  1. based on your situation, you can file for adjustment of status. which you will eventually be interviewed and asked about entering the US on a visitors visa and getting married. There is the risk of denial based upon that (coming to the U.S. and getting married is usually a K1 visa). Be prepared to justify your situation with USCIS. OR you can file a k3 visa or CR1 (I130). and return to Canada and wait for approval (which usually takes 6 months),which is also the proper way. the good thing is this is much less riskier. The bad thing is that you will spend time apart with your husband. unless he temporaraly moves to canada with you without giving up his US residency and wait for the K3 or CR1.

    As for the laywer fees, you can totally do it yourself with alot of good links and guidance here on VJ and other websites. If you are still worried about mistakes, some attorneys and agencies charge a minimal fee to check the completness and accuacy of your package to submit before you submit it yourself. or you can schedule an appointment with your local USCIS office and ask them about your paperwork.

    Whatever you do, just do not overstay your visa. File before it expires or return to Canada.

    I understand the pain of leaving your SO to wait for a visa. I fly up to Victoria BC every month just for a few days to be with my wife while we wait for our approval. Its sad everytime i have to leave her and its putting a huge dent in my wallet.

  2. I used to work for phillippine airlines, PAL (plane always late). in los angeles. There are people who carry on all sorts of stuff that are ok. chocalate is ok. vitamins are ok. as long as it is not fresh fruit or vegetables, its ok. one of the favorites that people bring home to the philippines are Krispy kreme donuts. dozens and dozens of them. Other airlines ship suitcases, philippine airlines deals with huge boxes after boxes. haha.

  3. After applying for the CR1 first, (petition I 130). You can then apply for the k3 (I 129f). Use your NOA1 from the CR1 and send in the K3 petition to the service center where the cr1 is pending. The K3 has no other fees if you applied for the cr1. USCIS will automatically waive the K3 fees.

    go for the CR1 if they approve both at the same time. saves alot of money down the road when thinking about adjusting status with K3.

  4. hello everyone, i'm new to this site :) so please forgive me if the answer to this question is found elsewhere. :innocent:

    my husband is a polish citizen but he's a resident in the UK. he'll be working in the UK through the whole K-3 application process. will he be processed faster if we say on the I-129F that he chooses to apply for a visa at the american embassy in london? or will it be faster in warsaw?

    is it even possible for him to select london? will there be any tricky details that we should be aware, if we choose london? :wacko:

    The K3 visa can only be processed in the country where the marriage took place. If the marriage took place in the U.S. then it will be processed in the beneficiery's (your husbands) country of citizenship.

  5. yes, definitely hire an attorney. Candle for Love is a great place for this discussion. One member there posted a thread linking a consular officer talking about K1/K3 Cr1 on a immigration website and it states that once returned to USCIS, the cases usually gets lost in a black whole and never touched again. Get active while the case is still in Guangzhou.

    luckily, I never threw away any of my boarding passes from my flights to visit my wife every month. And my phone bills are just horribly high but does prove that we talk every day for hours. I have many affidavits from family and friends and over 2000 photos from trips we took to Shanghai, Beijing, Tokyo, Osaka, Nanaimo, and Vancouver. Hope thats enough proof.

  7. Generally speaking, previous denials for other types of visas are overlooked, when and if a bonafide marriage can be proven at a K3 interview.

    What is her citizenship? What is her status in Canada at the moment?

    Shes a Chinese Citizen on a student Visa studying at University Of Victoria. Ooo, those international student tuitions are sooo high. We got married on the beach near Victoria in the winter, it was freezing cold. haha

    She applied for a student visa during the summer of 2007(june-aug). She got denied 9 times (within 2 months). everytime they gave her the same slip explaining she needs more information establishing a strong tie to her home country and she was welcomed to apply again. we tried so hard by extending the start date of her school. (California State University) We eventually gave up and luckily she was accepted to University Of Victoria, in canada as well. now we are older and felt we were comfortable with marriage, we got married in Canada. I am flying there every 3 weeks to stay just a few days, the airport is almost my second home and have started the K3 process. but we are worried of the past denial records.

    I was wondering if my wife's previous multiple denials for a student visa to the United States will affect her K3 visa application. She was denied multiple times at the Beijing Embassy. We both decided we were too young to marry at that time (2 years ago). and i did not finish my college degree. we only wanted to go to the same University together while we date. Now we are married and she is a college student in canada and i will graduate next month. So we decided to get married. However im afraid of her previous attempts at a visa and denials will result in the CO grilling her. any thoughts? thanks
