  1. Hello,

I am trying to deal with a situation that makes no sense to me at all ... Any suggestion is more than welcome!

Back in July last year, my husband and I have applied for the adjustment of status (married on July 8th). In December 2009, I got the official letter from USCIS saying that my permanent resident status has been approved and that I should get my green card in the mail within the next 3 weeks. We've waited until probably mid January, when we have filed an I-90 form ("green card was never received" - with no fee, per the information contained on the USCIS website and the Customer Service person we've talked on the phone) ... 3 months after (end of April), I've received a letter stating that my I-90 application was rejected because I haven't checked the relevant option on the form ( :ot: ... of course we've checked the right option, we are not that ignorant!).

Since this whole situation made no sense at all, I scheduled an INFOPASS appointment, to see if I can get a more valid answer ... or a stamp on my passport. I did not get a stamp on my passport (because I did not have any I-90 pending), but the lady I dealt with emailed the Nebraska office (where my case was processed) and asked for more clarification. She called me back today, saying that the form was rejected because it was supposed to be accompanied by a fee ... It's stupid, what can I say? The USCIS website states clearly that there is no fee involved when filling an I-90 "If filing because you never received your card".

I don't want to file the I-90 again and and pay inexistent fee, I paid for the whole thing back in July 2009, when I applied for my adjustment of status. Plus, their rejection letter says nothing about the fee.

I am expecting a baby in July and my work authorization is valid until August - I was wondering if not having a Green Card will influence these two events ...

Is anyone else in the same situation or knows about something similar? What needs to be done?
