  1. Hey all, I'm trying to put together the affidavit using the sample that's been posted here on visajourney. It's a little bit confusing to me, could someone please explain what the areas that I have highlighted in red mean? I need to get the ball rolling on this because their K1 expires this March. The new form comes out 1 February. Also, will my friends need to provide their SSN?

  2. *sigh* You know the story already. My wife came to the states, turned her package over to customs and it was lost before the AOS interview which was today. What are the chances right? Well, I'm pretty new to this whole thing, but from what I've been reading on the boards, this happens pretty often and she didn't ask for a copy at customs because she wasn't expecting this to happen and neither was I. Had I been aware of this, I would have instructed her to do so. Anywho, my now wife and son need medical exams. I've been calling doctors on the "approved list" and they all seem to want $410 ($820) for the both of them. I was just wondering if anyone in the California area knows of any doctors that will do this for less. I'm not in a position where I can spend money on things I've already paid for. I am military and my family has Tricare medical insurance, but none of these civil surgeons accept medical insurance of any kind. I don't know for sure, but I don't think any of the doctors on base are on the civil surgeon list. That's something that I'll check on tomorrow.

So if anyone can give me any info on somewhere I could get this done and not get taken for a ride, then let me know. I know this time when we get these exams done, I will be asking for certified copies of these documents from the office I go to. I can't believe how something like this could just happen. These things need some kind of bar code/paper trail so someone could lose their job for such a huge mistake. They are messing with peoples lives. Not only that, but there is also the chance of identity theft. They should also send out vouchers to a nearby civil surgeon to pay for your exam should this happen. This way they could absorb the cost and learn from their mistakes.

I guess that's just wishful thinking since we need them and they don't need us.

  3. So let me make sure I'm getting this right.

Part 3. I check 8. I am sponsoring the principal immigrant named in part 2 above. IN RESPONSE TO MY WIFE'S INFO

    check Yes

check 9. I am sponsoring the following family members immigrating at the same time or within six months of the principal immigrant named in Part 2 above. Do not include any relative listed on a separate visa petition. FOR MY STEPSON

    9a. add stepsons information

    10. Enter the total number of immigrants you are sponsoring on this form from Part 3, Items 8 and 9. 8 BEING MY WIFE AND 9 BEING HER SON BRINGING THE TOTAL TO 2?

Now, for part 5 can I use A or C for my wife or just one of those choices? Also, which one do I choose for my stepson? I don't have any children of my own and the wording is kind of confusing. Does it matter if I choose D or E for him? I'm guessing D because he will be my dependent, but like I said, I don't have any children and that sounds like what D is for. E on the other hand sounds like it can be used for anyone dependent on me.

They should really reword those choices to say your direct relatives or relatives/dependents of the sponsored immigrant.

  4. So I'm trying to do the I-864 to go with my I-485 and it's confusing the hell out of me. Now, my wife already has a 7 year old son. I know that I have to file a separate I-485 for him. The thing that's killing me is Parts 3 and 5 of the I-864. Could someone explain to me how to do this part? It's like the instructions say I have to add her son and then it says "Do not include any relative listed on a separate visa petition". If I follow those instructions, when I file the I-864 for both of them, it'll say that my household is only 2 and that would be my step son and I and the other form will have my wife and I. Could someone help me out with this?

  5. I have a question about this part of the instructions.

    11. Affidavit of Support/Employment Letter

Submit and affidavit of Support (Form I-864) if your Form I-485 is based on your entry as a fiance, a relative visa petition (Form I-130) filed by your relative, or an employment-based visa petition (Form I-140) related to a business that is five percent or more owned by your family.

Now, when I filed for the I-129F, I had to do one of these. Are they saying that they want another one from me or are they asking her to fill this affidavit out?

  6. Thanks for the info all, nothing to it but to do it now. I have one last question. I've read in the guide that it could take some months before this AOS gets approved. Will they take that into consideration once my 90 days are up? They wouldn't do something while the paperwork is being processed right? Or do they get off your back after you've gotten married in the 90 day time limit. Because I don't see how all that paperwork could be processed in such a short time.

  7. Current USCIS status for your wife is: "Entered U.S. on K1 visa" Your stepson's current USCIS status would be: "Entered U.S. on K2 visa" Then the related entries in Part 1 will show their visa numbers (printed in red on their K1 and K2 visas), A# (on the I-129F NOA2), their date of entry, and the validity date of the the I-94.

You only need to prepare a G-325A for the boy if he is 14 years old or older.

Her son is only 7, so I'll just add him to her G-325a like last time. I also see an area on the AOS. I will be putting his information in Part 3. section B.

What is supposed to go in the "Nonimmigrant Visa Number" section? Do I put her personal passport number there that was issued to her in Japan or the red number on the K-1? Right now I have the Control number on the K-1 in that section.

  8. Ok, so after all the fussing and fighting with paperwork my fiances visa got approved. Well, it's been approved for some time now. Back in June of this year actually. She was preparing to come and her father fell deathly ill. He had an aortic dissection while driving, it's nasty business look it up when you get a chance. Anyway, she stayed with him until he pulled through the whole thing which is understandable. Because of this, it kind of threw all of the marriage plans out the window. Her Visa will expire November 18. Is there anyway I could get this extended? I was trying to get a little last minute wedding thing together, but every priest that I talk to tells me that these things have to be planned at least 6 months in advance. She'll be here September 28 and I have no idea what to do as far as getting married. Can I get a marriage license from anywhere or does it have to be from the embassy?

  9. So, it's been a long hard road, but I think we are in the home stretch. My fiance had her interview and embassy folks over in Japan say that we can get a visa. What happens now? Are they going to give her something soon and then she can fly over and we can finally get married? Or is there more red tape to cut???

  10. So, my fiance has an interview May 10 at the embassy in Tokyo. I haven't received anything in the mail about an interview for me here in the states. Could someone give me some advice on what I need to do now? Is this interview for her the last step before we can get married? I'm excited and confused at the same time. PLEASE HELP!!!

  11. I just recently received a letter from the embassy telling me that my I-129F has been approved. There are instruction in Japanese and english and apparently the same thing was sent to my fiance. She said she filled out the DS-230 and gave it to the embassy. I have an I-134 and I'm confused about what I'm supposed to do with it. I have collected all of the needed documents that are listed in the instructions and I have filled it out completly. Am I supposed to send it USCIS or the embassy/consulate in Japan?

  12. I wanted to edit my post, but I don't see an edit button so I'm posting again. I know I have to give the consulate a copy of my bank statement, but does it have to show all of my deposits and withdrawals? Some of this stuff they just don't need to see. I'd hate to be judged on my spending habits.
