  1. I have not received my request for evidence for my K-1 Visa 129F package I sent in 5 months ago. They said they sent the request for evidence on Aug. 19, 2010, but I have not received anything. There is also an expiration date for this RFE, but they won't tell me when it is when I write or call them. It will be dismissed after all of our hard work getting the package together if we do not receive the RFE soon I bet. We also paid the $455.00 as well. Then we will have to go the K-3 route I think. Does anyone know how long it takes to receive the RFE and when the expiration date might be? The customer support phone line isn't helpful, yet they are rather rude and every time I write the Vermont Service Center, they don't answer my freaking questions!

  2. THIS IS BY MY FIANCE ON THE SAME FORUM: WHAT DO YOU THINK ABOUT THIS?

My fiancee and I (she is the petitioner) filed for a K-1 in April. They received the documents on April 20, so tomorrow it will have been 3 months since we embarked on this journey. Our main issue is that the only source of income for her is SSDI. Hence, there is no way for her to prove that she has enough income to ensure I will not become a burden to the state. Neither her mother or her sister are willing to sponsor us at this point so we are in a bit of a bind. I do have $28k in the bank, as well as a duplex in Florida which I own outright and of which the downstairs unit is currently occupied by a renter (as of July 1, with a 1 year lease). The rent at this point in time is only $550, and what ends up in my bank account is only about $400 every month. The upstairs unit will not be ready for rent until February of next year.

Because it seems pointless to wait another few months, only to have our application turned down due to the lack of a sponsor, we have been wondering whether or not we should void it and go for a K-3 or other visa instead. We want to get married and continue our life together in the U.S. It is that simple. I do not know if there are any other options besides the K-3 (perhaps there are lawyer firms or other establishments that would sponsor people in return for collateral and a certain fee?). It would certainly be preferable to continue on our current course so we may be together sooner rather than later. My fiancee and I would love to hear your thoughts on this matter.

  3. I don't want to marry this guy. I can't trust him. I think he is using me. I already sent in all of the K-1 Visa package. I'm not sure, but I don't think it was approved yet. What if he is using me? We have been through hell lately. Manipulation and deceitfulness are included. He has been using vulnerable women in various countries to go and visit. I think he may have a mental problem. Can I cancel the K-1 Visa if it isn't approved yet?

  4. If the sponsor doesn't have enough income, they can usually make up any shortfall with assets, like cash in the bank. The value of the assets has to be at least 3X the shortage in income if the sponsor is married to the beneficiary. Otherwise, the value of the assets has to be at least 5X the shortage in income. Consulates usually apply the 3X rule for a US citizen petitioner sponsoring their fiance, since this is the rule that will be applied when they ultimately get married and apply for a green card.

Are you saying it is okay for him to add cash into my account or not? I do not have the cash or assets for my account. I only make around $900.00 a month, so he will have to help me somehow. There are no co-sponsors. I already tried that. I guess he will try to self-sponsor. I don't know why they make this so hard. He also has a deed in his name in the U.S for a house he owns..which is for 118,000 dollars. I hope he can self sponsor if he cant deposit cash into my account.

  5. Hello.. I was wondering if it is okay to deposit money into my account before the 134 is filled out(5 months before hand)? My fiance said it would be fraud if he deposited a lot of money into my account in the U.S. Some people told him it would be "fraud". I don't understand this at all. Should we have a joint account then? He is confusing me about how much money we need too. Do we need the 125% poverty guideline minimum amount or do we need more than the minimum amount(like three times as much)?? Please see if you can answer my two questions. Thank you
