    THANKS DAINANDVICKY.

MY INTERVIEW DATE IS NXT TWO WEEKS

  3. Hello, here i am again... got confused about my fiance's address....

When we filed the K-1 last march 2009, my fiance was doing volunteer work in Florida, so he wrote the Florida

address in the form I-129F. Last Dec 2009 he stop doing volunteer work and

went back home to Georgia, and was hired recently for a construction job.

My interview date is next two weeks.. If the consul will ask about my fiance's address what should

i tell him/her? the Florida address or Georgia ?

(Petition approved just last Dec 2009)

    Thanks for your reply..........

  4. The only thing I can guess is they have to have a copy of it for whatever reason - and we know how USCIS/DOS can be about losing things sometimes!

I guess I don't see taking one more piece of paper as a hardship. Plus you need one for AOS anyway so keep the copy and mail it in with the I 485.

    THANKS FOR YOUR REPLY....

    I DO APPRECIATE IT.

  5. hi! im about to print my application forms for k-1 visa for the embassy interview (ds-156, 156K, and 157 forms). is it ok if i type my answers in the fields then print it or should i (print the forms then) hand-write it? does it matter? i dont know whats the embassy's standard for this. hope i wont get denied because of this. thanks! God bless!

DS-156 SHOULD BE FILL-UP ONLINE AND HAVE IT PRINT,

WHILE DS-156K AND DS-157 PRINT IT AND FILL-UP HANDWRITTEN..

THAT'S WHAT SOME ARE DOING AND THEY GOT APPROVED.....

  6. Dear VJ Members,

My fiance and I are quite worried about our K1 petition filed last July 30, 2009. We received our NO1 last August 5, 2009 and until now we didn't hear anything from them. We are quite reading news and updates from a lot of VJ Members which have the same timeline with us about the progress of their respective K1 petition. Some got so lucky, they had the process so quite speedy which some of them had already their final approval of visa or others are just awaiting for Interviews, etc.

We in fact follow-up and called USCIS to check about our pending petition, my fiance even went there personally to check and all they can say is that "The K1 petition is on Review". We fully understand the process and all the patience needed but the long waiting, anticipation, long distance are killing us both.

Any thoughts why there are some petitioners got the process quick and some like us who are very unlucky to be placed in the bottom of the waiting list?

Good luck to everyone and we are happy for those who got a very speedy process. We are fully in your side, same as our longing to be with each other arms. We are keep praying that one day, our turn will come and we will got that approval.

    Thanks.

Hello, do you have a lawyer that would make follow up on your papers?

You just wait, it takes 5 months to process the K-1

We don't have a lawyer. We just did the process and filing by ourselves.

We know that it will take 5 months for the whole process, our just plain concern is that our case has not been move anywhere.

In fact, we are assuming and preparing ourselves that it will be indeed delay for the end of the this month will be the FIFTH MONTH since our filing of I-129F.

We apologize for the sentiments but we are just worried and wanted to hear some ideas if what makes it delay compare to other cases considering filing, or type of case maybe or process or what other factors that may affect the whole process and timeline.

We will be patiently waiting and will be waiting even it will take forever for being with each other means everything.

Thanks for the members who did take their valuable time to share there thoughts.

IF YOU THINK YOU SUBMITTED ALL THE DOCUMENTS , THEN NO NEED TO WORRY.

IN MY CASE, WE RECEIVED RFE AFTER 5 MONTHS OF WAITING, BUT WE COMPLIED ALL THE REQUIREMENTS.

AND RECEIVED DENIAL NOTICE BUT WE'RE GIVEN OPTIONS TO FILE AN APPEAL , IMMIGRATIONS SAYS DIVORCE PAPER WAS NOT SUBMITTED,

SO WE FILED AN APPEAL, PAID $585, SUBMIT THE DIVORCE PAPER. WE DONT HIRE A LAWYER, WE ASKED HELP FROM A CONGRESSMAN,

WHICH HE CALLED THE USCIS AND NOW WE RECEIVED NOTICE FROM IMMIGRATION THAT THEIR FINAL DECISION IS ON JANUARY 11,2010.

    IT'S REALLY A LONG WAIT.....

    HAVE FAITH IN GOD!!!!!!

  8. I have learned from a travel agent who process the US Visa of someone that I know that you will never tell the consul you have met your fiance on a "dating" site...because it is consider like a mail-order bride thing and that will raise a red flag on your case. Another thing, they are more suspicious to those who have relatives in the US or those that are being introduced by a relative or a common friend...because they thought you just made an arrangement or pay someone to get you to US. Maybe that's why the consul was being rough to you. Well, you are not denied and you still have the chance to be approved. So hang on there...you know your relationship is genuine, you told them the truth...God will bless you with a good news. I understand it will be hard to talk to your family and friends about this...but trust me, it helps a lot to have someone to be there with you at times like this. :) Dont give up sis!

hello, in my case, me and my fiance was introduced by my brother (Florida). Why would they act suspicious about that? yes, we were introduced but we fell in love....

  9. Hello, please i need help.... we filed Petition for Fiance last march, received NOA1 last August, accomplished all

the requirements last september sad to say we we're denied but we filed an appeal for reconsideration and submitted the

picture ID and divorce decree final (requested). It's been 6 weeks now, but no reply from the immigration .

We are worried so much!!!!!!!! Please i need your advice.....

Were you denied? Or you received an RFE? Was the divorce final BEFORE you filed the petition initially. Also you are very vague in your description. "Last March" when is this? Exactly. March 2009? march 2008? And what does "last September" mean? 2009? 2008? And what does "accomplished all the requirements" mean. It sounds to me like you did NOT accomplish all the requirements. I also do not belive you waited for 5 months to receive the NOA1. Do you mean the NOA2? Was the PETITION denied or was the visa denied? Did you have an interview?

And please state exactly the date the peition was filed and exactly the reason it was denied.

Yes the petition was denied but we were given option. yes the divorce was final before we filed the petition.

We filed the Petition last march 27, 2009. Received RFE last August. Submitted all the requirements first week of sept .

on the third week of september received notice of denial.

OK, I tried to read your timeline and it has not been updated. So you did not receive an NOA1 last August, you received an RFE. You did not satisfactorily respond to the RFE. So you have failed TWICE to submit the divorce decree? I mean you say that he submitted it with the peition, but you got an RFE for it. Maybe they lost it...once. So he responded to the RFE and sent it again. And what? They lost it again?

It would help us, now that we know what is going on, if you could give us the exact wording of the RFE and the exact wording of the denial.

And have you appealed the denial? Appeals can take many many months. If you are at that stage, it will be faster and cheaper to withdraw the petition and start over, OR have your fiancee come to the PIs and marry you, then file for a CR-1

If I were in this situation I would withdraw the petition & start over. When resubmitting I would ask for an expedite based on USCIS error (which is one of the valid choices listed by USCIS). Of course you would need proof that USCIS screwed the pooch by losing the RFE documents (e.g. a tracking receipt from the post office).

No need to withdraw a denied petition. It's already denied. Sounds like you replied to the RFE incorrectly, too late or both. Time to file again and get it right this time. You might consider professional assistance.

Understood it is denied, but she states in post 1 they have filed an appeal. Would they need to withdraw the appeal? Agreed, I used the worng term "petition"

We were denied but we're given an options to file an appeal for reconsideration and paid $585. So, that's what we did.....

  10. Incorrect ID Picture and they said we didnt submit the divorce decree of my fiance, which he did submit last september

    together with the requested documents.

Ah that makes a bit more sense. Although I'm sure they would have needed the divorce decree a lot sooner in the process. Maybe your pictures weren't recent enough?

I agree with Penguin - definitely call to check they have at least received your resubmitted documents.

I wonder why it wasn't turned around earlier on as an RFE?

We still do not know enough. Need exact dates, need to know if this is a petition or a visa. Who was the evidence submitted to. We don't know if it wasn't an RFE.

She said in the OP that they filed "last March" and no wsays he sent the divorce decree "last september" Please stop referring to dates as "last..." Please refer to exact months and years, it makes a BIG difference.

we only received 1 RFE just last august 2009
