  1. Hi,

    Im currently not working so my dad is completing the I-864A. I do understand that I still have to complete the I-864 but my question is because I dont have any tax papers and all that, my dad has all those papers. He has the tax returns for 2006/7/8, has paystubs for the last 6 months, employment letter. What else does he need? I see that they ask for tax transcripts, would he need that? please advice, im so scared that we send the wrong papers.

  2. these forms are confusing us. My dad makes roughly about $70pa. Would that be enough? I completed the I-864, obviously with $0 income, and gave the I-864A to my dad to fill in. He just needs to get all the proof paperwork.

    $70 per annum? What is $70pa?

  3. Firstly US-Citizen petitioner (YOU) are REQUIRED to provide an I-864 for support even if you have no income.

    Your father also provides an I-864 as a JOINT-Sponsor.

    Thats makes more sense, so I will be sending 2 I-864 forms. The joint sponsor, does he complete the I-864a or just an I-864?

  4. My husband is from south africa, he has been to the us twice, both times leaving before his visa expires. Ok, the problem actual is that they ask if you have a crimanal record, he applied for this through an company and it came back that he has no crimanal record. He then applied for the job he has now and they also did a crimanal check on him which came back saying that he doesnt have anything. If he did then they would not have employed him becuase its a high risk position.

    Well, 2 months ago he applied for his police clearence, only to find out that he does have something in his name. It was an assault case in 2002. He wasnt locked up or given a fine of any sort. Will this count against him and if so what can we do to over come this? He has the 2 documents where it says he has nothing against his name. But the epolice records say he does. What can we do??

  6. The I-130 alone will end up in a CR1 visa while if you file it with the I-129F it will end up with in a K3. In years past K3 visas were supposed to be faster than CR1s but that is no longer the case especially if you take the NVC shortcuts for the CR1.

    Also, keep in mind that if your husband enters the US with a K3 visa, he will have to file for AOS which is an additional $1,010 and wait about 3-6 months for his work permit and about 6-12 months for his permanent residency. If he enters with a CR1 visa he will automatically get his permanent resident card in the mail as well as his SS number within weeks.

    Correct, USCIS as eliminated the reason that the K-3 exits, LONG I-130 processing, USCIS has been tying the I-129F and I-130 together and approves them the same day.

    The K-3 is no longer a relevant visa type, it was developed at a time when I-130 for spousal visa was taking a year or longer to process through USCIS, in this case the K-3 allowed entry to the USA to wait for I-130 approval, so that the couple can either adjust status or interview for the spousal visa, since USCIS has begun approving I-129F AND I-130 on the same date, this eliminates the whole reason for K-3 (Entry and waiting for I-130 approval).

    K-3:

    I-130: $355

    I-129F: NONE

    Consulate: $131

    Adjustment Of Status: $1010 I-485

    ($1496)

    CR-1

    I-130: $355

    NVC I-864: $70

    NVC Visa fee: $400 ($355+$45)

    ($825)

    I see many posts from K-3 holders stating, "Wow this sucks, I am stuck at home because I don't have EAD, DL, etc, or I am having hard time getting added to bank accounts because of NO SSN." K-3 has a 90 day or longer period of limbo while waiting for EAD or Green-card.

    K-3 was developed at a time when CR-1 was taking much longer that today, NVC and USCIS has greatly streamlined the CR-1 process to the point where K-3 becomes irrelevant.

    This is the best advice we have gotten sofar. And I see your point with the price difference. So our I-130 will turn into an CR-1 if I understand you correctly. Do you have an idee of how long its going to take? We are so scared of making an mistake. We have a 1yr old son together and we need my husband here with us. Thank you again.

In a way this website makes my wife and I feel a bit beter because it shows that we are not alone, there is thousands of married couples out there waiting just like us to be reunited. Our son is in good health, changing him to new milk but its making him sick.

    I'm glad to hear that your son is doing well. One of my sons had health problems too when he was born, had emergency surgery and then he stayed in the NICU, and later had problems with the milk as well. Just to let you know, he's a big tough 4 year old and hasn't had any problems the past 3 years, other than driving me crazy. :)

    Good luck with the visa - I'm sure everything will go fine. I guess we all just have to suffer for a while to be happy forever.

    Hi. Thanks. It wasnt nice to sit on this side not being able to go see him in the hospital, be present with the birth, see his first steps, first words ect. I would think that we would fall under a different group because we have a young baby. But no. Im sorry to hear about your son but glad to hear that he is doing ok now. Im sure our son would also grow up strong and healthy.

    VJ sure makes a difference knowing you're not alone in the process. Lets hope yours is a speedy one so that you, your wife and son can finally be together.

    I hope so too. It seems like we still have a while to go but they are worth the wait. They are my everything.

    My Wife and I have been batteling to be together. Im from South Africa and my Beautiful Wife from Louisiana. We also have a beautiful 1 year old son Camdyn. Which of course I wasnt aloud to be at the birth due to temp entry restrictions. I wasnt aloud to apply for a temp visa. We had some tough times with our son in and out of ICU. But after a year and two months they got the green light to com to me and we got married in January. He fell ill again twice while here and they returned to the US. We posted our I-130 in April and got out first NOA a fww days later. Now we are just waiting.....waiting....waiting......waiting
