  1. Hey everyone!

    Typically what do people do for health and auto insurance once your spouse gets to the USA?

    health insurance is definitely going to want to see their previous health insurance statements before they will give you insurance, no? or does the medical exam for the visa get used instead as a record of good health??

    how about auto insurance? i cannot even get a quote without entering a name on the websites. won't the insurance be too high because they don't have a USA record??

    what will most people do?

    Neither my health insurance or auto insurance company required proof of prior coverage. I already had coverage for both, and was juat adding her to my existing policies, so I am not sure if your situation differs but...

    I was able to add my wife to my auto and health insurance without any issue, once we were married. Both asked for a SSN, but did not require it. She was able to get a driver's permit, auto insurance card, and health insurance card, all prior to receiving the SSN number. The only thing we had to provide in both cases was ID (passport, I-94) and a copy of our marriage certificate.

    In fact, the only issues we had was with my bank. It was incredibly difficult to add her to my banking accounts without a SSN, so we ended up waiting for it to arrive before getting that done.

    By 'a lot' of work, I mean anything over the amount allowed under the Family Medical Leave Act. I had a link earlier this year for it, but cant seem to find it now. If I remember right, it covered any continuous 12-month period during and/or after birth and was quite a few weeks of unpaid leave authorized for care of the child.

  3. Just my opinions, so don't take them very personally... :)

    Situation #1: Not much you can contest on this one. If you are missing a lot of work, that is a valid complaint that the boss is making. But really is is up to the individual boss how strict or lenient the wish to be. I have been fortunate enough to have a boss that has let me take an extra 2 weeks off this year (unpaid) to visit my fiancee during our K1 process. However, I know for certain that if I continued to request unpaid time off in the future, in addition to my regular leave, they would begin to complain about it as well. If I were in the same situation, I would just try to stick it out for a while, because I will not need to take all of this extra time off forever and ever, right? If I was continually needing so much extra time off, I would begin to search for a job with a more flexible boss or more flexible schedule.

    Situation #2: You have every right to mention this one to HR if you choose, especially since you can demonstrate proof that your name listing is being treated differently than other employees at your company. This is discrimination and cannot be allowed. Be careful though, considering Situation#1 above, there may be an opening for your boss to mention to the wrong people that you have been missing too much work lately. Not likely, but it could happen.

    Nothing is worse that working in a hostile environment. (Been there a few times.) Hopefully things will smooth out over time, but always keep an eye open for other opportunities if they come by. Even in this economy they are out there.

    i was asked how we met and if i met my fiance's kids, thats all. very polite, no delays, nothing, took 10 mins or so

  5. I have no personal experience with what you are describing, but If you have the appropriate waiver forms, I would suggest submitting them yourself first. The worst they could say is 'no', then a lawyer may be appropriate. (I guess I just have a personal bias against using legal services if it can be helped.)

    You may be able to just reiterate what you stated about IMBRA having a 2 year requirement. Someone there may just not be checking dates very carefully.

    The Application Process:

    :: For K1 Visa Holders ::

    As a K-1 Visa Holder you are eligible to receive a SSN upon producing a valid I-94 (unexpired). Do

    not wait until you only have a few weeks left until your I-94 expires to file for a SSN. Many SSA

    offices will not allow you to file for a SSN if your I-94 is about to expire (generally 14 days prior

    to the expiration on your I-94). On the other hand, you should also not file for a SSN too soon either.

    You should wait 2 weeks after you arrived in the US before applying for a SSN. If you go too soon your

    record of arrival will not be in the SAVE-ASVI system yet, and it will require manual verification from the

    USCIS. As this will add weeks to the period it takes to process the SSN, it is advisable to attempt to wait the two weeks to be safe. If you have waited the 2 weeks and they tell you they can not verify you arrival record via the SAVE database, you may allow them to to process it (but remember the potential delay for manual verifications). You can ask if they will check the computer again for you in a few days or return personally to have them look again -- thus eliminating the manual verification. The manual verification will require the SSA office to file a G-845 with the USCIS.

    To apply for a SSN you will need to go to your local SSA office and bring the documents below. These

    documents are proof of your eligibility to file for a SSN:

    1. The SS-5 form you downloaded and filled out (they have some at the office if you forget).

    2. your Passport (with the K-1 Visa in it)

    3. your valid I-94

    4. another form of valid ID (as defined in the SS-5 instructions)

    5. You should also bring the document RM 00203.500 that you printed out

    Make sure to bring all the documents above because some offices have staff that are not aware

    that a K-1 Visa Holder is eligible to file for a SSN. A friendly reminder is a nice thing to have -- if not

    you could be turned away incorrectly.

    Once you have successfully applied for your SSN, the SSN card will come in the mail in about 2 weeks. You can check on the status of the SSN application and/or often get the SSN in advance by returning in person (try calling) to the SSA office. If you need your SSN before it arrives in the mail you may ask them for an SSA-7028, Notice to Third Party of Social Security Number Assignments, to be sent to your employer or other interested third party once a SSN has been assigned. Your card, when you receive it, will be marked with the words "VALID FOR WORK ONLY WITH INS AUTHORIZATION" indicating to an employer that you must also have an unexpired EAD to be eligible to work.

    :: For K2, K3, K4 Visa Holders ::

    As a holder of a K2, K3 or K4 visa you must first have an EAD from the USCIS. You will be required to

    show this to the SSA agency to be eligible to receive a SSN.

    To apply for a SSN you will need to go to your local SSA office and bring:

    1. The SS-5 form you downloaded and filled out (they have some at the office if you forget).

    2. Passport (with the K-2, K-3, or K-4 Visa in it)

    3. your valid I-94

    4. another form of valid ID (as defined in the SS-5 instructions)

    5. A valid EAD

    Only persons age 12 and older must apply in person. A derivitive visa beneficiary (K2 for example) may

    elect to have their parent (the K1 for example) apply on their behalf (they will still need all the required

    documents). The SSA will most likely need to verify the validity of the EAD and will make a copy to send to the USCIS as part of the SSN processing. Once they verify the EAD you will receive your SSN card in the mail.

    You can check on the status of your SSN application and/or often get the SSN in advance by returning in person to the SSA office.   8. Thanks for the well wishes! Going nuts waiting for the interview date to arrive, but mostly just can't wait to see my sweetie in Japan in 3 weeks! :)

    I'll try to pass the time preparing for wedding in 2010 and upcoming visit to Japan in November :D

    You are already planning your wedding?! Now I feel really behind schedule! hehe :lol:

    Seriously though, we have discussed it, but haven't decided on what we would like to do yet. We will most likely get married in January or February if all goes well. One option we are considering is to have a simple ceremony at a Shinto shrine here in the states, with a reception to follow later in the year when it is warmer outside.

    Just dropping in to say hello. We have finished our packet 3 requirements and have an interview coming up on 2-Nov. I am going to visit her in Japan during this time. Won't be attending the interview of course, just going for the emotional support. :) Hope everything goes smoothly! I'll be so relieved when we have that visa in hand. :unsure:

    I have been reading some of the embassy reviews for Tokyo, and most seem to be very quick and easy.

    Wow! I just heard from my sweetie that we recevied our interview date. I am amazed how quickly we have moved through thw system, especially for all the worries about getting held up somewhere in the process. In the end though, our hard efforts paid off and the interview is scheduled for 2-Nov, exactly 5 months from our NOA1 on 2-Jun! :wow:
