I do have one more question regarding my filing the I-130....is there any issues with me needing to adopt

my wifes daughter or is she my stepdaughter(relative) just by marriage and i just need to file my own I-130 for her

no we just received the letter telling us its on the way to the NVC...so it will probably a few weeks before they

get to it to assign a case#...

would my filing a second set of papers for my stepdaughter confuse the process or would the left hand not know what

the right hand is doing, and would the second set of paperwork get pushed thru while the first set just voided after

nothing is followed up on....

yes i am the US citizen and my wife holds the green card and is the petitioner...we were married before her 16th birthday

we just filled the paperwork back in Nov 2010 and got approval in Mar 2011.... so it should just be normal time in New Hampshire

before going to Manila....

my next question is we would like to send her daughter back home after she gets her green card to finish her schooling since

its cheaper there, i have read you cant be out of the country for more than a year for re-entry with just a green card

with out running in to problems...will be it easier for a child to come and go?

we just got notified of the approval for my wifes daughters I-130, it is now being sent to New Hampshire to be

given a case# then forwarded to the Manila embassy...

my first question is..this should be a relatively short process? to get the case# and then get forwarded

my second question is regard a green card...is there a minimun age to get a green card, her daughter is 17

and if she is still that age when she gets here is that to young or is there no age limit?

yes it has been 1 year since her K-1 visa interview, so we will have to file a I-130, both her kids were under 17 when she got here so thats not a problem, my concern is how long i have heard it could take for an I-130 visa number to become available, does filing when the kids are 17 and under guarantee they will not be to old if it takes a long time or does the CR-2 visa mean a faster processing time.

no, if it's been less than 1 year, between the k-1 visa holder's 'interview date' in manila, and today,

then can send in the packet 3 forms directly to the embassy, with a cover letter, requesting to start the K-2 follow to join case. (actually, it's 1 year between the k-1 visa interview date and the k-2 visa interview date, is no concept of 'today', really).

if it's been more than 1 year, and the children were under 18 by the time you married in usa, then YOU can file an I-130 petition on their behalf, resulting in a CR-2 visa for them.

I am trying to find out some info as to which is the easiest way for my wifeto bring her 2 kids both under 21, i brought her here on a K-1 visa and was told to list her kids so when she got stable we could petition them, i have seen the "follow to join" mentioned and we would contact the consulate in Manila, or do we need to file the I-824 and other paperwork with the USCIS.

yes Skeeter, we did add them to the original K-1 but were waiting to bring them until their mom

could get work and get established, my wife just arrived last february so we still have time, but

we will start filling out the K-2.

My question is regarding her 2 kids that we would like to start petitioning, i know they are able to follow on her

K-1 and would like to know which forms i need to look for on the USCIS site and if there are any unexpected issues that could arise.
