  1. If she had never left the US she would have been able to file for AOS. As she is no longer in the country she is welcome to continue visiting with the B1 assuming they let her in with a husband living in the USA (it is possible, although totally at the discretion of the officer) but will need to file for a CR1 spousal visa in order to stay permanently.

So I buy her a ticket to come visit me and they say she can't come in because we're married and I'm living here I'm going to be out 1200 dollars. I'll contact my senator. I mean if Obama can get his Aunt a green card who has been deported twice...... This is insane. I mean what do they care if she lives with me for 6 months she isnt working, driving ect. I'm sorry but the system seems wacked for a lack of a better term.

  2. Her truthful answers to the CBP official may cause her to be denied entry. Being untruthful may cause problems when doing an adjustment of status interview here in the US.

The correct steps would be for you to file a spouse petition now and she interviews in her home country for the proper visa. This would cause you two to be apart for some months. But you also don't lie or materially misrepresent the facts of her intentions when reentering with her B1 visa.

Not the choices that you wanted to see. You can choose the other course. Just weigh the risks and consult a competent immigration attorney to determine the steps that you are willing to take.

I do want to be unlawful nor untruthful. I thought well she's here can we do it this way. She has a visa and can travel back and forth to the states with her B1 and what I'm hearing is that she wont be able to travel here for 6-12 months now once we start the paperwork.

  3. Hi and thanks for helping.

My Wife and I married in Nicaragua, I planned on living there. After a year in Nicaragua we got a b1 visa for her to take a look at the states to visit family and friends. Well when we came to visit family I ended up landing a really good job and we decided to stay. We rented a apt together and she started to volunteer at the Mex consulate. We talked to some people about what doc's we needed so she went home after 6 months to get her BC and other papers and will return after 4 weeks on her b1 again. Now can she AOS here in the states in order to stay or is that a pipe dream.

    Thanks for helping.

  4. I have found an answer to this whole US visa bs... If she can't come to me, I am going to her. So this is my new journey one that is by her side no matter where we go or where we end up, we will be together. Nicaragua, Costa Rica, the country does not matter, the person is what I care about. Are adventure will be together, are journey starts here. I leave in 3 months, I've notified both my jobs, sold my TV, my car I still need for awhile, but it's paid off! I'm going outside the box. Love has no rules! This is MY life and HERS, not one to be put into the hands of uncle sam. Who knows maybe will try the DCF.

  5. I just can’t get over being away from her. I’ve never felt so connect and so far away at the same time. We where talking on the phone last night and it’s the rainy season there… so we where talking about fears that pop into are heads; just healthy conversation was all it was. She was telling me she hopped she would be a good person to me and that I would be to her and so forth….and the phone went dead. I tried calling her back and nothing, I knew she was going to travel in the morning to her home, which I might add, there is no phone service. So I’m left sitting with her fears until Monday.. I must say I really admire you guys… 2 questions- What did you guys do to help with the waiting and any secrets on international calling? On a side note… I did buy my ticket today for August 27th I will be down for about 4 weeks to marry and spend some time with her. All I do is think about her and how can we be together and that and I have 3 months of waiting.*ugh* Also we talked about the K1 but she would like her family to be at the wedding and it is important to her to be married like this. Thank you for listening and letting me talk… It means a lot to me. I feel like no one else understands sometimes...

  6. That would be cool to have some music!!

We met in San Juan del Sur. She was working at a hostel for a few days. From there we traveled all over. Her home is in Nancimi close to Revas. Then Spent the remaining days in Managua. That's where she's at right now, working for the Gov. at the Dept of Ministry as a intern or something to that effect.

  7. I’m grateful I came across this site. I came across this website googling info on how to marry in a different country and bring someone into to the U.S.

My name is Derek and I fell in love with someone in Nicaragua. It started as a vacation that I was going to end short because I didn't speak Spanish and I was alone and didn't feel like I fit in anywhere. So I called and rebooked my flight 9 days early and planned to spend the rest of my days in some nice hotel next to the airport and wait it out. I was staying at a hostel and my soon to be wife was working there. Now, I fell in love with this girl at first sight, but didn’t come to Nicaragua to hook up or to fall in love so I never said anything to her. (Shy) The night before I was going to leave, she came to me while I was lying on a hammock reading a book and asked me if I would like to take a walk with her she said she was getting off work in ten minutes. I looked around and said “me”? She laughed and said “yes”. We spent the next day together seeing a volcano and that night, sitting outside (I was dropping her off at where she was staying) a man came out of nowhere and told us we where two lost stars in the universe and have found each other. We refer to him as “the man in the street” he is a huge part of our story. But the next day I left for the airport 3 hours away, early in the morning. When I got to the airport something inside of me told me to go back. I told the driver to “take me back”. (I missed my flight) When she saw me she said “you’re crazy”, I told her “you’re right, crazy for you”. We spent the rest of my 9 days together traveling all over, I met her family, learned to wash cloths by hand, cook on an outdoor oven with wood, and draw water from a well. I was in love and she loved me, it was magic. When she took me to the airport I told her I would be back, that I loved her and asked her to marry me. She said “yes” then asked me if this was a dream and if she was going to wake up.. I said “I hope not”. Since I have been back, 2 weeks now, I’ve been going crazy being away. We have already planned the marriage it will be in Nica in early September. I’ve contacted the embassy and found out what I need to do, in order to bring her here to the states. I never knew it was so much, so long and so much money. *UGH* but its okay. This is my journey…..
