter requesting to provide the evidence of her status in Canada as the file does not contain any document showing that she is a permanent resident of Canada. Once we receive the response from her, we will mail her the K Visa instruction packet.

    2. Regarding the passport, since she will be a Canadian citizen soon, she must submit Canadian passport for the processing of K visa.

    3. She is required to complete DS-156 & DSS-156K for K visa. Please read and follow the instructions carefully for K visa processing once she receives the packet from our office. Please complete the DS-156 form after she receives her passport.

    A. Although we submitted evidence of her Canadian Permanent Residence in our original I-129F submission, apparently it did not make it in the file that was sent to Vancouver, hence their request above - I am guessing that this is pretty common for benefactors who are not citizens of their country of residence

    B. They told us to hold off submitting Packet 3 (when we receive it) until she has her new Canadian passport as the DS-156 requires a passport and nationality. Although it requires a slightly longer wait, this suits both of us as we had set a date of mid-March for her to move to the US.

    Thanks for those of you who responded. I hope that in the future this string is useful for someone who has the same unusual problem.

  4. I don't mean to come down on you for your language but I think the title to this thread throws people WAY OFF.

    You mean beneficiary, not benefactor. Benefactor means patron or boss and it would allude more to the

    petitioner (you) than the beneficiary (her). You might want to contact the moderators with the report function and

    ask them to change the name of the title to "How to deal with Beneficiary getting new Citizenship while in the K-1 Process."

    I'm sure they will be happy to do that for you if you ask them. Only they can do it.

  5. Which one will they put the visa in? I would assume they would put it in the one she has listed and used since the start of your process?

    might be true, but I doubt it really matters... the US truly does not care what passport a visa goes into... just as long as it is in a passport and that passport is the one that will be presented when entering the USA

    Quite honestly, we would prefer the visa be put in the Canada passport as once we are married and have "parole", it is easier to travel with a Canadian passport than it is with a Venezuelan one.

    Thanks guys - we will probably contact the consulate once we have got an interview set and ask the question beforehand.

    My fiancee and I find ourselves in a strange position. At the time of our application, I was (and still am!) a US citizen, while she is a Venezuelan citizen with permanent residence (green card status) in Canada.

    We applied for the K-1 Visa (Fiancee I-129F) and received approval - NOA2 was on November 9th. We are awaiting Packet 3 from the US Embassy in Vancouver.

    Quite some time ago, my fiancee applied for Canadian citizenship and lo and behold, she got a letter last week telling her that her swearing in as a Canadian citizen will be this week (Thursday Nov 26th). When she goes for her Canadian citizenship, she will have to give her green card to the authorities and will have to apply for an expedited Canadian passport. Once she has received it (before Christmas), she will have two valid passports (Venezuelan and Canadian).

    My question is this:

    As all the paperwork was filled out with her as a Venezuelan citizen, will there be any problem with showing up with a different country's (Canada) passport, or do we want to just show the Venezuelan passport which will no longer have a valid green card to go with it ? If we submit the Venezuelan passport for the visa, it is likely that we will have problems/questions on leaving Canada/entering the US as she no longer will have a green card.

    Has anybody run into this same sort of situation ? Who would be the right person to talk to ? NVC or the US Embassy in Vancouver ?

    Any help would be appreciated as I really do not want this to turn into a bad situation at her interview.

  8. Yes, ITT is still missing... :s But I'm sure this should be fixed in a very few days as it seems VSC is working on backlog at the moment. :)

    No, Kitty we don't have to move to another thread for AOS, you can see most of "month filers" thread usually last until everybody is done with AOS, then we get a big break from USCIS. :)

    (I can't wait for that 2 years break already :x)

    I feel so relieved for Musho and Rachel! Wow!!!

    But you'll see, you feel happy for like 3 or 4 days max, then the NVC tracking begins and just another kind of wait...

    I'm afraid I'll start to feel better once I'll fasten my seatbelt for that very last flight... :)

    I keep dreaming about how it will feel to go there knowing that this time you won't have to go back...

    Doing those dumb everyday stuffs, like watching TV on the couch in my monkey arms, without that anxious thought, you know what I mean?

    I can't wait ! :)

    Especially if you were expecting your NOA2 in the very next hours.

    In 3 weeks, you'll have forgotten this and we'll do the NOA2 happy dance all together!

    Too right - I am as detailed a person as anyone (just ask my workmates and fiancee !!!) and I missed something. My blue RFE form was dated 9/21, mailed on 9/22 and arrived on my doorstep on 9/26, so hopefully you won't have too long to wait before the mail comes. You have about 31 days to respond (10/24 was the deadline on my letter) and they say that it will take a minimum of 14 days to process after receipt. I sent it off on 9/28, so I am hoping there is not too big a delay. We had banked on my fiancee getting here in early Feb 2010, so if this is a temporary blip (as I hope) we should be right on schedule.

    RFE could be about a missing signature, birth certificate format, etc...

    Hmm, huge amount of photos isn't so good, it's 5 pictures max. You know sometimes too much info kill the info.

    What was your primary evidence?

    Well for now, I wouldn't worry about it.

    I was pretty sensible about the photos printing 6 pages of 4 color photos per page with labels on the back, so I don't think it would be too onerous to check. I also was thinking that the RFE was a good sign as they are working on it, but have some envy for those who got approved. It could be a complexity thing also - I am an ex Brit who naturalized as an American and she is a Venezuelan citizen with Green Card status in Canada - perhaps they want something different. I will bite my fingernails for a few days more until the snail mail arrives and will keep the board updated...

    Basically I am a moron ! I must have hit spacebar twice on the I129F form Page 3 Part C Q2 and did not answer the question of whether I had been convicted by a court of law of a variety of heinous crimes. For those interested, the answer was NO :)

    Hopefully after sending the blue RFE form back this morning, we should be joining you successful NOA2 folks very soon. Let that be a lesson to everyone - check, re-check and then check again !!!

    Now, i'm going to feel worried if I don't get ours in the next 3 days.

    But it's so good to see it won't be as long as expected. :)

    Well according to the number of petitions we actually can see on VJ, it's not so surprising that June and July are getting mixed.

    Sigh, we both are getting very cranky, a good news like that would be more than welcome now.

    Congratulations you two also. Although happy for you, it was tempered by us getting an RFE dated 9/21. I guess that I will have to wait for snail mail to find out what they wanted as the online case does not give any details. I really hope that this does not send us back to the end of the line and I will be anxious to find out what is missing. Given that we have been dating for 4 years, have seen each other 27 times in that time, submitted huge amounts of photographic and other evidence (that I got a buddy who had gone through the process check), I really hope that is something minor and this is only just a short delay.

    Congrats all you folks again - the good news is that they are looking at a bunch of July filers right now...

  13. Sorry to re-tread areas, but reading through the plethora of message strings, I have specific questions that I would appreciate answers for:

    I am a US citizen and my fiancee is a Venezuelan with permanent resident status in Canada. She is currently in the last stages of attaining her Canadian citizenship - hopefully 3-4 months away.

    1. Having read a few posts, it appears to be a "no-no" for her to come to the US on her valid tourist visa and for us to get married as this would effectively be "visa fraud" - using a visa for a different purpose than its intention. Is this a valid statement ?

    2. As her citizenship will be changing in a few months from Venezuelan to Canadian, is it worthwhile waiting for the change in her citizenship before submitting the I-129 paperwork, or does it not matter ? i.e. is it better to have Canada on the paperwork rather than Venezuela ?

    3. Related to 2, our plan is to have a party/celebration/church wedding in Venezuela, so once the I-129 is granted and we are legally married in the US, how long does it usually take before the married visa recipient (my fiancee) is eligible to travel outside the US. I am aware that we can apply for a I-131 (Application for Travel Document), but wanted to avoid that if possible.

    4. What is the next step in the process after the I-129 is granted and we are married ? Is it a case of applying for I-485 (Permanent Resident Status) and I-765 (Application for Employment Authorization) ?

    5. If anybody is aware of Canadian paperwork, how long does it take to get a Canadian police report - my fiancee had to get this paperwork when filing for her Canadian permanent residence and it took her 4+ months to get it back. I believe that we need this for the I-129 - is there a quicker way, or is this a typical timeline ?

    Many thanks to anybody out there who could help answer these questions - this will really help us decide on our best course of action before we start filling out the paperwork.
