  1. Hello all, here is the situation: i now have 2 good jobs but for the past few years i was not making much $$ on paper as i was living on a family farm so i did not show enough income to sponsor my now wife to be able to come here so my parents co-sponsored as they have enough $$. Now we are applying for the AOS and my parents have sent me their completed I-864 with their tax returns, but they only could find 07 and 08 for my old returns (i now live in FL and they are in NH along with all my previous tax information) so my question is what do i do? do i leave it blank? just put in some random amount? None of the years were that much $$ , 08 was a bit over 6k and 07 was just over 3k.... like i said, i did not make much $$ at all before. Just looking for some good advice on our next step as my wife wants to apply soon so she can work!!

    thanks in advance,

    bill

  2. Hello everyone, question regarding the situation we seem to be in right now. My family owns an apple orchard in NH and although i just recently moved to FL i have been able to secure some time off of my new new job to be able to go to NH and help with the apple harvest, which i would like to do to help out my family, the problem comes that Maria's interview is on Sept 16 and provided it goes well she would be arriving here in the states sometime in late sept. right around the time i would like to be in NH helping with the apple harvest.

could she arrive in boston or somewhere in the northeast, get married up there, help with the harvest, then drive back to FL and finish up any paperwork we have not completed in NH??? would this be a problem?

    thanks for any input/ insight!!

    Bill

 she will be here soon!!!

  3. I'll take a shot at this...

One of your parents will have to assume the co-sponsor role. It can't be both of them. The co-sponsor will have to fill their own I-134 according to their own circumstances, and provide their own evidence. In other words, their I-134 will state the number of dependents they have (including your fiancee), their income, their tax forms, and their assets. For relationship to sponsor, I would think "father/mother of fiance" would suffice.

If your parents have enough income to qualify without assets, then they don't need to list any assets. If they are short on income, then they'll need to list assets to qualify. Note that there are no rules for what is needed to qualify with the I-134. This means that the consulate has wide latitude in what they are willing to accept as assurance that the beneficiary won't become a public charge. Most consulates use all or part of the I-864 requirements, so that's usually a good place to start when trying to determine qualifications. The I-864 allows YOU, the primary sponsor, to make up any shortfall in income with assets that are 3X the value of the shortfall. However, your parents are not sponsoring a spouse or minor child, so the consulate may require their assets to be valued at 5X the value of their own shortfall, since this would be the case with the I-864 form. This is a consulate specific issue. Some consulates are also reluctant to accept a co-sponsor that requires assets to qualify, since this is essentially declaring that neither the primary sponsor nor the co-sponsor have enough cash income to support the beneficiary.

Any credible proof that they own an asset should be acceptable. For land, a copy of the deed should suffice. For stocks, a recent statement from their broker.

A recent professional appraisal is usually required to declare the value of a home, but I would think a tax assessment would be sufficient for declaring the value of land. It might also be helpful if they can obtain statement from a Title Company that the property is free of liens (i.e., they own it outright). I doubt a consular officer is going to want to look up the ticker symbol for each stock they own, so a statement from the broker stating the value of their portfolio on a given day should work. A bank statement will do for cash assets.

Check the regional forum or send an email to the consulate in Madrid and ask about their requirements for co-sponsors.

OK, its been a while now, we have the NOA2 and the new case # from the NVC. I have a couple more questions, I currently have 2 jobs, but on the 134 form there is only space for 1? do i fill out 2? my mom signed up on here and asked a question about their 134, and i think she is ok, but with my 2 jobs, it should show that i make more than enough to meet the poverty requirements, the problem comes that the past few years i have made nowhere near enough $$ to show support, thus i will continue to use the 134 support of my dad (he is the one that will fill out the 134)

another question, does she need to fill out a 134? i was reading

    http://www.visajourney.com/consulates/inde...&cty=Madrid

and it seems like the person that wrote it did.... as it talks about "copy of a letter I sent to the company who administer my income, directing them to send the money to my new bank in the US" does Maria need to submit a 134 as well?

  4. Here's my list:

    1) 2 days after NOA2, starting calling NVC: 603-334-0700 press 1 then 5.

    2) Once NVC has your case, they assign a new case #. Ask them what date they sent your file to the embassy & also for the NVC case #.

    3) Once you know the date NVC sent off the file, track it at DHL's website: http://track.dhl-usa.com/TrackByRef.asp?nav=TrackByRef For the reference code, enter EXP 10 JUL 2009A (adjust using dates just before the date NVC told you), with a shipping range of that day to a few days later (July 13 - July 14 worked for the example above). Look for shipments to your beneficiary's embassy.

    4) To find out if the embassy processed the packet, call the Dept of State before 5pm: 202-663-1225 press 1 then 0

    5) You can also call the DoS to find out your interview date once you believe the embassy has scheduled it.

i called the NVC today, and they said they sent out the file out on aug 6, but i went to the site you listed and tried to track it, but i always got a "No shipments found. Please revise criteria and resubmit." not sure why it is throwing this error, but i would guess the reference code? should i call them back and ask them for one?

  5. got this in my email this morning :)

    Current Status: Approval notice sent.

  6. We have been waiting a long time and still have not received our NOA2, but i want to be ready when we do get it. I have filled out the I 134 but i dont make quite enough money on the books right now, and do not have enough tax records to be able to do it with out a co-sponsor. My folks are willing to do it, they have money in the bank i think, a business, and a LOT of money in their land (~400acres) so it should not be a problem for them. They had just asked me if they get "added on" to my I134 or if they submit their own. If they do their own, how should they list their relationship to her? future daughter in law? family friend? what evidence will they need to submit in regards to their property assets? it is all paid for, so their is no mortgage documentation to submit. their financial assets? do stocks count? how do they show proof?

sorry for all the questions, i just want to be prepared for when these documents need to be sent off to the embassy in Madrid. We have been waiting so long, i would like to have everything ready so it can go as quickly as possible after we get the NOA2

    thanks!!

    bill

  7. I was trying to look up what the cover letter for the RFE should look like, i didnt find much.

i read about people using COLOR photocopies of the passport front/back.... all the photocopies i have made were on the standard photocopier in B/W... would this be a problem? And does there need to be anything special in the cover letter i put with this RFE?

    thanks

    bill

  8. yes i was wearing my glasses.... dont think it will be a problem.

im not sure if they need just one or if they need more than one. Here is a quote from the letter:

"Submit evidence to establish that WB is/was a citizen of the Unites States. Such evidence may be:

    A) BC from civil autority

    B ) passport 10 yr

    C) passport 5 yr under 18

    D)consular officer statement

    E)cert of naturalization

    F) FS 240 (proof of birth abroad)

  9. Well we were expecting them to request some signed 325's and letters of intent but they did not ask for these. Here is what they requested:

Apparently our 'passport style photos' were not correct so I am going to to to rite-aid or somewhere today to get some more passport photos and she is going to do the same.

I sent in some pages from the divorce papers i had from my past marriage, but apparently they were not what they are looking for. I am going to call the court and request 'a final (absolute) divorce degree' as all the papers from my divorce are back in NH and i am currently in FL so i will just request that these documents are faxed/mailed down here.

I sent in a copy of my birth certficate from the hospital where i was born, but that is not a civil document. I need one from a civil authority that shows birth in the US. It also lists i can use my passport, since i will not get it back can i just photocopy it? Do i need to photocopy all the pages in in, even if they are blank? Also they say i can submit a statement executed by a US consular officer certifying that i am a US citizen and the holder of a US passport, where do i find a consular officer?
