I'm sponsoring my brother and his wife from Bangladesh. After a long wait his Serial number finally happen and I received email to pay Affidavit and visa fee. Now I'm filling up I-864 form. I need a little more clarification about the I-864 question..

Question 1) Me and my wife file joint tax return and my earning is more then triple the poverty limit. If I send my tax transcript for 2024, how would they know what is my earning is because Tax transcript have total income not individual (given I don't need a co sponsor).  

Question 2) What other documents I should include with the I-864 form.

i forgot to ask if you are USC? If not you would not be able to file for your sister (assuming you are!)

one thing she will need is proof they are "married"... do they file taxes together? do they list each other as spouses on health insurance and for how many years do they have proof of that?

some countries even have 'certificates' of common law marriage.

also, this is something i saw in researching for you... if the children are the man's and not your sister's (which would make them her step children, but that didnt sound like the case but i want to cover all bases), that would be an issue becasue even though a common law "spouse" could be eligible, step children in a common law marriage might NOT.

nab-- Thanks for the quick reply. Yes I am USC and the children are theirs. About the health insurance and tax file-- I am not sure. I will ask them today. And also I will ask them if they have some kind of certificate or anything that says they common law.

Hello everyone,

I have a question related to common law (living together, 2 kids but not married yet). I like to apply for my sister as an immigrant. Currently she is living in Canada, have 2 kids (4, 6)and living with her boyfriend as common law for last 10 years. Is US immigration law accept common law (as spouse)or she has to get married and then I should apply for them. As I was filling up the I-130 form ( q.6 has only 4 option a)married b)single c)widowed d)Divorced), does not have any option for common law.

Please advice.

my mother arrived in NYC on July 7th CR-5 visa, till now we haven't received any welcome letter or the actual green card yet. Can anyone give us any idea how soon she will get the card.

Applied for both of my parents December 2009. Received NOA1 in 10 days but after that nothing is happening. Any idea how long it's going to take. My USCIS office is California. According to their estimates it is five months. But I know it takes less than that. I am saying that because cousin's case get's approved in 8 weeks though he had a IR1 category. But the timeline for his case also said five months but got approved in 8 weeks. If any one recently get any approval please updates me and other VJ's users.

One more thing after approval how long it's going to take at NVC to complete the whole process.

Just a quick question? My mother had medical done Feb 14th, After the test and shot, doctor told her they will send the report directly to the Embassy. Is that normal. I thought they usually handed out to the patient. Thanks in advanced.

Your parents should get approved by next month. And if you have all the necessary paper ready for your parents, whole process in NVC will take about 30/40 days.

Hi Everyone,

I have received an e-mail (REF) from NVC for missing doc for DS-230 (Marriage certificate for both beneficiary and the petitioner). But the problem is that I have sent them both original and the copy with the other doc to them.

I have called NVC at the same day and spoke to an live person and she was saying that the marriage certificate is not on the right form. I did explain to her that in BANGLADESH for people of HINDU religion there is no official marriage certificate. We usually get one from the local municipal office form or from the Temple (where the wedding function occurred). And also I have told them that four years ago when my husband sponsor me to come here, we used the same marriage certificate. NVC operator was reasonable enough to hear my argument and she told me that she will refer this to her supervisor and that will take 2/3 weeks.

Please advice if I could do anything else to make them understand.

Please respond if anyone knows, NVC accept Laminate copy of original document. My mother sent me her original birth certificate (Laminate copy). I have read somewhere before someone was saying nvc doesn't accept laminate copy.

Thank Mili. We are pretty much at the same stage. My father's DS-230 was entered into the NVC system on Oct 08.

Btw, which original civil docs are you sending with DS-230 to NVC?

Well little different than you because we (Hindu) sent marriage Cert. (Court Paper from the local Municipal office), off course original and copy, Birth Cert, police report, picture etc..

Ok, it is the "security clearance" phase. Pretty much all Bangladeshi male must go through this process. They send your info + fingerprints back to the US for doing a background/security check. I know this is frustrating, but you should be glad because this means everything else is fine with your application, and as soon as they receive the clearance, you will get a call from them for your visa.

When my father applied for visitor visa back in 2006, it took 9 months to get the clearance (and he only got 1 year visitor visa while my mother who applied with him got 5 year visa with no security checks!!). Then, when he applied again in 2008, it only took 2 weeks to receive the clearance.

I am not saying yours would take that long, specially now a days the background check process is much more efficient and it doesn't take long at all. Stay positive.

Feliz, I re-read your post and realized that the NVC letter asks the beneficiary to bring original of anything that wasn't submitted to NVC. So that makes sense.

As fer as I understand, the Packet 3 or Packet 4 stuff are not for us. Those are for k1-k-3 visa.

You have to send all original and photo copy to NVC. Once NVC approve your case, they will e-mail you the interview date and sent your whole package to Dhaka embassy. At the time of the interview, your parent will get the original document back.
