  1. Hi UKRUSA:

    People who filed their cases in 2009 MUST have an answer/decision from Vermont in aprox. 5months from the date they file their case because that's a new regulation published in uscis website, that's why you see cases approved in 5 or 7 months. It's not my case, I filed my I-360 last year and I've been waiting for 21 months or so, and still have no decision taken on my case. And I can tell that for those who filed before 2007 (before immigration increased their fees to apply for AOS) they just getting their approvals now: 3 years later!!!!! Unbelievable, right?. So, your waiting time for their decision I guess it doesn't depend on what evidence you have sent but when you filed your case. Once they're working on your case they will let you know what it's missing and what they need from you to send, so they could make a decision in your case - IT'S MY OPINION.

    I am extremely happy today!

    I just received notification from CRIS stating that my VAWA got approved!!!

    Gotten this approval after waiting for 7 months!!!!!!!

    I will include all of you in my prayers!

    Congrats on your success and blessing but remember those behind.....

    For everyone who will come here in the future PLEASE PLEASE GIVE DETAILS ON HOW YOU FILED YOUR I-360 WHICH TOOK ONLY 7 MONTHS.

    Those who follow in your footsteps many wait over double that time would like to know the steps you took and thoughts you may have on why so fast. Thank you in advance from everyone looking for a little hope.

    I apologize for not logging in sooner and replying to posts....

    When i filed the I-360, I made sure that I have EVERYTHING that is needed - I went to all VAWA forums, checked online and compiled all the necessary evidence required to support my VAWA application - I did it all by myself that when i showed it to my lawyer, she said that it was so thorough and very detailed and requested if i can provide her with a soft copy so she can save it and have it as a reference (I was thinking, the nerve of her...she didn't even contributed anything to that!). Anyway, I provided copies of lease agreement with both our names and signatures, joint bank account, emails and letters sent back and forth when we were dating and emails exchanged during our marriage, incident reports, copies of criminal & civil charges filed against the ex, police reports on the 2 times he violated the restraining order, copies of threatening emails he sent to me, pictures of my black eye, black and blue bruises covering my entire upper body during the 2nd & 3rd beating incidents, pictures when we were dating, a testimonial from our pastor during the 3rd beating incident when I decided to call our pastor for help coz i thought the x was hell bent on killing me - he slapped a phonebook several times against my head saying that it would not leave any mark so no one would believe me that he was beating me then he threw me around the room, started punching me again, then laid me in the bed and started choking me and placed a pillow over my face so i couldn't breathe. He just let go when he said, "tell me you're sorry" which i did. I called our pastor immediately after that and our pastor requested to speak to him and my x told him and lied saying, " She started it, she was flinging me around the room and was hurting me" - which of course was a BIG lie, I'm 5'7 and weighs 105, he's 6'2 and weighs 250, how can i even do that? Plus he has NO bruises,not even one scratch while i was the one covered with bruises and choke marks.

    To answer the question, just SHOW everything supporting claims that this was not a scam marriage. Literally, EVERYTHING that would connect me to him from the start of our courtship days to the time that we separated.

  2. Hi, have you received the interview letter yet? I got my I360 approved, then another letter about I485 being sent to the NBC and just yesterday another letter about my I485 case being transferred to another uscis office. Do you have anything new?

    I truly apologize...I just logged in and saw all the posts....

    Biometrics was taken on 11/03/09 at Elizabeth, NJ then received my EAD card in the mail on 12/08/09 (the date on the I-797 shows 11/24/09).

    I have just gotten my interview letter advising me that my interview is scheduled on 01/13/10.

    Hi, My lawyer filed I-485 and I0765 concurrently on Sept 30, 2009. I just got 2 letters (I-797C) today informing me that the next step is to have my biometrics taken and that they will be sending me the schedule for my biometrics appointment.

  6. That is what I did. I sent in the request for extension myself to the Vermont Service Center.....

    Yes. that's what I did because I didn't have the additional money that my lawyer was asking me just to request for an extension. So I wrote the letter myself and sent it via fedex on may 28.

    You shouldn't need an attorney to request an extension. Just make sure you do so prior to 15 days before its expiry and make sure you send a copy of the initial I-797 Notice of Action that you received showing that the prima facie determination has been made.

    I received my I -360 prima facie determination on January 12, 2009. It is due to expire on July 12, 2009. I requested my lawyer to file a request for extension but she wanted to charge me $875 just for that. I have already paid her $ 2800 in legal fees. I asked her shouldn't that be included as part of the legal fees i paid you and she said no. I also pointed out that the fees for the I-360 has been waived and yet you wanted to charge me $875. I dont have any additional money to spare so I sent the written letter requesting for an extension of my prima facie on May 28, 2009 via Fedex. I am getting worried now because I have not gotten any receipt at all confirming that they indeed recieved my request. I checked the CRIS website and there are no status updates.

    Please help. What should I do?

    :blush: I apologize if my question sounds stupid.....but, since you signed a contract with your lawyer to be represented by her, can you send request for an extension of prima facie by yourself? Speaking legally, you have given the rights to her to manage/work on your case and maybe that's why you haven't get a response..........Maybe I'm wrong...... have you asked about it?.

    Don't get me wrong, I'm totally agree with you, :star: that's a lot of money just for requesting an extension of prima facie....

  7. My attorney is the same. She charges everything! Which is the reason why I am not using her for the divorce. I am still broke from all those legal fees that i paid my lawyer which is why I still have not gotten to filing the divorce. I still don't have the money yet plus I wanted to look for a good one. I am definitely not using this lawyer that I have now for the divorce case.

    im varey satisfied with my attorney he didnt charge me alot of moeny 1200$ and he did verey good job and i call him all the time chake on my case and he never say any thing but i try to get him more client bcz he so good with me and i knew him sinc 2003 ......... but my divorce attorney he is hungrey mony and he charg me for the phone call when he call me and also charg me for te post stamps when he send me letter
