  1. If it's just the cheque then do a new cheque and send the package right back to them. You can try resorting it if you like to make sure it's all there (which it should be).

    Unless anything else is wrong you don't need to resign or redate any forms. just mail it back (double check you've done the cheque correctly and double check the address). I used a personal cheque so I could see it online.

    You haven't filed for anything before because there's nothing in the system. It's like sending something and having it returned to sender for the wrong address... it never "arrived" where it was supposed to to get registered in the system. Again, unless they told you something else was wrong, or you've realised you did something wrong, don't change anything except the cheque and just mail it right back.

  2. What visa are you AOSing from? What address did you send it to? Did you write the cheque out for $1070?

    We just got the packet back today. Apparently the check was written out incorrectly (for 1010 instead of 1070). This is the stupidest mistake I think I've ever made...didn't think I was capable of it. We had not checked fees and gone off what our friend (who just finished his) sent in.

    We will be resubmitting the packet of course. There is one place on the 1485 where it asks if we've filed before. now I have to say yes correct? there is also a place on the I765 where it asks if "you have every applied for work authorization before" . the 1485 was what was rejected...I don't think we have to say we've applied for employment authorization before do we? Also. do we have to resign and date each document? or will they accept them the way they are with the minor changes we have to make?

    If you know any of those answers let me know! thank you so much for your help.

  3. Hi.

    I am getting the AOS paperwork together and have found that I can't find my NOA2 anywhere. looking back I believe that I sent the original copy in after 129F was approved. I know that this is absolutely ridiculous of me to have done, I'm not sure what I was thinking at the time. I am assuming that the original was taken along with lots of other documentation when my husband went through the first POE.

    That's done, and now I need a new copy. I have been attempting to find other things to send in. Some people have said they sent in their NVC letter or print out of online process of I129f saying it was approved.

    WHAT can I do? I feel like there should be another way to go about this than waiting up to 6 months for a piece of paper to be mailed to me. is there not an electronic way of doing this? and if not when the heck will there be?

    PLEASE help, I am hoping there is SOMETHING I can do to fix this error.

    Thank you I'd appreciate any input at all good or bad.

  4. Thank you so so much for all of your amazingly helpful answers. We are now getting all of the paperwork together. And the funds will be saved in the next week or so. I feel so much better.

    I am confused about the Medical info he needs. I have been out of this loop for a while so I'm starting to forget names of documents (I know it's all available here) so within the checklist they provide here, there is listed I-693. ...

    Medical Examination of Aliens Seeking Adjustment of Status. If you are a K-1, K-2, K-3 or K-4 visa holder the I-693 instructions state that you are not required to have another medical examination as long as your Form I-485 is filed within one year of your overseas medical examination. Only if your DS-3025 is marked "incomplete" is a I-693 required to be completed. If it is marked as such (incomplete) you are required to complete certain portions of the I-693 and have a Civil Surgeon certify the form (and seal it in an evelope). Specifically, you will complete Part 1 (Information about you) of the I-693 and provide both the form and your DS-3025 (if you have it, proving your vaccination history) and any proof of required vaccinations that were completed prior to entering the US. If you do not have a copy of your DS-3025 you will need to provide sufficient evidence of your vaccination history to the Civil Surgeon (talk to the civil surgeon's office to discuss what vaccination records they accept as proof). If you do not have proof of your vaccination history the Civil Surgeon may insist on re-administering all the required vaccinations prior to completing the I-693. Once the Civil Surgeon has has verified that all required vaccinations have been performed, they will complete form I-693 Part 2 (the vaccination section) and Part 5 (the Civil Surgeon's Certification). They will then seal the form in an envelope and return it to you.

    We have his vaccination history. is he supposed to have this document? everything was taken at his POE in the envelope he had from the embassy.

    Another Question:

    We have moved states since the K1. if we file the AOS at the appropriate center since the move (now nebraska not california if I'm not mistaken....we are now in Denver and not Tucson) will that cause complications and questions? it is a recent move because of employment. any experience with this?

    I'm super confused about the medical documents. the other stuff is straightforward and comprehensible. Thank you so much I Don't know what I'd do without this site.

    I have recently married my fiancee who came to the US on the K1 visa. He is currently out of status and we are waiting to apply for AOS we just simply have not found a way to pay for it. some family things have come into the picture that have not allowed us to save the money we had originally intended to save for this.

    We are hoping to be able to file by the end ofthe month. Is he illegal? what could happen to him if he was for example pulled over? we are married. We just haven't been able to file yet!

    Also, can you file for the EAD without filing for the AOS package in full? or is that just a ridiculous question?

  6. Just a quick question. I've been looking on here for over an hour and occasionally things pop up sometimes they don't so sorry if this already exists (I'm sure it has to)

    I have to find a co-sponsor. Embassy is awaiting those documents. This co-sponsor must make over the poverty line for him and his dependent and my fiancee. That is understood (18,213 in my case + dependent does that equal 3 people? ) My point is, the co-sponsor would be a LPR. I'm almost certain that he makes enough to sponsor, but the job that he will present on his w2 is not the job he has now. he can provide proof of his current employment I'm sure. Will this be a problem that he has not been employed for them in the last few months , but provides proof of his new employment?

    If that is not a problem, I will go ahead and move forward, but I don't want to ask someone to provide that information in vain.

  7. Thanks for your help. I found a cosponsor! one other question. if the person is married and she is sending in her tax information with her husbands name on it as well , is that a problem? do they joint file or is that not allowed for the affidavit? I remembe rreading here somewhere that it can only be one person. This person wouldn't have to make the over 18,000 poverty line for 2 would they? they would only have to supplement my income correct?

    would she need a bankstatement as well or would they just accept tax info only? I know they ask for both but the embassy had mentioned just sending her tax info...I may sound naive but I want to make sure to not cause her grief if it's not worth it.

    any thing else anyone else had trouble with with co-sponsoring?

  8. Congrats to everyone on their approvals/interviews. Nelson had his interview today and was approved pending further documentation due to the I134. I need a sponsor. This is proving to be more difficult than I thought...but I was wondering if anyone could tell me what the guidelines for that are? they said I need a cosponsor based on the fact that I haven't been employed for a year straight (I was in chile for part of last year). I guess I am short 4,000 dollars or something like that. If I were to ask someone to sponsor him what is the timeline? isn't it, if it is not an annual income, the amount available has to be 5 times that of what is missing of the annual income? so I would need either someone that made that difference of 4,000 a year or someone with 20,000 in savings or assets? so it's 5 years? I am going to keep searching on the forums but if anyone knows off hand that would be fantastic. I need to send him this information asap. he might need to forfeit his ticket if I can't get this paperwork to him soon.

  9. I just want to take this time to say....please support the people of Chile in this time of great need. My fiance is okay as well as his family but the country is very damaged. it will take 5 years to rebuild they say...

    take the time to contribute if you can. My heart goes out to all of them. I hope that this doesn't hugely delay the visa process, but at this point I just care about his well-being. :( I'm so sad right now...

    Documenting your current income is most important. There is nothing you can change about the past. If you are worried about it, get a co-sponsor. The co-sponsor for the visa is only on the hook until you do your adjustment of status anyway, so it is basically a "throw away". More is better, but if you have current sufficient income and if you documet it it, you should be OK. When in doubt, get a co-sponsor.

    I have a go on the cosponsor. I´ve heard adjustment of status can take quite a while. when exactly are the cosponsors off the hook? and what are the odds that they would be pursued for any kind of hypothetical thing that may happen (medical expenses in an accident etc). they would definitely consult with me first would they not? I just want to be able to assure them that there is no chance they might lose their house or something if my husband gets in an accident while waiting for his change of status.

    I think it will be fine...but they want to know the legal details. I will do my own research on that info, but if anyone knows of a good site for that let me know :) :) thank you so much everyone!!!

  11. Hello everyone amazing and wonderful that has helped me through this,

    I just received my NOA2 about a week ago and am now preparing to send documents needed to my fiance.

    I am only sponsoring him no kids nothing too complicated.

    I have 2 jobs.

    I have taxes to show what I made last year (but that only represents 6 months of working because I was out of the country studying abroad).

    I have a letter from that employer stating that my annual salary is usually around twice what it shows on my taxes.

    That alone is not enough money. I just recently on dec. 31st got another job. I have 2 paycheck stubs. will this count as proof enough that I CAN make more money? I know I will not be leaving this job anytime soon. with that income proof I will definitely make enough.

    is it too risky because the employment history is so brief? I can get a letter from them no problem , but I'm not sure this would be enough to satisfy them. I think I have someone in mind that can cosponsor me but I would like to avoid it if I can. anyone with similar situation? I looked for a while but couldn't find anything. I'm sure there's an identical entry somewhere though....

    Congratulations to everyone who is on their way to the next stage of this crazy process.

    is anyone else freaking out at not receiving any word at all on their status? no touch. nothin. it's been 3 and a half months and I am worried something may have happened to our file. I'm just being paranoid but has anyone tried to call to find out if their file is being tracked/handled? I know it's there I'm just getting antsy and worried.

    I couldn't quite find anything on this.

    I am applying for my fiance to come here (waiting on NOA2 right now) but his friend would like to come visit sometime after he comes here.

    I know him, and he would be staying with me. since my name is already on my K1 packet, would it do any harm to put my name on my friend's B2 visa for vacation purposes as where is going to stay? It seems silly that it would affect anything, but with this I have to be 100% sure before moving ahead. I don't want any delays because of that.

    any experience with that anyone??

  14. hey guys! that's really unfortunate what with the fee increase....I hope that doesn't get through. it's already so expensive to complete the whole process.

    CONGRATULATIONS to all of you who have received your noa2s! I still have no word....I'm starting to get a little nervous. my last touch was when they received it 10/15/09. I really hope I didn't overlook anything.

    I'm going to visit my fiance in march so hopefully by then we will be looking at a possible interview time.

    does anyone know about putting my name on another visa for a chilean friend to come over on a B2? is that a horrible Idea considering I'm already doing this one?

  15. hey I got my noa1 oct 13th and no NOA2. I'm guessing everything will be fine and I just need to be patient. hang in there guys! I guess just staying positive is the only option!

    I have a question about a tourist visa a friend of my fiance's is applying for. he has to put where he will be staying in the US (that would be with me) and I was wondering if anyone thought it would be really weird to put my name on another visa. doesn't it make sense that a friend of his (and mine) would visit during that time anyway? or does that just look weird to them that I am on two visas one of which is my fiance and another just a visiting tourist b2 visa.

    also...about the paperwork and the NOA2...how long has it taken some of you to gather all the information? I'm just getting all nervous about how long it will take the rest of the information to go through.

  16. hey octoberians! I'm VERY late with joining but I hope you'll still take me in and help me if you can. I'm just playing the waiting game....I tried to post something before so if I double posted whoops...anyways I sent mine october 9th! I'm hoping for some news sometime this month.

    as far as NOA2 receivers...what has been the most difficult/time consuming info to gather? I'm pretty sure I will need a sponsor for the financial documents. has anyone done anything with a sponsor? I will check other threads too....

  17. hey guys I filed in october as well I know I'm coming in way late....I was just wondering how your processing times were...I filed at CSC.

    I am hoping this month I will get an NOA2....or SOME news. online it says nothing has been touched since oct 15th. I've heard that the online database isn't updated very often though...I don't know. but I'm excited to see others in the same position good luck!

    First of all I tried to find topics with this in it but the search yielded nothing so I apologize if anyone's answered this multiple times...but I submitted my I129f 2 months ago and was wondering if there is any effective way to contact USCIS about the status. I'm signed up online etc...I just remember people saying to leave it alone and not try to badger anyone. when should I start getting worried? or should I just stop being impatient? :) for other Chile applicants it's taken about 2 months. I know it varies though.

    if I Ever did need to contact them what have you found to be the most effective way?

  19. so, I am just now beginning to fill out the I-129f and the package deal. everything seems very clear to me especially with the help of this website but I have some slightly ridiculous technical questions:

    1. My fiancé is Chilean his name is: Nelson Andres Solari Cerda.... it says to put family name in caps, that would be his two last names SOLARI CERDA correct? any other spanish speaking fiances?? and I understand this probably won´t make them approve or disapprove it , but I need to know just to make sure everything is easy to process and there are absolutely no questions! Put the family/last-name in the format it is shown on his passport.

    2. while filling out past addresses I´m assuming the point is to know where you´ve been. I´ve used an address for mail 2 times while studying abroad (once in Germany and once here in Chile). I have all the addresses I need from both of those places, but will they want that permanent address as well?I never lived there, only had mail sent there. Put the address of the location you lived - they're not asking for mailing address'.

    3. does it really matter if you put N/A or none. ? where it says other names I put none where it asked for past spouses I put N/A. any problems there? I assume not. just use your brain ? smile.gif "N/A" and/or "None" are not interchangeable - they have different meanings. In the case of previous spouse, if you've had none, write "None."

    4. it asks you to list any occupation held abroad if not listed above within the work history section. I had a 5 month internship in Germany, unpaid, pure experience and part of my abroad program. does that constitute the need to include the information as an occupation abroad? I'm leaning towards no, but again help is always better than none! Just put the internship occupation - you're kind of making this harder than it really is. If you decide to not list the internship, be sure to not leave unexplained gaps - you might list this internship period as "unemployed" or "student".

    5. also, how recommendable would it be to fill out forms in ink? I am leaving chile in 5 days and don't have my new address to put on some documents...thus I won't be able to do it on the computer to print out and have my fiance sign. we could have him sign it and mail it...but if we do it in ink I can have him sign and I can fill in the info when I get home and for sure have everything ready weeks faster (not toooo much faster, but still...) Black ink - either by hand or by printer is acceptable. Which ever works for you.

    okay that's all I got for now, I understand a few of those are almost laughable but hey, it's the typical beginners paranoia I suppose!

  20. Thanks! don't let your mom see this...:) I guess I just thought Not applicable to me because I never had spouses before...but if I actually thought about it I would have obviously answered none.

    and as to leaning towards no, I just don't want to put more information than I need to. more info means more screw up possibilities and if I can avoid that, especially with something small, for five months I guess I thought not putting it would be more appropriate, but as you said just doing it can't hurt anybody.
