    here is the story:

    I came here on a K1 visa (2007) USC husband filed I-130 for my 2 kids in the Philippines. Kids Birth certificates has date and place of marriage.

    Just wanna share to u all another good news . It was impossible but really God made a miracle. My kid's I -130 was both approved!After i got the approval of the removal of my condition my kid's were approved.

    Thank you all sooooo much for the encouragement and even the discouragement.God is really great! have the best christmas presents ever.

    Can you give us a detailed information, why it became miracle?? was there a problem with your kids papers?? coz im processing mine and until now i havent receive any information

    For me it was a miracle. Had asked so many about my case even lawyers,,and all most of them told me to cancel the petition.. Some said i will be charged of legal misrepresentation for supplying USCIS a public document (birth certificate) with date and place of marriage .

    To make the story short..i trust my faith in God.had submitted all the documents i had and it was approved.

    hmmmmm..........your story is familiar to one person i know......well anyways! congratulations!

  3. Hello everyone! Just got a quick inquiry, My husband (USC) and I (LPR) are filing to petition my kids, the receipt date on the NOA is August 22, 2009 and the Notice Date is October 22, 2009. They are in another country, can anybody here tell me their experience on how long and the process til my kids gets their interview date.........

    today is very sad day. i went for my interview at the embassy and they give me back my passport and a letter saying 'unable to issue a visa to you because you have been found ineligible to receive a visa under the ff section:

    section 221 (g) which prohibits the issuance of a visa to anyone whose application does not comply with the provisions of the Immigration and Nationality Act issued pursuant thereto. There following remarks apply in your case:*

    221(g) for police report and AOS. Requiring proof from IRS of 2008 taxes. (Quarterly tax filings)

    Please help me. Does this mean i am no longer able to get visa issued anymore?

    However, The lady that interviewed me asked me to get police clearance of my fiance and also his quarterly tax filings.

    Is it already denied?? or i can still get approved??

    Are u sure its not your police clearance they are asking for? It would be strange for them to ask for police clearance of the petitioner at the embassy stage. I could understand if they are requesting his quartery tax filing becuase he is the USC and sponsering you. Did you submit your police clearance?

    Also, it seems like 221g's are very common and usually if you submit what is required you normally will get your visa approved. Do not fret about this and just get them what they need asap.

    they are asking me for police clearance from philippines as i come from there but i am living now in singapore. i only gave them police clearance issued by singapore police.

    my fiance gave his income tax but officer requested for quarterly tax filings. office said that she's afraid my fiance wont be able to support me.

    do you think additional bank statements will help too?

    The additioal bank statements are a good idea. Get everything that shows he has sufficient income. But, they usually want what they request as far at the quarterly filings. The bank statements could be proof of additional income.

    tell your sponsor too that try looking for CO-sponsor to help you out, like a relative with w2 income, it will help a lot

  5. Because she stayed here illegally, the USCIS must follow the procedures used as if she were the beneficiary of a K visa (filing the I-130) as part of the AOS process. The police record must be provided.

    Why exactly is that? The I-130/I-485 package does not require a police record. It can be required for the I129F, but that is not required if filing for a spouse in the US. The processes are not the same.

    thats what i thought of, the processing of petition in US is different from outside US.

  6. Hello everyone! I have a quick query. My friend is currently processing her adjustment of status. She is in US already and came here under B1 Visa. She married her BF USC and now processing the petition. The lawyer she hired ask her a copy of NBI Records (philippines), i thought it was strange coz she is here already and came here under B1 Visa, she overstayed for a year before she married her BF...is there anyone here like her case who still required to get an NBI clearance (philippines)...

Can somebody help me....My wife in under B1 Visa and already expired for two years....im a USC and her petition is already in process. the lawyer ask us if my wife can get an NBI clearance from her country, the problem is my wife cannot come home yet till she gets approved and get her GC. Is someone here with same situation to us. Do we really need an NBI Clearance???please help us
