    Some indian lawyer told us that once I-130 is approved, then the approved K3 is not honored. I have hard time believing it. So I was looking for cases of people who actually used K3 visa to enter USA when their I-130 was already approved.

    Yours and many other people's recommendation about I-130 as fast as K3 is valid depending on your individual case. Ours is not a first marriage for both of us plus children also involved from prior marriage and current marriage. Those things take more scrutiny during post-I130 approval stage vs. post-K3 approval stage. So our real lawyer in US told us to go for K3 route. We did not do any legal paperwork to inform or clarify with Visa office that it is okay to come on K3 route. Any real people with personal experience going for K3 interview please tell us. Thanks

    Anyone has experience with case like me where both I-129F and I-130 are approved and WE STILL WANT TO PURSUE K3 route to get my wife here as soon as possible.

    Someone told me that they will reject us visa at the time of K3 interview.

    Someone told me that it is clearly my choice which route I want to use. FYI, when I130 got approved, we did not do any further action with NVC on that I130 route (eg. AOS, etc.) so our file for I130 is still sitting at NVC. NVC has only transferred our I129F/K3 file to India and set us for interview in next week.

    Please guide me ASAP if something could go wrong.

    Also, I have sent I-134 (Affidavit) instead of long form I-864. Is that an issue?

  3. We have interview coming up for K3 in 2 weeks. My wife was previously married - got divorced - married me. Her middle and last name was changed from X (maiden) to Y (1st marriage) to X (post-divorce) to Z (marriage to me). She held passport in the name of Y, X and finally current passport in the name Z.

    We did not notify or publish any name change in Gazette office. Is that a problem ? We assumed passport agencies are government offices so when we made new passports each time due to name change situation, they obviously know the fact and send this information to gazette as well. Not sure if they don't do that or do that. We want to know if we need to make a SELF-affidavit to capture the above fact that person X, Y, Z are all the same person.

    My wife also has a child from her 1st marriage who is now going to be my Stepchild. His passport was made after mom's divorce so he has middle name of mother and last name of mother's maiden-name (X). Do we need to make an affidavit that says he is child of mother X/Y/Z who is married to ME.

    Help us please.

  4. Congrats. Our I129F and I130 got approved in April 1st week. But we are waiting for NVC to send our packet on I129F (K3 visa) to India still today. Please let me know how long it takes in your case?

    Also, are you taking I129F route or I130 (CR1) route to get your spouse here?

    I was told it takes 5 months from I130 approval date to see your family here. So I129F is considered a faster route. Please let me know if you know something mroe about this.

  5. Try your senator's office.

    If he does not help, try Texas Senator - john Cornyn. He is on immigration subcommitee.

    If lawyer filed your case, you have option to go to AILA.

    Generally you don't want ALL people pushing your case. That can be BAD.

    Choose Senator over AILA if you have both options.

    Im so sorry that you guys are having to endure this long wait. That is truly heartbreaking.

    I agree that your USC spouse needs to contact his congressman and/or senator and ask for a formal inquiry. He can also ask USCIS for an expedite based on being WAY outside the processing times.

    I would write my congressman AND senator and ask them to make a formal inquiry along with an expedite request based on your timeline. They will need your case #'s, a brief description of the timeline and a privacy release form.

  6. Yes, phone inquiry on NVC.

    My K3 / I-129F is at NVC for further processing. They do NOT need any documents from us like they for I-130 case.

    Is your case K3 related?

    Anyone has lately experienced with new procedure, how long it takes NVC to prepare and send your packet to Mumbai consulate once they have your approved K3 from USCIS ? My K3 petition got approved on April 3 by USCIS-CA and they said they are sending our case to NVC for interview processing stuff. I got a letter from NVC on April 14th that they have received our info from USCIS and within 1 week they will send our packet to India for them to schedule interview of my spouse.

    Well, it's May 12 and NVC still tells us on phone inquiry that they are still processing our case and they have NOT sent it to India yet.

    The worst part is they tell us there is "additional processing" going on with the case and there is NO DETAILS about what that is plus there is NO TIMELINE ESTIMATE for it.

    Anyone has any idea how long it could take for NEW procedure at NVC to send K3 packet to India ?

    The interesting part is that our I-130 also got approved by USCIS at the same time in April. My lawyer tells me that it is LONG ROUTE to get my spouse on Consular Processing route since it will take another 5-months average to get my spouse to USA using I-130 route. He recommends we wait on K3 Packet and bring my spouse here on K3 visa and then do her adjustment of status. I am not in RUSH for greencard. I am in rush to get my spouse here ASAP. So, he thinks K3 is my best bet.

    Please guide me. My spouse is in Ahmedabad, Gujarat, India.

    Btw, I also have K4 child on my spouse's application. His I-130 is also approved like my spouse's I-130.

    Please guide me.

    When you say " phone inquiry ", are you talking to an operator?

    Is your I-130 application in NVC system yet? If so it should take about month or month and half (good avg) before you case can complete and interview can be assigned. Once you case is in NVC all depends on you on how fast you send them requested douments. Look in wiki for NVC guides.

    My case is like yours. We got NVC letter that within 1 week they will send packet to India. That was on April 14th. No packet has been sent yet.

    I keep calling NVC daily and they say case is under "additional processing".

    Do you really think I can call up India consulate based on that letter from NVC and schedule an interview ?

    That sounds difficult. Plus, they never pick up phones in Mumbai consulate.

    PLEASE GUIDE ON OUR OPTIONS.

    I AM A NEWBIE AND THIS IS MY FIRST POST.

    MY HUSBAND GOT A MAIL FROM NVC DATED APRIL 2,2009 THAT THEY GOT OUR PAPERS AND THEY ARE SENDING THE DOCUMENTS TO THE US EMBASSY IN MANILA WITHIN THE WEEK. I DON'T GET A LETTER OF APPOINTMENT YET AND WE DIDN'T MAKE ANY CALLS TO INQUIRE FROM THE NVC. WHAT IS THE USUAL TIME DIFFERENCE TO WAIT BETWEEN THE LETTER FROM NVC AND FOR THE US EMBASSY TO RECEIVE IT AND SEND THE APPOINTMENT LETTER TO ME? :innocent:

    Your husband could call NVC to check for the exact date that they sent your papers in Manila so you could track it in DHL website. Once the papers has been received in USEM, they will input it in their system which would take about a week or so.. During that time, you could call USEM from time to time if your case is already in their system and ready for appointment scheduling..

    PERHAPS :unsure: WE WILL GIVE THE EMBASSY UNTIL THE END OF THIS MONTH AND THEN IF WE STILL DON'T GET ANYTHING FROM THEM, WE WILL CALL. MY HUSBAND IS NOT PREPARED YET OF THE AOS ANYWAY. THANKS FOR THE REPLY CANDID WITCH. :thumbs:

    My K3 was approved on April 3 by USCIS. The letter was sent to NVC. But NVC has not sent our packet out to my spouse's home country.

    Can you tell me how long it took from K3 approval date by USCIS to get your packet first sent by NVC to Brazil ? When did you reply to Brazil consulate that you have "all documents" needed so they can schedule your interview date.
