  1. an immigration lawyer adviced me that I cannot apply for self petition (Vawa) if the divorce is not yet final, so wait. My soon to be ex (can't wait) abuser husband is doing all kinds of delay tactics knowing we have no children

    You immigration attorney he is wrong you can still file for vawa while you still married and if you approve the abuse you can expedite your vawa because you still live with abuser

  2. Hello Everyone...

    I'm back to the Forum and I just wanted to let you know that I really feel your pain... My case has been pending for 2 years and 2 months as of today. I've NEVER being asked for RFE, NOTHING and still pending. They have placed me in to proceedings even when I advised them that I filed VAWA case previously to my immigration appointment and still, NONE case is denied nor approved.

    Three months ago I had to leave USA and obviously I can not come back at least in the next 10 years, but I bet you that even in 10 years from today my case would be still as pending. WHY? Who knows? Evidence I have it all, I sent all docs requested, hospital reports, police reports, notarized affidavits from friends, family members, pictures, medical bills, all backgrounds are cleared, car insurance bills, E V E R Y T H I N G .... Question is: WHY my case never was approved? NOBODY KNOWS. I called to 1-800 many times, send at least 10 letters requesting adjudication of my case, my lawyer contacted "his immigration friends" trying to use their influences to rush the decision and NOTHING WORKED OUT FOR ME.

    I know the frustration for all of those who has been waiting and waiting years for that approval and still no answer.I can only say BE STRONG, that's it. Don't feel sorry for yourself, that's the worst feeling. . . PAIN IS INEVITABLE, FEELING MISERABLE IS OPTIONAL :no:

    I really hope that this journey ends soon for ALL of you. May the God bless you all the time.

    I hope everyone is doing ok and they approvals have been coming in. Sorry I haven't touched base in a while. I was on vacation, I had my first international trip to Cancun, Mexico. It was great, cancun is beautiful definitely a place to visit. I had a smooth exit and entry, was only asked 2 questions on my entry "Purpose of vacation" and "Place of employment" and that was it. And if I had any alcoholic beverages or tobacco. Other than that I had a great vacation.

    Hi there, I was away for awhile as well, but I'm always hoping for good news on everyone here.

    Lost, did you have to obtain a visa to go to Mexico? I got invited to a wedding in Vancouver, Canada in June. I haven't been out of the country so I don't know what to do. Any advice or information is greatly appreciated.

    Did the officer at the interview told you about when you can apply for citizenship? I was reading earlier posts but there was not exact conclusion. Do you have any idea?

    This is the beginning of good things happening to you.

    By the way, LostinNJ, I have a tip for you for your upcoming interview. My lawyer said when she prepared me; try to be brief in answering the interviewer's questions. Don't elaborate or volunteer any information. If the question only requires a yes or no answer, just say so. And if you are not sure, say "I don't know or I don't remember".

    I'm so excited for you, let us know ASAP, ok?

    I got another e-mail, the "the welcome package for the new permanent resident has been mailed".

    I can't wait to see it.

    I just called USCIS I asked them my receipt number for my I-765 and I-485 they told me they cant give any information for my case .

    And told me to make an appointment at my local USCIS to get my receipt number ..

    Lostin how did you get ur receipt number from ur I-765 ,I-485 ?

    who has the same issue of me .. anyone ?

    Hi ashley, after you have filed the applications, uscis will send you a Notice of Action, your receipt # will be there as well as the receipt and/ or priority date. I suggest that you sign up for Case Status Online, that way, you can check yourself anytime you want and if there are any decisions made, you will be sent an e-mail.

    Hi, sorry I wasn't able to get back to you sooner. I couldn't find my passport when I was supposed to be petitioned by my husband in 2006. So we filed I-102, w/c is replacement for I-94, it was approved in March of 2007. We sent a copy w/ my vawa/I-485 application. I used my DL and EAD for proof of ID.

    Hi Kymber, it took 19 months, from 02/2008, approved 09/2009. Around May 2009, I was sent the RFE.

    LostinNJ, don't worry about the USC BC, just tell the interviewer that you were not able to obtain a copy , I'm sure because of our circumstances they will not give you a hard time.

    Thank you Lost, Yahya and everyone here, the interview ran smoothly, it did not even take 10 minutes. I was sworn in first, then the officer asked me basic questions, e.g. my name, current address. Asked for a copy of my birth certificate, added it to my file. She said if I have a copy of my USC husband's birth certificate, I showed it to her, she looked at it but did not take it or asked for a copy. Then she said, "I believe, everything is in order, you should expect your GC in 2-3 weeks."

    I truly believe that your prayers, advice and support helped me throughout this whole process, I can never thank you enough. I promise, I will never forget you and I will include all of you in my prayers.

    I recieve my I-360 approval dec 07 and just recieved my interview date for the 12th of this month.

    I have a quick question,I've read from this board that most questions are from the I485....

    what documents are you taking...apart from the IDs,EAD..any bank statements? anything else?

  12. I don't think so. You need to have a prima facie case (eligibility for benefit sought) before u can move on to the next round.

  13. Congrats mona_lisa. I'm not sure on your question about if you remarry. I would think you would not be eligible for citizenship if you remarry but I may be wrong. By the way guys today I received my interview notice for 25th January 2010. Wish me luck. And just a very quick question, on the notice it states to bring your spouse's birth certificate or evidence of US citizenship, do I need to take that? Because I don't have it or even a copy of it.

    I don't think we have to bring our spouse's bc or proof of usc, they already approved our petition.

    I asked the paralegal about this, I will ask my lawyer as well just to be sure and I will let you know asap. Actually, in my case, my husband gave a copy of his birth certificate when we first went to the lawyer, this was before he showed his "true colors". My lawyer said that they don't have the bc anymore since they sent it w/ my I-360 application.

    As for Mona, I'm happy that you found someone, I wish you all the best, considering what we all went through before getting to this point.

    For me, I'm already in my 30's, I promised myself that I will NEVER put myself in a situation like where I was before. In January, if and when I get my GC, I will concentrate on empowering myself, to work hard and save enough so I could own a home, be self-sufficient and never need anyone ever

    again. But that's just me.

  14. Hey bubbles, I'm so anxious to get my interview letter, I check the mail box everyday lol. But I know it will take atleast another 10 days to get here, hopefully.

    I'm sure you will, I'm about 2 weeks ahead of you. I'm waiting for the results of all my medical, I had a chest x-ray yesterday since my tuberculin test was positive. The doctor said that he's sure that the x-ray will be normal, I don't have any symptoms of TB and the reason why my skin test is positive was the vaccine I received in childhood. Hopefully, everything will be normal, otherwise I really don't know what to do next.

    Anyway, to everyone who's journey has just started, I wish you all the best. We are here and if able, are all willing to answer your questions and concerns.

    Just in case, FYI, we are exempted from form I-864/Affidavit of Support requirement if our I-360 was approved and are applying for lawful permanent resisdence.

    I found a civil surgeon for my medical exam [form I-693], called them this morning, was told that they don't accept health insurance, payment by credit card/personal check, only cash. I have no choice, tomorrow I have an appointment, I have to shell out about $500, the visit-$150, MMR, PPD/TB testing, about $75 each. Blood work for another $150.

    It's a good thing that we are exempted from producing the I-864 or Affidavit of Support.

    I will call the Nat'l Service Center tomorrow, I'm hoping they can help and answer my questions. If I called my lawyer, she will bill me again. My interview is next month, I'm getting nervous. I'm not able to enjoy the holidays even though I'm very thankful to the Lord that he willed my self-petition to be approved.

    Anyway, thank you guys for being here. If anyone has any ideas on how I should proceed, I would truly appreciate it.

    Bubbles I think you should go to the interview alone, save your money. It was the lord's will that your petition was approved, he will not lead you this far and disappoint you.

    Hi everyone and to LostinNJ, I've decided to go the interview by myself, I really think that I can do it.

    I had my medical this morning, I paid $450. One of the vaccinations that I got, my left arm is swollen. I hope that I can work overtime this weekend to make up for it. Anyway, thank you Lost, also Honest, Niagara and everyone.
