    i think that schedule is too tight. if the medical is the same for everybody, then medical takes 2 days to finish. also st lukes will be the one to deliver the medical results to USEM and i doubt if they will be able to send the results to the USEM in one day. i think a week before the interview is enough? any feedback guys? :unsure:

    My son is going to have an interview at the Embassy in Manila this coming Nov. 19th. I would like to ask your opinion/s regarding the physical exam.

    Physical exam, how long will it take? And after the exam how many days before the doctor's releases the result?

    I am planning to have my son fly to Manila on Nov. 15th, and do you think 3 days will be enough or do we need extra time just in case?...

    Also , for those of you who has a child born out of wedlock and had gone through interview already..... any idea what the questions are during an interview?... My son is 20, so he can answer all the questions... I just want to prepare him for the interview. Any advice will be much appreciated...

    One last question, does anyone here knows any hotel in Manila that is very close to the Embassy or in between St. Lukes and Embassy and also in very reasonable price?

  3. ^_^ mmmm Its very controversial and timely among couples. Taking for intance a Filipina marrying a foreign national. I could tell that my future hubby and I have underlying issues and concerns relating to it that of which reflects both our values, character,social perception and commitment to each other.

    Could it make or break our relationship vows?...Only both of us could tell thru time and experience. What I could assure him is that no matter what , I have his back . And I love and care for him so much. ^_^ Aussie (our own lingo of understanding :wub: ) kisses, Honey Chuck!

    My husband and I have a prenuptial agreement before we got married. We have been happily married for almost 7 years now. At first, I questioned him why do I have to sign a prenup and he explained it to me. I understand the whole situation.

    If you are not sure, consult a lawyer and make sure you understand what you are signing. My husband actually told me that it was okay to hire a lawyer and he would pay for the cost. I did read the agreement and signed it without hiring a lawyer. Yes, I made sure that I understand what I was signing.

    I married my husband because I love him not because of his money or assets. Yes, if you dwell on it and think that your spouse/fiancee do not trust you completely,,, then you will have issues in the future. Prenuptial agreement is a very touchy subject to a lot of people. Some men just want to make sure that you are not aftering their assets/money. YOu have to realize they work very hard for what they have and that's why some of them like to have a prenup. I would do the same thing if I was a man and I have lots of assets.. etc... I am a filipina too... Good luck!!!

  4. Hi Everyone,

    I have a couple questions to those people who have gone through enterview already... I hope you can help me.

    My son's enterview will be this coming Nov. 19th. He already got his NBI and Police clearance but what I did was sent them to National Visa Center.

    Does my son still need to get those eventhough he already submitted them to NBI?

    Or will the embassy honor the photocopies... or it has to be original?

    Also, is there any issues getting NBI clearance for the second time or this is no big deal?

    My son has the bottom copy of the NBI except the top portion.

    I hope you guys can give me any answers. Thanks again in advance... I will appreciate any feedback you may have.

  5. Hi I am Brian and my fiancée Cherry Lynn, Cherry has a 2 1/2 year old son, whose father has never been involved in his life and we don't know where the father is. Cherry was never married before however the father's name is on the birth certificate of her son. So her son has effectively been abandoned. No paperwork has ever been filed for abandonment. We are wondering what will be required to bring her son to the US as an attachment to our I-129 F.

    Please help us in figuring this out.

    Couples weeks ago I have posted also a question similar to yours... regarding custody papers that the National Visa Center asked me to get because my son, who is now 20 years old, was born out of wedlock.

    I wrote to NVC and explained my situation and that my son's father was never involved in his life, nor the father try to contact my son.

    Anyway, I just explained it on my letter and I had it notarized and sent it to NVC. I received an email last Friday and they approved my letter and now my son is ready for his enterview on Nov.19th. I am so happy and thankful that the NVC did not ask any Court documents....

  6. The only issue I have is the National Visa Center... they want to make sure that I have sole a custody of my child and it's not a joint custody. As you know in the Philippines, when the father is not invovled in a child's life, the mother is automatically has the custody... which is not in writing anyway.

    The link below may help you with NVC. When you write the NVC, inform them that under Philippine law, a mother has sole authority over her illegitimate child and then refer them to the link. In addition, you may also print the link below to support your letter but make sure you highlight the words that pertains to your authority as mother. This is law that was amended and passed by Congress and signed by the President of the Republic of the Philippines.

    SECTION 1. Article 176 of Executive Order No. 209, otherwise known as the Family Code of the Philippines, is hereby amended to read as follows:

    "Article 176. Illegitimate children shall use the surname and shall be under the parental authority of their mother, and shall be entitled to support in conformity with this Code. However, illegitimate children may use the surname of their father if their filiation has been expressly recognized by the father through the record of birth appearing in the civil register, or when an admission in a public document or private handwritten instrument is made by the father. Provided, the father has the right to institute an action before the regular courts to prove non-filiation during his lifetime. The legitime of each illegitimate child shall consist of one-half of the legitime of a legitimate child."

    Our Dept. of Social Welfare & Development is also clear on the authority of the mother over her illegitimate children. You may also want to refer the NVC to the DSWD website.

    CAN A TRAVEL CLEARANCE BE ISSUED TO ILLEGITIMATE CHILDREN WHO ARE STILL APPLYING FOR THEIR VISA IN THE EMBASSY?

    Illegitimate children are under the custody of the mother. If they will be traveling with the mother, they are not required to secure a travel clearance from the DSWD. If they are traveling with person other than the mother, they must secure a travel clearance.

    WHAT ARE THE REQUIREMENTS FOR ILLEGITIMATE CHILDREN ABANDONED BY THE MOTHER AND UNDER THE CUSTODY OF THE FATHER OR OTHER RELATIVES WHO WILL BE TRAVELING ALONE OR WITH THE FATHER OR OTHER RELATIVES?

    Since the mother has the absolute parental authority over her illegitimate children the father would need to secure a Court Order vesting in him the parental authority over the illegitimate children. If a parental authority has been granted to the father, and the minor will be traveling with the father, he is not required to secure a travel clearance. If the minor will travel alone or with someone other than the father, he/she is required to secure a travel clearance.

  7. I would also call the NVC ( they are a little better than USCIS ) and ask them about this, I too am confused as to why they would need to ask for this if your son is over 18? Please let us know how it goes.

    Thank you for your feedback. Yes, we already contacted the NVC twice and talked to couple people but we did not get the same answer. Every single one of them had different suggestion on what to do. I thought that they would have the same advice, unfortunately they don't have a specific guidelines... Only that you have to follow what they tell you to do and if they are satisfied the documents that you give them then it's wonderful if not then they will ask more documents.

    I already wrote a letter and explained myself where I am coming from. Yes, I do agree with you totally that my son is not minor anymore. However they have to follow the immigration laws. So I just have to obey their rules. I hope that the letter will help and my son's photograph. I'd let you know what happen in a couple weeks or so. I am being positive.... and thanks again!

  8. My wife does not have a a hospital issued birth certificate.

    How have people gotten around this situation? Can anyone share an example of birth certificate that has worked with NVC? It will be specially helpful if it's a Nepalese birth certificate.

    I don't have a birth certificate. It was destroyed by the fire and couldn't obtained it at the place where I was born.

    You have to have an affidavit made by the municipality where she was born. Affidavit from her parents, affidavit from 2 witnesses at the time of her birth... they could be her godparents, and the affidavit made by the court or the place the birth certificate where it should be filed at the time of her birth. The affidavits must be signed and notarized. I was born in the Philippines and I am a US citizen now and that is what I did when I was petition by my husband.

    Here is my case: My son was born out of wedlock and he is using his father's last name and it's also on his birth certificate. I was not married to his father. My son has never seen his father nor his father is involved in his life. I thought that I am almost finished with his petition because I have submitted his DS-230 along with the requested documents by the National Visa Center, unfortunately, the NVC emailed me and requested more documents such as CUSTODY PAPERS...

    My son has already gotten his passport and there was no issue obtaining it. The only issue I have is the National Visa Center... they want to make sure that I have sole a custody of my child and it's not a joint custody. As you know in the Philippines, when the father is not invovled in a child's life, the mother is automatically has the custody... which is not in writing anyway.

    If anyone out there have similar case and who is already gone through this same situation, I will appreciate it very much if you can give me any details or input.

    What did you do to accomplish the Custody Papers? Did you or have you gone to the court? Or did you file at the police station the missing father?,... or did you have your case published on the newspapers in the Philippines? Please any feedback... I will appreciate it... Thanks so much for reading this post/reply.

    We have two children included on the I-129f. Unless things have changed, my wife wasn't required to have a letter from the father. I think the DSWD (Philippine dept of family service?) has some info on their website concerning traveling with children and what is required. Good luck.

  11. I really need your help fellow members. I am confused about this DS 230 form and the choice of agent form.

    My questions are:

    DS 230 Part 1 page 2-- Signature of applicant?

    1- WHo will sign as the applicant? my minor kids who are the beneficiary? Or my mom who is the legal guardian of the kids?

    2- Can i just print this form and sign it myself since I am the mother of the kids and they are minros(7 & 11) so i don't have to send the forms to the Philippines for them to sign and send back to me here?

    Another question is about the Choice of Agent Form

    1 -When should i prepare this Choice of agent form?( we are still waiting for the NOA 2 of our I -130)

    2 SHould i prepare this or my mom(legal guardian) will do it?

    2.WIll this form be sent to me by NVC or i can just print them from their website?

    3. If this form is filled up can i just email it to NVC or send it by mail?

    4-Lastly who will sign this choice of agent form? my mom who is the legal guardian or i can sign it since i am the biological mother of the benefeciaries?

    I am freaking out so plssss.. help me and i would really appreciate your inputs.

    I will try to explain my situation because we are in the same boat pretty much except that your kids are very young. I have only one son and he is 19 years old, so I don't have to worry about having anyone signing the form for him.

    I am also his petitioner and choice of agent. You really need to pay attention to what the National Visa Center sent you. They are pretty strict and thorough about documentation.

    Here's what I can tell you:

    The choice of agent was filled out by my son and signed by him and returned to NVC. My family mailed it from the Philippines... registered mail.

    When the National Visa Center received the Choice of Agent form, NVC then will send you another letter that you are chosen as an Agent.

    I think at this point they will send you a bill for the AFFIDAVIT OF SUPPORT, and once they received the payment then you can send the necessary documents that they asked in regards to your affidavit of support.

    Also, I have received a bill for the DS-230 which is $400.00. After I paid it, they sent me an email that they received it and now it is time for the intending immigrant which is my son to process the DS-230 application form. There is a website that you can look at and read everything there... they will send that to you too. But do not do anything in advance until they tell you to do so. Here is the website www.immigrantvisas.state.gov Just follow all the instruction there and it is very time consuming reading all the materials and following exaclty what they tell you to do.

    Right now, my son is working on getting all the necessary documents and once he obtain all the documents, he will send them to me and I will send it to the NVC. He is also needs this documents that is mentioned on the site because he will bring them with him during his enterview. It has to be original or certified copies and then make some copies too just in case something happens....

    What happens next... the National Visa Center will forward all these documentation to Manila Embassy and then they are the one that will send a letter to my son and tell him when his interview is going to take place.

    Please take your time reading all the information posted on the website I have provided for you. It is very helpful. I am so busy trying to prepare all the documentation and it really requires time and effort. Make sure all the names, address, etc.. are spelled correctly and always the same all the time with all the documents you are filing from the day one.

    I hope the information that I wrote here will help you a little bit. As far as signing the form, someone may be able to help you because I don't know... I understand your kids are still minor.
