  1. So here's my situation.

    My cousin just got married and both reside in the US. His wife is the US Citizen and she's petitioning to for him. He's never had a work permit, but was able to obtain a SSN and somehow work and pay taxes. Him and his wife, who is pregnant, will be filing for I-130 soon, will this be an issue? Since I know the immigration looks at everything.

    I'm not sure what to advise them on this situation.

  2. Now I went to my interview fully expecting an RFE for expired medical but much to my surprise I didn't get one. At the time I submitted my AoS application my medical was over a year old (by 5 days) but I went and had the documents transcribed onto the i693 about 3 weeks prior, signed and sealed. I did not get a RFE or any questions. I could have just been extremely fortunate though :)Up to you whether or not you want to gamble like I did.

    Ok, so here's my situation:

    What I have with me is a copy of his medical examinations he needed for the Fiance Visa. If I wanted to take the chance, could I submit that? I'm sort of confused by everyone saying "documents transcribed onto the I-693" ... I feel like I wouldn't be able to do that because the doctor that helped in the beginning lives back in our country. :(

    IF doing a whole NEW medical is much more logical, as stated in the previous post, is it expensive? :huh:

    I apologize if this question was already asked. We were married last year on May 9, 2010. Due to the recession and just waiting to have enough money, we are finally able to do the next step (AOS) this week. :(

    My concern is that of the medical examinations. The doctor that my husband went to gave him a copy of it and as of right now, it is still sealed up & un-opened. HOWEVER, the medical examinations are now expired because he had them done earlier this month of last year.

    So does this mean we would have to see a Civil Surgeon to get another examination done? Or should I just take the chance and turn in our unopened copy?

    Please advise.

  4. i got here in US Feb 28,2008 and married April 5,2008 and we file for AOS January 17,2009, Biometrics Feb 12,2009 , received my working permit march 15,2009 and got my green card March 30,2009 and everything went smooth. so relax everything will be fine :)

    Ok, I'm going to relax. Also, I noticed that with the AOS process, it's $1,000 dollars and more? Is this true? I'm not complaining, but just want to make sure.

  5. Hello VJ Family!

    Ok, here's my dilemma... we went through the whole fiance visa process and all went well. We just married on May 9th of this year. I am still currently waiting for our copy of the marriage certificate. My only concern is that on his I-94, it says June 23rd, in meaning that when we both entered the U.S., we should be married by then, in which we did. However, I fear that we will get our copy of the marriage license too late before I am able to finally file my fiance's AOS. Will he be out of status?

    Also, the visa itself, in his passport, has a seperate date that doesn't expire until September.

    I'm not sure what to do anymore. PLEASE ADVISE! :(

  6. Hello VJ family!

    We have our interview next week on March 17th in Suva, Fiji. My fiance has yet to recieve his K1 visa packet. HOWEVER, upon recieving approval from on my side (USA), a week later I emailed the embassy in Fiji and asked if they have recieved our package and if we should set an appointment.

    This is what they emailed me:

    Dear Madam

    Thank you for your e-mail. Your fiance’s approved form I-129F has been received at this office. His interview date has been scheduled for Wednesday, March 17th, 2010. 8.00am. This office will also send Mr. Isamau the original interview letter at the address provided in the case file. P. O. Box 44, Tonga.

    Please also note under the U.S. Privacy Act laws, this office cannot respond to inquiries relating to individual cases in the public domain, in this instant, Face Book. Visa/Consular-related inquiries regarding individual applicants/cases should be directed to consularsuva@state.gov

    I trust that this information will be useful to you. Thank you.

    They also attached his checklist and medical information for the exam. HOWEVER, up to this day, my fiance still DID NOT recieve his package or orginial interview letter.

    So this is what I'm going to do...

    I will, of course, take this email I recieved from them and also take my letter they sent to me with interview date and barcode.

    Wouldn't that be sufficient enough?! Any other advice? I'm leaving this Sunday... so please please.... WISH ME LUCK!

    As you can see below, I received NOA2 on January 26th, 2010. :dance: Do I call the NVC to verify if they've received it? Should I also set-up an appointment for my fiance's interview at US Embassy near him (Fiji)?

    I don't know if I'm over-analyzing the instructions on the NOA2 (which I probably am), but just wanted to see what my VJ family's suggestions/advisement would be on this specific issue?

    My fiance has already started on his packet and is about to complete the final item on his checklist.

    Just really nervous about this specific step and not sure what I should do.

  8. You applied 2 months ago, you are within normal processing times. That is what you will hear. I'm sorry but the waiting is the toughest part. InfoPass, in my opinion, is not for people just looking for a status update. Besides, since you never made an initial inquiry, you won't have the service ID number which you are requested to bring to the apt.

    We waited 178 days between NOA-1 and NOA-2 so I know how difficult it is to wait. But unless you fall outside their processing goals, very little can be done for you and, in my opinion, is not worth an InfoPass apt.

    Ok, so it's confirmed, I guess I am overly anxious and a bit impatient. :blush: LOL! At least I know how to make an appointment with InfoPass.

    The waiting is so hard, but I know God always provides.

    Is there anything I can while waiting?!

  9. I know you can talk to customer service about it, or if you need someone who can see more, schedule in Infopass appointment.

    For example, at the Infopass appointment I had on Monday, the lady was able to tell what date the biometrics results were posted to my husband's cases. They couldn't see that at the customer service desk. They just read the exact same status found on the website.

    So I just made an infopass appointment for January 14th, 2010. They offer 4 kinds of appointments for a case that you have already filed. I chose the following option:

    Case Services follow-up appointment - If it has been over 45 days since you contacted NCSC and have not received a response to your inquiry. You must bring the Service Request ID Number related to your inquiry to the appointment.

    However, I never made an initial inquiry? Does that matter? I'm just wondering what is the current status on my case? Would that be enough reason to see someone? Will I be ok to go in with the copy of my 129F packet that I sent in?

    I'm probably just anxious to hear about my case. However, in a couple other posts I've noticed that some petitioners are able to actually talk to a INS representative regarding their case. Is this possible? If so, is there a number I can call? Or a website I go to for this specific number?

  11. Congratulations on getting this far—but don't get too excited just yet. USCIS considers the target processing time for I-129F petitions to be 5 months. While it often doesn't take that long, it's not considered to be "overdue" until 5 months have passed.

    What you can do now: view the cashed check on your bank's website when the image becomes available, and find the number that starts with WAC. It's usually on the back of the check, but recently some have been printed on the front. This is your I-129F receipt number. You can use it to check your case status on the USCIS website and register for email/SMS status updates.

    Another great thing to do: :time: - http://www.visajourney.com/timeline/intro.php - This will allow you to get estimates from VJ on the actual processing time to expect based on other users' timelines, and will in turn help VJ to give more accurate estimates to you and everyone else.

    I am turning in my packet tomorrow and ####### as it sounds, just wanted my VJ family's opinion about the proof I'm sending in. My mobile carrier (Metro PCS) will not be able to send me a copy of my phone log until 2 weeks. I've wait too long to send the fiance visa in. Also, I was only able to call to my country through phone cards, it would have been waaay too expensive to do it direct.

    My question is:

    Does it matter if I have a phone log?

    Below is the proof I'm sending in...

    Documents supporting our ongoing relationship:

    - Copies of passport and all entry/leave stamps that show I visited Tonga

    - Letters from beneficiary & translations

    - Emails from beneficiary & translations

    - Pictures of my visits to see him & engagement

    - Used phone cards

    - Itineraries of traveling to Tonga

    - Invoice of recent trip to Tonga (June 2009)

    - Letter from supervisor

    - Letter from petitioner’s biological sister

    - Letter from beneficiary’s biological sister

    - Detailed Invoice wedding venue

    Please advise.

  13. I am Tongan and my fiance lives in Tonga. I'm currently putting my fiance visa package together. So I’m translating my fiance's emails/letters. I notice that it’s mandatory to translate all foreign documents, however my questions is… since we do not have an actual “official Tongan translator” in America, would I be sufficient enough to translate this emails and letters?

    Also, is the statement that I have to put after each of my translations?:

    Certification by Translator:

    I (typed name) , certify that I am fluent (conversant) in the English and (type the foreign language) languages, and that the above/attached document is an accurate translation of the document attached entitled (name of document).

    Signature ______________________ Typed Name _________________

    Date ___________ Address _____________________

    I hope this makes sense. I'd appreciate any assistance with this.

  14. Quick question: At the beginning, you mentioned that they need to send in their birth ceritificate with the petition. Is this the original birth certificate of the petitioner or beneficiary?

    doesn't really need to be the actual origianl, but a certified copy, and this is for the petitioner, beneficiary birth certificate is needed at a later stage.

    I guess in my case, being that I am the petitioner, I was not born here. However, I did officially become a US citizen last month. So a birth certificate would not be valid, but a certified copy of my naturalization certificate would do?

    Sort of lost... sorry if I'm slow. :wacko:
