i had my I 485 interview first week of this month IO took my i-94 as well, she even asked me about the abuse.. Which of course like you the question stressed me out.. Few questions about if i was convicted or was a member of a gang.. The IO seems very nice but still i wouldnt know.. So dont worry youll be fine.. I just got the card production email few days ago.. The IO didnt say if i am aproved or what the day of the interview. She just said that i have to wait within 30 days because they have to review ..

yes its normal, you dont need valid passport for interview, as long as you don't require the adjustment stamp., you do need a proof of legal entry and it can be in any form EX: I -94, or else.

well after almost 4 years I got my EAD just last week based on approved VAWA .. i remember my lawyer trying to get me an EAD 3 times while my VAWA is pending i think he just want to get some $$ from me..

and yeah I filed my I-360 May of 2008 and just got approved Nov of 2010 that long! but still im glad that its almost over

After almost 3 years got my approval.. yes , thanks God!

-Got an RFE for good faith & good moral

-I wrote a letter to our congressman

-called the USCIS number to check my case status, it was way beyond the time frame.

-wrote the Vermont Service center to expedite my case.. w/ my letter of request of prima facie extension.

I had 7 Prima Facie since then

I responded My RFE by myself and requested prima facie extension by myself i hired a lawyer to represent me at the court because im currently on proceedings.

My lawyer used to charge me $500 to extend my prima facie thats why i try to did it myself

He was also charging me &2500 to prepare my RFE I dont have cash so i did it myself..

Today I inquire to a different lawyer thru phone and he said that there is no other office that can adjudicate my case except for Vermont but the representative from the congressmans office said that Vermont already forward it to the court and it should be adjudicated by the Judge. when all this time I know that Im waiting for a decision from Vermont..

What now? I have a question I didn't file I-485 and -I765 with my I-360 and im now on removal proceeding because my the first I485 was denied because i was not with my ex that time.

Now, the question is can I still file AOS & EAD even if im in removal proceeding because i have a feeling that they would just deny it because im on a proceeding this is so frustrating

I filed last May 08 Im on proceeding in June it would be my 6th appearance in court. I wrote to the congress to ask for help and they have mentioned to me that my case is no longer in Vermont. and its with the judge now i dont know what to do next.. I thought that im just waiting a decision from Vermont but now Iam wrong this is si Frustratin my lawyer didn't even know that.

Hello Everybody! Today I've gotten an e-mail from USCIS saying that my case was denied. They don't say why in e-mail so I'm waiting for actual mail. I don't know why it was a very strong case. If they were going to deny it why it took 13,5 month and why they issued 2 Prima Facies and why they sent a RFE. I've talked to my lawyer and she said that I have 30 days to appeal it. I was wondering if anybody's case got denied like mine and appealed it and got approved. Any suggestion will be appreciated.

That is devastating well, i may suggest that instead of appeal try to file a motion of consideration or something i remember that its better to go that way than to appeal. im not sure im not a professional.

I filed my 1-360 06/25/2009 and got the prima facie on 06/30. I have no lawyer. Can not afford. Catholic charities could not help either, heard about them after filing. I too did not know VAWA existed. It feels like you are in one hell.

When I filed, I sent in the filing fees. It was returned a week later, a day before the Prima facie. Why did they return the fee? Any idea?

I needed the money though. After he left, I had a severe accident and have been in PT for 3 years. He disappeared with my travel documents, work permit. For a while I was not sure he took them because they just disappeared from my car. Last year, 2 years later, he returned them thru a friend, after the friend threatened him. Thats when I knew he had taken them.

My biggest problem is that I feel like a complete failure. Like I should have seen it coming. I should have asked more about him. I should have pressed about his job. After the accident I consireded going back.

I can not seem to get over this. I have not dated since then. I really do not mind dying.

Hey! Don't lose hope you'll never know you might get approved in less than 7 mos. look at Honest & Beth they filed this year and got the approval this year. so please dont lose hope ok? I understand what you're going into its not that easy i know i feel the same i know its easier said than done well.. But we're here to support each other ..

and I believe you have a refund because the filing fee is waived if the petition is because of Domestic violence of some sort. im not a lawyer im speaking of what i know from what i read here too.. well, lets hope for the best of all..

This week I contacted and requested some help from the congress man in my state, due to the long processing time taken on my pending I-360 and his office replayed that I should hire a lawyer because He doesn't handle this kind of cases. Can you believe it?. It's frustrated.

The second Prima Facie letter I had to request by myself because my lawyer told me that I shouldn't push immigration on my case and just wait until they sent me their decision, so after I read some people's postings on this forum saying that extension of prima facie letters must be requested 15 days before they expire (which it seems my lawyer doesn't know about it), I decided to send my written inquiry to Vermont along with copy of first prima facie letter. So, now I know why my case was touched on 8/12 and my lawyer received already the second prima facie letter dated on 8/13. (I will probably have to request my third one as well by myself). Both prima facie letters are valid for 60 days only, they both say that a decision would be made in the next 150 days and none of them asked me to request any extension 15 days before they expire.

In the other hand, I'm in proceddings now because I missed the first interview with my husband at immigration. Few months ago, after I received Notice of Appear letter calling me into a proceddings, I found out that my husband hide all my mail from immigration: letters/ docs/ ssn card / driver license card, etc., so obviuosly I did not receive that letter and I did not know when it was shceduled our interview and I missed it. Now, I'm also paying to my lawyer for taking care of this new case, because as per their notice I can not show up by myself at the courthouse - must be acompanied by my legal representative. I have had 3 hearings already and my asigned Judge denied the motion requested by my lawyer to cancel this procedding since I have a pending I-360 but instated the judge has called me back to court on december.

Is there any suggestion/opinion/advice out there beside waiting?. What have you read about this kind of issues or situation that I'm going throught?.

Fifth Prima Facie Extension? Oh my GOD!!! Did you request for Adjudicate on your case as its more than their processing time.

Well.. I understand exactly how you feel EWTN I myself also is going to court on December and that would be my 5th appearance there. From my understanding we have to show the judge that we have an approved VAWA before they let us go so meaning we have to appear in the court as long as our petition is pending its like they want to make sure that we dont hide from them OR sad but true that they can throw us back in our country as soon as they deny our petition we can't really rely on anybody but i admire you for asking the congressman i think they wont care about us like our lawyers they are all profit driven professional .. They really dont care about our case they just play pretend that they are concern but in reality what they want is our $$$. Im sorry i just feel that way. i know its bad to be so negative but that's reality. My lawyer want to charge me $ 500 for the extension of Prima Facie . He used to charge me $60 because before i just let his associate do it for me. so i made the letter myself this time and yes they update Your Status date everytime i sent a letter of extension. I just dont want to rush them from their decision. i don't think that's a good idea by now.. Iam just frustrated and very sad about my situation seriously...
