  1. Technically yes, but is up to the USCIS's discretion to grant or deny. About 5 years ago I had a friend that went through the naturalization process and she was working out of switzerland using her greencard and would come to the usa for 3 months, and then go back to switzerland for 4-5 months. The person doing the interview drilled her about it, but she still got her citizenship; so really, hard to tell you an answer because we won't be the ones approving or denying your case. Most likely it shouldn't be a problem, but we don't work for the USCIS B)

  2. Hi All.

    I apologize first for posting this under the section "Traveling prior to getting a green card". I couldn't find a relevant section for posting this topic.

    I have obtained my 10 year permanent resident card. I am planning to go to Europe for an extended length of stay that is less than a year. I am also planning to apply for citizenship in 2011 which will be the time I will be eligible. However, the requirements for travel outside U.S documentation is a bit confusing for me. I was wondering if anybody can help explain it. Below is the statement that I find a bit confusing.

    "has been physically present in the United States for at least 30 months out of the previous five years (absences of more than six months but less than one year shall disrupt the applicant's continuity of residence unless the applicant can establish that he or she did not abandon his or her residence during such period)

    has resided within a state or district for at least three months"

    My question regarding the above statement is:

    1. If I stay outside the U.S for 5 months come back for 2 months and go outside the U.S again for 5 months everything within the same year will that be allowed under the above rule ?

  3. Thank you all for shedding a lot more light on this topic. I really appreciate it. At this point, I'm not sure whether to go through the hassle of USCIS interviews to prove that our marriage is genuine or wait two more years and apply by myself. I'm still giving it a serious thought and I will let everyone know on this boards of any updates on my decision and its outcomes.

    As a side question: If I decide to apply and if USCIS decides to decline my citizenship application based on a lack of evidence to prove we are still together, Is there a possibility that they can use the same ruling to revoke my 10 year green card as well ?

  4. First of all, I would like to thank everyone contributing on this forums. Advices I have read on these forums have really helped me during my green card process.

    I have finally obtained my 10 year green card through marriage to a U.S citizen. I am eligible to apply for citizenship in 10 months under the category of being married for 3 years. Although I am still happily married with my wife we don't live together. This is due to the fact that my wife was laid off from work and she found a new job in a different city and state two hours away from where I currently live. We have been living separately for almost a year now but we usually meet on the weekends and for vacations. We are still working on arranging job situations so that we can start living together again.

    My question is, based on our living condition, Am I still eligible to apply for citizenship ?

    I understand I need to consult a lawyer to discuss this matter as well but I just want to know the general consensus on this forums and also if there is anyone who have been in a similar situation like me and what action they were able to take.
