  1. I was just wondering, it seems like the vast majority of K1 and K3 visa get approved once they get to the embassy interview stage, based upon the number of posts that come back saying they were denied?

The Department of State doesn't break it down that way, but you can get a rough idea from the total number of visas issued compared to the total number of ineligibilities. These statistics come from the following tables for 2008:

    Immigrant and non-immigrant visas issued

    Immigrant and non-immigrant ineligibilities

There were a total of 470,088 immigrant visas issued. There were a total of 291,792 applications where an initial finding of ineligibility was entered, and a total of 184,457 applications where the ineligibility was eventually overcome, leaving 107,335 applications that remained ineligible and did not receive a visa. If we combine the two numbers (visas issued plus remaining ineligibilities), we get 577,423 total applications, of which about 81% were eventually approved. The initial denial rate is about 51%.

There were a total of 6,603,073 non-immigrant visas issued. There were a total of 2,083,726 applications where an initial finding of ineligibility was entered, and a total of 538,129 applications where the ineligibility was eventually overcome, leaving 1,545,597 applications that remained ineligible and did not receive a visa. If we combine the two numbers (visas issued plus remaining ineligibilities), we get 8,148,670 total applications, of which about 81% were eventually approved. The initial denial rate is about 26%.

Bear in mind that these numbers vary radically from one consulate to another. Anecdotal evidence collected from attorneys show some consulates have a denial rate well above 50% for fiance(e) and spousal visas, but even these numbers vary from one attorney to another (might say something about the quality of the attorney... who knows?...).

So this refers to rejected at the nvc, usis level or at consulate? it was my impresion that once it gets to consulate they cant " deny the application" only make recomendations?

  2. well I called the Barbados embassy and I was told all july appt are full and I should call back july 13th and they will see if I can get an appt in AUG!!!. Why cant I just get my Aug appt now????

This is frustration beyond description, I have been married for 17 years I had a green card and was living in the states when we got married, both my parents are US citizens. I never thought it would be so difficult to get my visa.

  3. I will try again but they have refused to email so far.

well I am totally frustrated I still havent recieved the package over three weeks. Embassy claims they have sent it twice I am at a loss......

I asked if I could schedual and interview they said not until I recieve the package.

    should I call the NVC?

    Jon

email or call and ask them if they can email the packet to you...some consulates will do it. I woudl just explain that they have sent it twice and there is obviously some sort of problem and you would appreciate them emailing it to you ;)

Also, this is super obvious, but did you verify that they had the correct address?

    Good luck!

Thanks everyone for your good wishes  . We're really excited of course, getting ready for the interview. Thanti has printed out our entire Skype chat log for the past year - well over 1,000 pages. I told her she was nuts to do that, but I guess that's her way of dealing with the wait and the tension. We're hoping that if all goes well at interview she will come to the US in early July. On a related note I am planning to go to Brazil to see the kids in late July for a week.

Todd - That's great news! Glad that the interview went so easily. I'm sure you've shared your experience with your fellow VietNam VJ members right? They will definitely benefit from your experience. Good luck with everything as you and Hien start your new life together.

  5. congrats,

Its been a week and the Barbados Embassy still hasnt recieved my packet from NVC :(

and NVC cant give me a DHL tracking #

NVC will not give anyone tracking numbers, however you can estimate your tracking by using the date NVC says your package was shipped:

    e.g.:

    go to:

    http://track.dhl-usa.com/TrackByRef.asp?nav=TrackRef

enter in the following for the reference number and check the dates scope for the correct window of time.

    EXP 30 APR 2009A

this will return a good number of packages that left the NVC - play around with the date in the reference string = EXP DD MMM 2009A

you may also want to try changing 2009A to 2009B, C etc.. I'm not sure what that denotes.

    Hope this helps.

this is wicked got it, arrived at the embassy thursday hopefully they will open it tommorow!!!!

  6. he guys was your 36 days in NVC including weekends or just workdays?

I'd also advise you to try to contact the USEM in Bangkok, if anything, to make yourself feel better about it. It was probably really easy for us to do so, though, because it seems that here in Croatia people don't really apply for anything but tourist, student or work visas. For any even remotely immigrant related things, there's pretty much no waiting and, when you call them, they know you by your name.

Either way, good luck! I hope you'll get your interview date soon!

Steve and Grace, I'm afraid your congressman, or anyone else for that matter, won't be able to do anything at this level. You'll just have to wait it out.

    Good luck!

Thanks Badgerella. We of course have been emailing the BKK embassy regularly. They only respond to emails, not calls. Their IV Unit handles a much larger volume of casework than does the Croatian embassy, obviously. My fiancee is active on a immigration related website similar to VJ, but in the Thai language for people in Thailand who are navigating the process. According to the buzz on that side the embassy seems to have just stopped issuing interview appointments. Nobody has received an appointment for the past 4 weeks or so. So there's really not much more to do but wait.

Steve & Grace - as Badgerella says - most likely you'll just need to wait. At least the NVC times seem to have come down a bit, so there's a good chance your wait won't be too much longer.

GRRRRRRRRRRRRRRRRRRR......I am so sorry after all of this, that they are not issuing dates. I swear, I am never going through this process again. All the blooming stress has white hairs cropping up all over my head. I'm only 26!!!

Good luck Ron. I hope BKK pulls its finger out soon.
