Hey! sorry about the RFE!

but I wanted to let you know that I went to the bank and asked them for a letter stating both of our names. The letter said something like "Mr. and Mrs. H. have had an active joined account with us since ... until todays date" and they happily accepted that. Maybe that helps a bit. I hope they sort it out quick!

I'd like to make a suggestion for a revision to the AOS guide.

I followed it to the letter, obviously. However, what happened to us (and has happened to many) is that we received an RFE for a medical - even though our K1 medical was just a few months ago. We contacted our Congressman, but it was too little too late, as it seems once the RFE is in motion, it's very difficult to get it revoked. So we had to pay (and go through the inconvenience of) getting a new medical exam. Let's just say that was $300 that we could have used in a much more productive way.

My suggestion is that we start including a letter to accompany the sealed I-693 envelope, just in case the ajudicator is not aware of this exemption. The letter would be something to this effect:

Regarding the enclosed I-693:

According to the instructions for the I-693 (attached), a medical examination is not required for a person who is applying for Adjustment of Status from K1 Visa status. Therefore, only the required sections of the enclosed I-693 are completed. The completed sections fulfill all requirements as stated in the instructions, and provide sufficient information for the medical requirements of this Adjustment of Status application.

I don't know if this would fix this problem entirely, but if it means 1 less RFE, maybe it's worth it?

Thoughts?

We received the dreaded "we lost your medical exam" RFE last month (even though, like many of you, my wife arrived on a K1 and had her medical within the past year). I contacted our Congressman right away for help. To their credit, they made several calls to USCIS on our behalf, but kept getting the same answer - it's the POE's fault for not sending the medical to USCIS. My question back - how the hell can I control what any of you guys do? Aren't you supposed to work together in this system? I have to be punished because your system is broken?

Anyway, the RFE is due in 4 days, so we sucked it up today and got a new $250 medical exam. We really needed that money. The system is broken. I really hope someone out there is trying to fix it.

Arrrgh.. we got the dreaded I-693 RFE stating that we had an incomplete physical (when we all know that as K-1 applicants we only had to have certain sections of that form filled out). I immediately called my congressman's office and they are going to jump on it for me. I was pleasantly surprised at how willing they were to help us out! I am going to fax over all of the supporting paperwork to them today and they'll call their USCIS liaison to get it checked out. Fingers crossed!

Just got our EAD and AP approval emails! WOO HOOOOOO!!

Hi everyone, just hitting up this thread for the first time. Filed in late January (for my wife) and playing the waiting game now! Hoping we get EAD and AP soon. Just got an email about an RFE on the I-485.. waiting for that to arrive in the mail. I hope it's not some stupid mistake about the medical because I KNOW we did it all right.

Wow - reading through this thread, I'm realizing that it exemplifies everything that VJ should NOT be about - passive aggressiveness, belittlement, very unsupportive undertones - basically, flaming.

My fiancee just had her K1 interview yesterday so we're still fresh coming out of this process. The inevitable wounds caused by mistakes made during the K1 process are still just as fresh for us as the sweetness of our success. It's hard for me to believe that some "veterans" here feel so jaded, self-righteous, and "knowledgable" that they would try so hard to make an "injured" newbie feel like sh*t.

This really makes me very sad.

We also made the request to pick up the visa this Monday so we could drive together to the States that same day. They obliged! We are picking it up from the consulate on Monday at 3pm.

But Congrats I think everyone got approved yesterday. Except for maybe that guy that was giving his documents at the same time as us. He didn't have anythings filled out and had a criminal record. He sounded really confused. I don't think he was from VJ.'

My fiancee has her K1 interview in Montreal on Friday and I'll be attending with her. We want to return to the USA together on Monday after picking up the visa at the embassy, so that I can get back to work. Obviously I'm hoping we can convince them to let us pick it up instead of mailing it. If not, then I'll need to return to the USA to go to work, then come back on Thursday or Friday (whenever she receives the visa in the mail).

When I've emailed them they said that they only allow pickups by people with valid work visas in the USA. Does anyone know if they allow next-day pickups on a case by case basis, or is it a hard and fast rule?

Hrrm.. I emailed the consulate to ask if the passport did indeed have to be valid for 1 year after the interview (I thought it was 6 months and my fiancee's passport expires in July 2010).

They said yes, we should get it renewed, and re-submit the paperwork with the new passport #.

I'm leaning towards not following that advice, and just bringing the new passport and updated forms to the interview. I've already been told that I am on the "waiting list" for an interview and I get the feeling that resubmitting paperwork to the consulate has the potential of screwing things up (i.e. them "resetting" our case).

Any thoughts?

Just called DOS for the first time and spoke to a nice lady who told me that my fiancee "qualified for an interview" on October 2 and our interview will most likely be scheduled in "November for December, or December for January." She said that most scheduling gets done in the first week of the month, so I should call the DOS again at the end of the 1st week of November to see if we've been scheduled.

A bit more promising than I originally thought.. hope she knows what she's talking about!

OK so we're flying a little blind here, with no clue about the last few people to get interviews! Ahh! OK well I do know that there is at least one person in the past 6 months who submitted their P3 to Montreal and then got an interview date just about a month later.. so I'm going to hold out some hope that this thing can actually get done in 2009 for me and my fiancee!!

So I've kinda lost track here! When is the last time someone here got an interview date, and what date did they get?

Staying with you in America? Is she here on a visitors visa? When are you getting married?

She's here with me, no visa required coming from Canada, she can stay 6 months at a time. Just lots of questions at the border. We're waiting for the K1 to get married. Just returned Packet 3 but Montreal is 4-6 month wait for interviews. This whole process is going to end up taking us about 8-10 months before we can apply for AOS.

I'm just wondering if I messed up now. My Canadian fiancee has been not working and staying with me since we got engaged and will be staying with me for most of the time until we get the visa. Seems like we could have done this differently and shaved 5 or 6 months off the process.

Another option, if you are prepared to get married right now, is staying in the U.S. and filing an adjustment of status. Basically you would have to stay and you cannot leave the U.S. until you get your AP (advance parole, a document allowing you to travel until you get your green card) you also cannot work there until you get your EAD (Employment authorization document) - this can take a few months.

How can you suggest this? Isn't it a huge risk, since she entered as a tourist? How can she just bypass the K1?
