  1. I have a friend from another state in the US and right now she is facing a great emotional and psychological turmoil... She sought for an advice but I really am tabula rasa when it comes to this...With her permission, I suggested if I can write in VJ and seek the expert's advice regarding her problem. I know there are other posts here with "almost" the same case but I want some more custom -made advice from sincere and knowledgeable people...experts as we call them ....My friend is married for 1 yr. and 7 months now with a 2 yr. conditional GC. She has to apply for removing condition by early next year. Now this is just an introduction and lets go to the highlighted event:

    1.) She and her hubby are not in good terms, I mean seriously, based on her explanation to me, the marriage is over and done.. With her status at the moment, CAN SHE FILE A DIVORCE or is ANNULMENT much better??? What will be the consequences either way??

    2.) She plans to stay in the US longer and continue working(she has a stable job) and obviously, wont go back to the her country just "yet". Can she still apply for the 10 yr. GC "alone" ???

    3.) if u have more helpful and sound advice for her case, pls. feel free to share. My friend is in dire need of your help. Your advice might save a life here...(yeah im serious about it friends)..

  2. No, this isn't how it works now with USCIS. This is a mistake.

    Both of your friends received the wrong date on their card when they entered. The law clearly states that any applicant receiving Permanent Resident status on a marriage to a US citizen that is less than 2 years old at the time of the issuance receives a conditional 2 year card. USCIS does not have the option to do anything but that - it is the law. So, if your friends have 10 year cards they are issued in error and they do need to correct the error. They are still required to apply for the I-751 Removal of Conditions within the 90 day period prior to the 2nd anniversary before they can get the proper 10 year card.

    A few years ago on VJ there was someone who received a 10 year card even though they had entered on a K-1 and had been married for less than 2 years at the time. They just thought they were 'lucky' - until they filed for Citizenship after 3 years. USCIS discovered their error at the time, denied the Citizenship because they were not eligible as they had not filed to remove conditions, and it was only with the intervention of an elected official that they were then allowed to file 'late' for the I-751. They were told that even though it was USCIS' error, they were responsible for making sure that it was correct - and bearing the consequences for it not being correct. It caused a lot of hard ache, fear, and anger for the couple who did eventually succeed in removing conditions and applying for citizenship.

    So - it is USCIS' error but your friends will bear the brunt of the problems that will result from that error unless they get it corrected.

  3. It's a mistake and she MUST report it. She needs to file an I-90 to correct the error (free because it's their mistake). She has only been married for less than 2 years and isn't eligible for the 10 year card. If she doesn't report it she could end up having her residency revoked when she doesn't file ROC.

    Sorry. it's a mistake and she now needs to fix their mistake. it's also likely they'll return her application because she has the 10 year card and she'll have a fight to prove she isn't eligible. Even though that sounds unfair she'll be the one that pays for their mistake by having her LPR revoked.

    Hi. I informed my friend about reporting it and which she agreed to do..However, she did mention to me that one of her friends was also granted a 10-yr GC..both of them have sons whom USCIS granted a 2-yr GC...so i guess that's how it works now with USCIS... :wacko:

  4. How long had she been married at the time her AOS was approved? The 2 year conditional is dependent on the length of time married. Some people delay their AOS for a while, meaning by the time their AOS is processed, they've been married 2 years.

    She is married less than a yr and applied for AOS 3 months ago..and she told me that the GC says something about W46 which means she was granted an LPR status meaning Late Amnesty Applicant under Immigration Reform Act..yes she did her AOS after a yr. of her marriage coz the husband needed the W2/Tax papers of his sister as co-sponsor..he doesnt make a lot from his work and this was the reason of the delay...at any rate, im happy for my friend at least she doesnt have to undergo the same AOS process again, if this means a real 10 yr GC....

  5. Hi. I would like to ask if USCIS now issues a 10-yr. greencard without getting first the 2-yr. GC???Ive a friend who just received her GC valid for 10 yrs (2021) although what she applied for was the 2-yr GC..Is this a mistake ?misprint? or a new policy? If this is so, I guess she's very lucky not to apply for removing of condition...saves money and time

  6. Hi friends. I really need your help :help: especially those who been through this experience when they left for the Philippines.

    This is my first time to go back to the Philippines. With this being Christmas, I'm wondering what kind of restrictions, if any, I have for bringing things back in my luggage...For example, I am planning on 8 boxes of chocolate candies and most are cosmetics and fragrances(more than 100small pieces of them)for friends and family and a watch but no electronics. These will be all in 1 big luggage for check-in. Are we allowed to do it, for as long as we pay the baggage fee??

    Nothing is for sale there..These are all gifts so I dont think I need to declare any value too, right?..

  7. Hi there...about ur NOA2, its too early for u to stay worried about it..mine took 3 months after NOA1..pls. be patient...u can see my time line

    with regards to her dental work---i will suggest to have it fixed in the Phils..although facility wise, they may not have the best there, esp. if she is living in the province like me but better than letting her suffer from tooth decay ...i had all my bad teeth filled and cleaned before coming to the States (reason: i knew it was costly in the US and not for any other reasons)..if the amount she asked for her dental work is Ph 1,200, then its so cheap and reasonable..

    Just for clarification---My husband purchased a round-trip airline tickets to the Phils. and used my married name although my passport still bears my maiden name.It will expire in 2012 yet. I was told by some friends that its fine for as long as I have my GC and Marriage Certificate for perusal at the Immigration and/or check in counter, and maybe i can also include my State ID(since Ive no DL yet). I hope it wont be a hassle.

    Another question is--legally, for how long can someone like me, holding a 2-yr GC, travel to the Phils??

    Is there a restriction as to how long can I stay there so I will not be denied entry coming back to the US? this is, by the way, my first visit to the Phils since I came to the States.

    I'll appreciate whatever information and input u can share with this regard.

  9. hi everyone..i post the same topic in the Philippine Forum of VJ but i want to get more information from everyone who knows ....im a GC holder and my hubby and I wish to let my parents in the Phils. come here to the States as tourists since im not a US citizen yet to sponsor them..my question is will they need a complete medical at St. Lukes? or are they exempted?

  10. hi there...yes we are contemplating on visiting that marvelous and famous scenic spot...we might just take the car for a 10-12 hour drive because we are located in Wisconsin...its a sure long trip..but now i know i dont need a tourist visa since i got my GC...thanks everyone for ur time to reply to this post..its a great help...

  11. hi there...she is now married to u so she can already use her new name for her AOS application..its fine if it doesn't match her passport and visa..its understood that her passport/visa will show her maiden name especially so she came to the US under K-1 visa..just make sure u won't forget to include a certified true copy of your Marriage Certificate in ur AOS packet..

  12. hi everyone. i received today my 2-yr GC and im just curious and wants to start researching on how to obtain a tourist visa for my parents in the Philippines to visit us here even for 3 months. I want to know the requirements which the USCIS / US Embassy will ask from them, the time table when applying for one..etc..will there be interview and medical on their part as well as showing proof of ties like house and lot assets???

    Can anyone send me a link similar to my query and / or similar posts??reply will be highly appreciated

    @ LaneandDaisy ---> you can find the 100 questions from the USCIS site as what Tick Tock have shared. In my case, they (USCIS-Sacramento) gave me a book reviewer with CD when I had my biometrics. You can apply for citizenship (if based on marriage): add 3 years (less 90 days) from the date of your green card.

    USCIS Online Card Production Notice -- May 13 and touched May 15

    Welcome Notice in Mail -- May 17

    The letter however says wait for 30days..so im expecting may be ill get my GC somewhere around June 12-17...if beyond that period, we can call their hotline...

    btw, aren't they issuing a new GC now??? maybe we are affected by its mass production ( :whistle: ) but nevertheless lets wait till its our 30th day from date of welcome notice received...
