  1. The birth father is not in the picture, they are divorced and the mom has complete custody of the child. He only has visitation rights but he has not visited his daughter for over a year now, and has not even tried to be a part of her life. We did not need his permission for the K-1 visa approval either. The Father is listed on the birth certificate. If it matters any, they are coming from Indonesia.

  2. oh wait a min here.... My fiancee has a 2 year old daughter. We are bringing the daughter over to USA, the father has no custody rights and has no visitation rights either. Does this mean I have to file a separate I-130 for the 2 yr old also?

    No as long as the child for you is listed on the I-129. It is differnt when applying for a spousal visa, you child will get the benefits of a K-2.

  3. USCIS isn't going to assume anything about your income (petition stage). The Embassy/Consulate (Visa application stage) won't assume anything either, they will look directly at your I-134 (Affidavit of support).

    ok, so what I understand, it does not matter if its unemployment or job, it just matters if you have substantial income when they look at the I-134.

  4. Hello all, I finally received my NOA1 today, after the mail got screwed up and waiting for 6 weeks! GRRRRR!

    I am filing the K-1 for my fiancee from Indonesia and her 3 year old daughter

    question regarding unemployment compensation and the K-1 visa. As I was getting the paperwork together for the K-1, I was laid off due to the wonderful economy :whistle: So, on the biographic sheet (G-325A) I put down unemployed. Unemployment compensation is $21,300/yr. Now, the past 3 years I have made over $60,000 - but this year is going to drop because of the lay-off.

    Would they assume I am receiving unemployment compensation? But I know by the time they get around to my case in the next 4-6 months I will have a job. I do have one lined up right now, but will not start until mid October. The prospective employer, if need be, can provide intent to hire.

    I am just asking, with all the factors listed above, would this be a reason to reject my case, or make things more difficult?

  5. hello all, first post here, the site has been very informative so far :)

    i have a question regarding K-1 VISA and proof of ongoing relationship. My future wife and I have been chatting through Yahoo! messenger for 7+ months and will continue to do so until (hopefully) her K-1 VISA is approved. I have saved all my chat logs for the past 6 months, and will continue to do this. I'd print them out and send along with the package, but its 1000+ pages.... I was thinking of sending along a 1GB USB stick with the chat logs in TXT format / maybe word format. I have not sent in the initial K-1 visa package yet.....

    Would sending the USB stick even be worthwhile? What other way can i send these chat logs other that printing them out? Is it even necessary to include these logs, so they can determine how we met? (we did meet online).....
