    Evidence of Sustained Income on the 221(g), do I have to include a verification letter from employer or just pay stubs? She was told to provide 1.5 months of pay stubs. Problem is im employed thru agency w/c means 6 mos temporary until the company hires me permanent.

    I was hired from the agency on a contract basis. You know how agency works... u work for them for 6 months & if the company that the agency contracts to wants you, they pay a premium to the agency to get you in. It's kinda like a temp to hire position.

    • My question is, will this be a cause of denial for the K1 visa? This is one of the supporting documents for the I-134 fiance visa petition (K1). Not necessarily.
    • Do you have to be full time permanent to get approved?Nothing is permanent - how does your work history and previous tax returns income look? (these could also be factors)

    Thanks for the response. Worked for 9 yrs & got layed-off 4 mos ago. Prior to that, I worked 4 yrs in the mid to late 90's.

  4. I came to the US through a Fiance Visa. My fiance is a doctor. When I got here, we decided to wait at least before 90 days to get married so we would know each other more because though we've been talking with each other for almost 4 years, we've only spent time in person for a week.

    To cut this story short, my fiance had been seeing this girl whom he dating or have been dating for 10 years. Because of my work background, I am able to access information from him including emails, pics, call logs, sms's and other information which he is unaware that I have access to. So basically, this is not accusations, I have profs and picture with dates on it. The worse part is when they both flew to vegas 2 months before I came here. This is evidenced by dated pics and credit card bill statement and confrontation with him which he admitted.

    I am decided to go back home to my country because I can't marry him because of what he did and his incapabilities to recogniize his mistake and make amends to them. I have given him lots of chances, tried to work things out with him and compromised for him. I have dealt with his repeated infedility to me until my few days before my visa expires. He is unwilling to correct things and that is why I am going home.

    Is there anyway for me to stay in the states "Legally" without having to marry him?What processes would there be? If none, I am more than happy to go home and restart a life and hopefully get my job back.

    There is a way. Talk to an immigration lawyer. They offer free consultations. I spoke to a lawyer few years back but forgot the legal terms she told me. I told her if for some reason I change my mind will my fiance go back or can she stay here legally? And she something like the fiance has to file something and she (the attorney) will show proof and reasons why the marriage did not follow thru.

  5. Though I am presently employed with the economy the way it is it's possible I could lose my job any day now. So this is just a theoretical question. Say I had an employment letter dated today and I lost my job tomorrow and my Fiance's interview was one month from today. What would happen if I used the letter for her Affidavit of support? Would it still be valid? How often do they follow up and contact the employer?

    Consider yourself lucky, we just announced a massive re-org today although we've been lettiing a few hundred go over the last several months in small stealth rounds of layoffs. A buddy called me today to tell me my name was not in the box for the new re-org where it should normally be. So, perhaps tomorrow or friday will be my last day. These things usually happen on a Thrusday or Friday and especially at the end of the month.

    Last week, I sent in my I12F and they've cashed the check so we are now into the process and I will be unemployed shortly-arghhhhh. I can provide the 3 years of tax transcripts of very good income but it will be forshadowed by my unemployement income which i believe they will accept. Its about $586/ week here for me so that would put me within the range of 3 people I believe. Co-Sponors are not available to me so I must make this work on my own.

    I'm in the same situation as you. I called up US Embassy in Manila twice & told me they do not accept Co-sponsors for K1 type petitions w/c uses I-134 form. If it's a family based petition then co-sponsors are accepted. I ask them why they don't want any co-sponsors at all? She said sponsors should be the one financially responsible to the applicant not the co-sponsor. It is difficult for an unemployed sponsor to support the applicant once he/she is in the US. Ultimately, the final discretion is the consul. One member here mentioned w/c is in the same situation as ours that her fiance got the visa despite the rejection of his co-sponsor. The consul determined that the fiance in her line of work can easily find a job once she's in the US & would not be a public charge. Please call the US Embassy in Manila below. Please post any info you got to help other members here. Thank you.

    I'm unemployed and receiving benefits. Can I use my unemployment benefit as an income for filing I-134 (affidavit of support)?

    we are in the same situation, just in case, i went to my interview whit a co-sponsor, and the taxes of both (my fiance and the co-sponsor) and the other stuffs like I134 Pay stubs etc, my fiance in the affidavit put in the line of actual work that he are received benefits. my fiance was in the same boat like you, he worked very hard for the last past years, so his income are pretty good, over over the famous line (125%) , so the consul say me in the very begining of the interview, that i dont need a co-sposor and pass me all the papers of my co-spònsor, i dont know if she really see that my fiance are unemployed or just take a look the amount of his taxes :huh: , but the visas was approved, so this my experience in the Guatemala Emmbassy, i supposed that every emmabasy has his rules, good luck, and put your experience after your fiancee have his beautyful visa in had, i think that thread like this one can help to others in the same situation, now is not rare see cases like ours! :blink:

    Maybe somewhere in the UCSIS rules that if the petitioner don't meet the 125% federal income guideline you must have a co-sponsor to guarantee the US Gov't that the fiance being petitioned will not be a public charge. If however the application was denied (base on income) eventhough you have a co-sponsor (close relative) who is a US Citizen & earning well above the federal income guideline then the best action is for the petitioner to talk to his/her local congressman.

    By the way jokalu, did your interviewer ask you lots of questions before you got your visa?

    No really, just 5 questions, how many are you been married before, how many your fiance have been married before,how many childrens you have, and the same question on my fiance, and the last was, are you have any problems whit the police? so everything was very very easy, she give us the 3 visas !!! why you asked me this?

    You know i just made a post about this Manila "don't like Co-Sponsors at all", but was told they do by a VJ member if the co-sponsor is like your parents? Who was your co-sponsor.....

    Co-sponsor is my brother. I read it does not matter. Petitioner (sponsor) should be the one financially responsible not the co-sponsor when he/she comes here. Basically, if your unemployed, it's going to be difficult to achieve this. I guess US Embassy in Manila is playing it safe.

    I believe that information is incorrect. I know many K-1 filers that have co-sponsors. I am one of them. I have not been approved yet but I have NEVER heard of anyone being rejected having a co-sponsor because they are filing for a K-1 Visa. I have not heard of anyone using a co-sponsor not being able to use the I-134 form. Once you get to the US, you cannot use the I-134 anymore. Then it is I-864 all the way to get your AOS. I will send this to someone I know that is very knowledgeable in this area just to be sure. If this is true, the lives of many K-1 filers have just been severly set back.

    It is consulate and even CASE specific. You can be denied even if you meet the guidelines and/or have a co-sponsor that meets the guidelines. It is an entirely subjective decision by the consulate officer and YES, many K-1s have been denied for not meeting the public charge requirements.

    The income/public charge requirements have never been a "pass/fail" test of meeting a specific level of income only.

    I was, however, under the impression Manilla DID accept co-sponsors for K-1s. Maybe I have read wrong or something changed.

    They changed there policy not sure when. I'll be calling US Embassy Manila again for more questions. I'll also ask when did they changed their policy on co-sponsors.

    Thanks EZGoing but procedures in each US embassies differs (I read a thread on that). The US Embassy in Manila as I was told by the clerk who works there said that they don't accept it. Maybe US Embassies in other countries are OK. I guess in Manila they are very strict.

    "Reflect badly" may not be the best wording but the point is the income is not permanent. The result is they are unlikely to approve the visa without a qualified co-sponsor. Just tell the truth. You are unemployed and your income is what it is.

    Thanks pushbrk.... I was layed-off just recently because of the financial crisis & been working for many years.

    Actually, I used my unemployment benefit as an income and supplied them with copies of checks from unemployment office, letter from my former employer showing my hire & termination date, reason for my termination, pay stubs, 1040 tax form, W2, bank statement for the past 3 months, investments like 401K, & life insurance. I also have a co-sponsor who is well above the federal poverty guideline.

    Am I in the right direction??

    The I-129F which I filed for my fiance was approved 2 months ago & I'm now filing for the I-134 (affidavit of support). The problem is I was just layed off from work. On question #7 of I-134 form can I write down my employer even though I don't have a job anymore? I'm also going to include my parents as a co-sponsor. Submitting 2 affidavit of support (I-134) one for me & the other for my parents will that be ok? Presently I moved back living in my parents house.

    NO. If you misrepresent something on this form it is a "material misrepresentation", big trouble. Had the form been filled out and signed before you got laid off...but it wasn't.

    If you have a co-sponsor, do not worry about it. Your parents will have to do an identical I-134 with their own support information.

    Thank you for your response Gary and Alla. Can I fill out an I-134 form for myself and write "unemployed [Date of termination]" on question #7? I want to show the consul that I have sufficient funds on my savings account and investments I have in my 401K. The second I-134 will be for my parents. Oh let me ask also if a brother or sister can file an affidavit of support instead of my parents?
