If your spouse intends to work, vote , go to school here in the US or bring more relatives here, then yes filing right away makes sense cause you want all those dates to start as early as possible, but if your spouse has no intention of working or going to school for a few years then waiting is an option, i agree that changes in the fees/laws could play a role but its not like those are passed over night, much warning is given and so filing before those laws/fees took affect would be very easy.

    Bottom line is know your rights and use them to the fullest, be a wolf not a sheep!

Why argue abuot these fool politicians, unless of course you think one or the other being in office is gonna get our family members legally into this country faster, which it wont so keep on supporting goverment with your debates and voting procedures, it wont change a thing....6000 years of written history is backing me up!

Yes my wife and I just had and RFE cause of this, and when i called my civil surgeon they said its wide spread they are getting more and more call for this, seems the goverment didnt grandfather anyone in who had already applied for AOS before the rule change happened, so we have to go down and get the TST test, this is the 3rd RFE we have recieved for various reasons so im not worried bout these things anymore i just do what they tell me.

Yes i have also recieved 2 RFE's after the BIometrics appointment, always possible. mine were for tax forms even know i sent them already, so had to go through IRS to get more and sent them back all was well then they said i didnt make enough to sponsor my wife (wrong!) but whatever, so i got a another sponsor and we are still waiting almost a year from when i sent in the packet, just have to be patient with our goverment.

  5. My brother-in-law who is a US citizen wishes to petition his girlfriend & their 1-year old child. He wants to go for the K1 route.. Now my question here is what about their child?

    As far as their child is concerned your brother is allowed to petition for all of her children under 18 or maybe 21 even if not by him ( your brother ) it is as simple as an extra form with the childs info, but also they will need passport, birth cert., etc for the child also.

    I have heard something about a semminar that is required for Filipinas prior to them being given their K-3 visa, is this true, please explain.

    It is a seminar required but not for them to get their k visa, but after u get the visa it is a stamp added to the passport, allowing the filipino to go abroad, without it there can be problems leaving or so i have heard.

    the Seminar is CFO seminar, and must be attended in manila and cebu i believe.

My fiance is from the philippines and entered the usa april 6th but when she entered the airport she filled out her I-94 wrong and the dumb man at the POE didnt catch it so now she is registered as the wrong name, atleast as far as the social security department goes.....i dont know what information matters, we got a social security card but it is the wrong name, will that affect us getting marriage lisence? or down the road.... any advice or experiences welcome , thanks in advance.

  8. One thing specific about the Philippines process is the long wait from the time the Embassy in Manila recieves your petition until u are assigned a interview date between 4 - 6 months. Philippines medical exams must be done at St. Luke medical center and its in Manila, so if your from the province travel can be an issue, since the medical exam is before the interview usually by 1 week, so its stay in manila hotel for a week or pay airfare or travel expenses to and from twice.

  9. KTMguy, yes they embassy would have asked for further documents at the interview if required. U should ask your fiance' if she recieved a white paper with her pink paper to pay the Delbros Fee, the white paper would have a check mark in the "wait until u hear from us" box, or more boxes will be checked if u are on AR. I also payed the delivery fee and we werent asked for additional docs. but we did recieve that white paper and were on AR for only 3 weeks thank goodness, but yes i would call the embassy and inquire....my opinion is your on AR but its just a simple review shouldnt take much longer.

  10. Hello jsar13, I believe once the NVC process your case and they send u the letter your case is on the way to manila, that is the last time they do any with the medical or appointment making. I could be wrong but i believe the Manila, Philippines embassy is the one to schedule the medical and interview since they are the ones sending out the packet to the foriegn fiance.

Yes u will be informed of your medical and interview date from your packet the embassy sends ( usually about 6 weeks before interview date). u can also check the embassy website in manila, or u can call either the USA or manila embassy about the date , but they wont know until about 8 weeks before interview or about 4 months after Manila has recieved from NVC.

  12. hello Rick2000, I also had a problem like yours, with my filipina fiance's birth cert having an error i was also told it can take alot of time and expense to change this. It is true! u will need a lawyer and a court/ goverment appearance is necessary. But be careful about choosing a lawyer in the philippines for this, i suggest having your fiance get this fixed on her own and without telling the lawyer why the birth cert is needed or that she has a foreigner fiancee. If not u could be showing them $ signs. But before doing this i would call the embassy in Manila and ask what they think about your situation, telling them your passport, i.d., and such is all correct, just the birth cert is wrong. They might have an easier solution to your problem.

Kyd, she will not be asked to show a copy of petition or documents, but it is a good idea to send a copy incase more documents are required (or lost ) by the embassy at some point in the process then she will already have them there in philippines, saving time of u sending them to her then her sending them to Manila. But u will be sending her the Originals of some documents at some point unless u yourself are attending the interview with her in Manila. Atleast make the copy of the petition and certain documents then keep for yourself and if u need send something they request or lose u have it.

Hello Rusty ash, My suggestion would be to book your flight with open return(no xtra cost), then after visa is in hand , call the airline/ travel agent and have them book your return flight with a second one way ticket of the same intinerary. Depending on what airlines this is very possible, but beware sometimes it can be a week or 10 days before a flight is available for your open return date, depends on season.

Hello Jorel&meme, Now u will begin waiting for the letter from the NVC telling u they have finished processing your case and send it to Manila embassy in philippines, this will take 2 - 4 weeks. After u recieve letter from NVC i would begin using this site and other venues to help u prepare what documents might be needed for interview, but right now Manila is taking about 6 months for interview dates from time u recieve letter from NVC, so take that into account.
