  1. Hey everyone,

    Wow it's so good to hear we aren't the only college students! :D I'm a graduating senior (graduation will be June 13) and my husband isn't a student but is waiting to get permission to work. Anyways, our AOS was received April 7, so we're waiting for our hardcopy of the NOA1 and the biometrics appointment letter. I didn't work these 3 years but my friend is co-sponsoring us so hopefully that's all that matters. I was wondering what everyone is planning on using for proof of marriage (besides photos and the marriage certificate).

    Hello everyone, I'm rather new to this and I finally found a thread in this site of those who had to go through the process in Italy.

    I am the Italian beneficiary, we recently sent our I129F and got the NOA1 a week ago or so, therefore we still have a LOOOONG way to go until Naples :clock:

    Anyway, while we are waiting for the NOA2 (no RFEs, pls) I wanted to start gathering all the documents that I will need for the interview at the consulate.

    I have a few doubts about what documents are really needed as for:

    - Military: Congedo illimitato? Foglio Matricolare? Both? or what else?

    - Police: Casellario Giudiziale? Carichi pendenti? Both?

    The person who reviewed it also gave the Italian names of the necessary documents, enumerated next to "Other Forms (if any)?" The police certificate is the CERTIFICATO GENERALE DEL CASELLARIO GIUDIZIALE, and don't forget that the "estratto di nascita" is the long form, with all of your parents' info too. I don't know about the military records as my fiance' didn't serve.

    what I did was fax them the D-230 right away, then after about a week they sent me packet 4 which was basically further info on the medical exam. As for the outdated forms in packet 3, I sent an email and they said its fine, you can use either the new unexpired version or the old one.

    Everything is at the Naples Consulate now and we're gathering the montagna of paperwork. I'm confused by the instructions because it says FIRST fax the D-230 Part I right away, but then later it says to fax it with a statement swearing that you have all of your documents in hand. So if we're still in the "hunter/gatherer" stage does he fax it or not? It's ready to go.

    The other confusing thing is that all of the forms they emailed me in the famoso "Packet 3" are out of date. I went online and got the new ones per non sbagliare, but I'm a bit perplexed why an official Consulate would send out-of-date materials to you which, if you filled them in, wouldn't be valid.

    Argh.

  5. My fiance doesnt have a record of his immunizations, therefore I believe he will have to get them re-done. I read on the site that the vaccine for varicella is unavailable. When I received Packet 4 containing ore detailed info for the medical exam, I realized that for his age bracket, a vaccine for varicella is marked as "no". So I would assume that he would NOT need to get it done correct?

    Also, strega, did you two make an appointment for the interview yet?

    When the form asks "how long do you intend to stay in the US" would "permanent" be a good response?

    Also, my friend's dad said he would give my fiance a job, but I think he would be paid under the table, should I list on the form that my fiance will be working for him? Or should I say that he wont be working at all?

    Sure.

    Well, if you don't have copies of the original thing you sent, there's not much you can do. Next best thing is refilling the forms, but I'd note that somewhere, just in case.

    Each consulate is different, in the packet you'll receive they'll specify. In Naples' case, tax returns are required, pay stubs, I don't remember if they are, but a letter from an employer could be easily faked, so having a pay stub is just a stronger verification. You can go to the Naples consulate site now and download the forms, the directions sheet elaborates on all the requirements.

    What I meant for filling out another copy versus the exact duplicate was forms sent in to USCIS for the initial approval (I-129F, G-325A, etc), since we didnt make any photocopies of the forms. I DO however have the original evidence sent in (photos, boarding tickets, housing contract, etc.)

    In regards to the affadavit of support, I looked on the I-134 form instructions online and it asks for a bank statement and a letter from work. I did not see anything in regards to copies of taxes filed or pay stubs. Did you two ended up needing to show pay stubs and tax returns as well, or was that just "extra"? (this is the crux of my anxiety)

    I haven't looked at your profile, but if you haven't already you should create a timeline. From there you can easily look at people who have timelines similar to yours, to better gauge timing of these things. In my case I believe it took about 7-10 business days, but check my immigration timeline to see.

    2. will Naples send me (the US petitioner) an email letting me know the approved petition has arrived? I signed up for the case status update online but it seems that USCIS simply forgot to update our case online.

    I (USC) received an email from the Naples consulate saying that they had received the petition and to wait one week to call to make the appointment

    3. will Naples send my fiance Packet 3 via snail mail or simply tell him to download the info online?

    Both. It's better to just download it yourself now and get started, so that as soon as you get the go ahead you can mail stuff in

    If your CURRENT INCOME does not meet 125% of the poverty line, you will need a sponsor. So, yes, your mom would need to complete and procure all of the I-134 documents/supporting evidence

    5. since my fiance and I live together, what should I use as proof of our on-going relationship?

    This is tough, don't know of any situation where the USC is currently living with the foreign fiance. What did you use for the I-129F?

    6. do we really need an exact photocopy of our petition that we sent to the service centers, or could we simply fill out another copy?

    Where did you read that you need this? Am assuming you'd need an exact copy, since many of the items you should have submitted would have been original documents, e.g. boarding passes

    7. would it be cheaper to get the inoculations at a regular hospital versus at the Varelli Institute?

  10. thanks for the info emmaline q! you definitely helped me feel a lot more relieved (knowing there's hope). I truly appreciate the advice on getting my transcripts and an adviser to sign vouching that I'm a full-time student... i was freaking out, breaking down, and worrying so much...it's nice to hear that I'm not the first person to attempt this while still in college :)

    Im so excited to have found this posting for all the March 2009 filers, so now we can all share our experiences. I definitely feel that all I can think about everyday is this K1 visa...

    I was wondering if anyone who filed in March received a NOA2 yet? According to the timeline on this site, those of us who filed at the California Service Center should be receiving them around the next of couple weeks. Our I-129F packet was received March 16, and I received in the NOA shortly afterwards stating it was received on the 16.

    From looking ahead to the I-134 Affidavit of Support form, what should you do if you are still enrolled as an undergraduate student and are not working. I am actually studying abroad in Italy (for the 2008-2009 school year), and have gotten an extension to remain in Italy as a student until the start of winter quarter (Jan 2010), just so I can be with my fiance. Both of my parents are fine with the idea, and I plan on having my mom be a co-sponsor, since I dont currently work. Does anyone know if our visa will be rejected on the basis that I do not yet work (since Im still finishing up school), BUT my mom's income fulfills the 125% income level? This is one of the most pressing concerns I have about our petition. I mean I'm going to get my B.A. from the University of California Santa Barbara in June 2010, so it's not probable that I'm going to end up working in a fast-food chain. Do you think the US Consulate Officers in Italy will take that into account?

    I know our story is a bit different. We met August 29, 2008, and two months later we moved into an apartment together, just the two of us, since we spent every single night at each other's apartments anyways. I even sent in our lease as proof of having met in person, but I didn't get it translated into English though. Then in January after we visited his mom and step-dad, he surprised me by taking me to the jewelry shop and told me to pick a ring, and that's how he popped the question :D

    Anyways, we are planning on changing apartments in September from the one listed on the I-129F. Does anyone have an idea of what we should do to let USCIS know our current address? I'm hoping that we get the go ahead from the NOA2 before we change apartments.

    My fiance is eligible to become an Italian citizen and thus travel to the US on the Visa Waiver Program, since his mom married an Italian and she was sworn in as a citizen 10 years ago. Does anyone know how long it takes from the date of request to receiving Italian citizenship? It's frustrating that after 5 years of living in Italy, he never got around to asking for citizenship, since with his current passport from the Dominican Republic, he can't enter the US without a visa... Does anyone know how he could get the Certificado de No Antecendentes Judiciales without traveling to the DR? He lived there until he was 17yrs old before coming to Italy, so I believe it will be needed...

    I hope I didn't write or ask too much, and that I made some sense. It's just relieving to be posting in a place where everyone else knows exactly what you are going through... Good luck to all of us and I look forward to reading any responses :)
