  1. Hi,

    I had to fill out the I-751 for my husband. The anniversary of his permanent residence was on November 13th, I sent the form and postmarked it on November 10th but the USCIS returned the form because they said it was filed after the anniversary.

    As I posted the package November 10th, Veterans Day was observed the day after (which I forgot about) and I guess that the mail delivery resumed on Monday.

    I now have to write a statement establishing the failure to send in the form in a timely manner. Could anyone help me with this problem?

    Thanks again for all your answers you gave a few weeks ago.

    We are now filling the paper for my case and i get a little confused:

    - My wife is the petitioner and has to file I-864 --> NO PROBLEM WITH THIS

    - My Mother In Law is going to file as a joint sponsor, BUT we are living at her house for now and her income has to appear in the "household income" section of my wife I-864 (the petitioner).

    My question is: Should my MIL file I-864 as a joint sponsor OR should she fill I-864A because she is a member of the household and my wife's mother?

  3. Thanx all again for your answers, I guess I had an overdose of paperwork these days... The petitioner (my wife) is the "first/main" sponsor. Everything is much clearer now.

    - My wife should be the petitioner (filling the I-864 for me and checking the first item as the petitioner) and she does not need to prove her status/citizenship since she did it before throught the K1 process.- My MIL is then a joint sponsor, and she needs to prove her citizenship while filling the I-864.

    is this should be ok?

    The USC spouse needs to provide their proof of citizenship along with their I-864 as well. This petition is entirely separate from the K1 petition. Follow the form instructions to make sure that all is done correctly.

    A photocopy of California Driving License or passport would be enough for my wife and MIL?

    Otto und Karin: My spouse is US citizen too and she never filled the I-485, if I consider this a mistake, should she fill one too? How? As a main or join sponsor?

    I don't think my mother in law included a proof of her US citizenship. Now I know what to do about that.

    I am the immigrant, does that mean I am the petitioner? or should it be my US citizen wife?

  6. I received this request for Initial Evidence and here's what is stated:

    - Form I-864 Affidavit of Support was submitted; however, it was not from the petitioner/sponsor

    In order to process your application further, submit a completed and signed Form I-864 for the petitioner/sponsor listed on form I-130 or I-129F.

    For more specific information, see form I-864 instructions, page 2 "Who Completes and Signs Form I-864 (...)

    - The joint sponsor on Form I-864, Affidavit of Support, must be a United States Citizen, United States National, or Lawful Permanent Resident of the Unted States.

    In order to process your application further, submit evidence of the joint sponsor's status

    I was pretty surprised to receive this letter for the following reasons:

    - My mother in law (a US citizen) filled the petition with all her income informations. She filled it and signed it, in the 1st field she crossed that she was the petitioner.

    - I have no joint sponsor for this application since my mother in law income seemed enough for the petition.

    Could anybody help me to clarify what is happening or what should be done next to solve this problem? Thanks in advance

  7. You do not need to file the I-130.

    It's up to you whether to make the correction on the old form a create a new one.

    I just saw on the I-485 instructions that it was required, but I guess it doesn't apply to people entering with a K1 visa.

    It think I am going to make a new form but also join the old one with mistake for the resubmission.

    In my case, the total amount of the check should be $1010... can anyone assure me of that?

    I actually ran into the same problem. They require you to write a check for $930 and a separate one for $80.

    Thank you so much for that, I read somewhere else that a single check of $1010 was the way to do it. I'm gonna resubmit my package with 2 separate check of $930 and $80.

  9. Hi,

    I am actually filling a AOS after entering with a K1 visa. I sent the package some weeks ago and it has been returned with 2 rejection notice (on the AOS and the EAD both stating an incorrect check amount.)

    I found out later that for my I-485 form, I made a mistake about my own birth date (really stupid), I said I was born in 2009 instead of 1979! I think that the fee of my check ($1010) was then incorrect since my mistake made me 2 month old :wacko: and didn't have to pay for biometric fee.

    Well I'm 30 years old so I do need to pay for that!

    My questions

    1- Should I rewrite a new I-485 form or just correct my birth date on the one they sent me back ?

    2- I also worry about the I-130 form because I don't know if I have to fill it or not. If yes, do I have to write it on a separate check?
