  1. What? there is no medical or medical fee with the I-751.

    Oh really?

hum okay not sure why I'm confuse about that. On the USCIS it says the fee for filling is 505$ + 85 for a bio-metric fee for a total of 590$

    says Where applicable..

Or is it only for Child?

  2. Hey guys, sup.. it's been two year. My card is about to expire and I should technically sent a I-751 next month.

But the thing is I am a bit confused. Most people talk about conditional status etc. My card says Permanent Resident.

I did a K-1 Visa back then and moved without problem. Did not even need to do a follow up Interview. My green card just got sent in the mail and it was valid for 2 year. It's gonna expire the 09/21/12.

So if that make sens to you. Please tell me I am no different and I still have to fill the I-751 to get my 10 year green card.

    Sincerely,

    Ebrech

  3. Is it the USCIS Call Center that sent a message to the California Service Center? I am curious. Each time I talked to an immigration officer at USCIS I am told that there is no real processing time for I485 passed on marriage and that I just have to wait my turn...

Congratulations anyway! Enjoy your (almost) 2 years of "USCIS free" :)

Yes it seems so, I'm not exactly sure but I told them I was way out of the timeline and after telling me her speech and reading all her paperwork I guess

and asking me tons of question she finally said that.

I think some uscis workers are lazy and sometime you have to call twice or drop the call when you think someone is not helping.

did you apply for your ead and ap as well? if so, how long did that take?

No I did not since I didn't need it but i'm sure it would have been faster than that for those 2 if I had

Here is the link I forgot to type it earlier >.<

    http://www.dhs.gov/xabout/structure/gc_1221837986181.shtm#5

  4. It took a long time but we finally got it.

Our case been forgotten I guess but I called the Uscis and they sent a message to the California service center, and the day right after we received the update.

Here is the link again to call them if your case is being delayed as well (4-5Month)

We had sent our Aos application on february 27th!! :P

oh and for some reason they skipped the interview...

  5. Ours wasn't transferred, but from what I remember, you get more than one notice when the case is transferred, one which (paraphrased) says "we are mailing it off to CSC" and another one which is "Hey, we got it at CSC now". Did you get that second one?

Otherwise, I think you should follow up, just to make sure something unexpected hasn't happened and lost in the mail (like an RFE). Call the service center number, or try making an infopass, or get into contact with your congressperson/senator's office (in that order).

I usually don't advocate status checks, but I think, as you say, you've been waiting longer than normal, and it's good to make sure.

same for us, we got transfered and then no news...I saw my document been touched once around a month and a half ago and still no news... I never got more than 1 letter to say they had transfered the case.

  6. During this whole process did you speak with a manager?

Even though your I-94 has expired you can still have your SSN record corrected to show your married name. You just will not be issued a new card until you have evidence of employment authorization.

I would go back to th SSA office with your marriage certificate and ask to speak with a manager and show them this:

RM 10211.605 Request for a Replacement SSN Card Obtained for a Nonwork Purpose

    https://secure.ssa.gov/apps10/poms.nsf/lnx/0110211605

    A. Correcting Numident data when a replacement card cannot be issued

If the alien does not provide evidence of work authorization or a valid nonwork reason, explain that we cannot issue a replacement card.

    1. Alien provides documentation supporting the change

Although the FO cannot issue a replacement card, you may correct the Numident if the alien provides documentation supporting the change (e.g., a name change).

If the alien provides documentation supporting the change, process the replacement card application to update the Numident information but suppress the issuance of a card.

-- Answer “yes” to the "Suppress card issuance" question on the SSNAP Additional Information screen and record the nonwork reason documentation on the SSNAP Proof of Legal Alien Status screen.

    -------------------------------------------------------------------------------------------------

Once the record has been corrected ask for an SSN Verification Printout. Not the same as a card, but will give you some proof of your SSN and the name on the record until you can be issued a new card.

    Thanks much I will :D

  7. Hey Ebrench N Persona! We miss you in the Canada forum!

Hopefully the wait for your GC won't be too much longer. When I went for my AOS interview I didn't have a state ID either. I had some issues with my name as well, but it was a problem with the SAVE database so a different issue but with a similar result. The IO at our interview understood why I didn't have a state ID (although he did ask) and was very understanding when I explained my situation.

So, you have an SSN in your maiden name right? You could always get added to your husbands bank account and do some other things in your maiden name and then just have the name changed on it later. I presented some evidence at our AOS interview that was still in my maiden name and it wasn't an issue. It still shows the same thing, right? Just a thought!

We could try ya I got a ssn card on my old name and after I got 3 other with bullshit on it... as a Matter of fact right now my name on the ssn office is still UNKNOWN MISS XXXXx XD

But I think they asked me to have my DMV card... :S so As long I don't have it I can't open ######...Even my visa was refused as it was from canada.

  8. Excellent Review - thanks so much !!!

I can understand your frustration, absolutely !!!

IMO - your 'personal experience review' is best reason to 'apply in visa name' (for anyone else reading this, with a K-1 visa in hand, thinking to get SSN at SSA office).

SSA clerk first tries to find your visa name in the SAVE database. If it's not there, come back a week later, try again - do NOT apply until a SSA clerk or supervisor can FIND YOU IN SAVE database. Usually, you'll be found in SAVE database on or after Day 15 of yer POE date. If they can't find you, don't apply for SSN that day, come back in a week.

Sorry for the pain and suffering, now you must wait until EAD or GC arrives (whichever is first, take it and go )

Well the problem was not my new name...

beside I was in the system that I know...

it was that the girl made a stupid mistake

since I have 2 last name she probably filled one blank.

And it took so long that my I-94 expired.

I have 4 ssn cards >.< that should tell you.

Ya but now we are just waiting indeed.,, hope if we get an interview they will understand that he could not add me to his bank account, that I could not get a ID card eitheir...

  9. Alright, So far everything on my application is okay but I had so many problem with my name that I have to share with you.

So on the 9th January we got married and 2 week later I received my certificate and with this we went to the SSN office to try to get me a card and change my name.

As soon as they saw my certificate they said oh but your certificate do not have a name change request at the bottom. I was puzzled because the lady made us sign a paper over there at the wedding office to change my name and even made me decide how I wanted it.

So we had to call back the wedding place and figure out what happened.

Result, Some douche had it in the system but had not printed it on my certificate... So we had to wait another week and they finally called so that we can go pick our new version at the hall of records.

So for now... we go back to the ssn office.

Ah yes, we waited an hour again, got into the office with a new girl who was obviously new to what she was doing and all and we waited an hour looking at her type on the computer and asking us question.

To this we thanked her and left.

Waited 2 week got my ssn card but my name was XXXXXXX-XXXXXXXX_XXXXXXXX I'm not gonna type it but it was the wrong name since I had requested A name change.

We went back to the office, a new guy served us try to fix it was looking at my papers again. Oh well it must have be a problem in the pc we will send you another card he said.

I went back home waited another week.

By then we are in march.

I receive my card and my name on it is UNKNOWN-XXXXXXX-XXXXXX My name was obviously changed but with the fact that my first name was now unknown...

Called to have explanation and told them I really didn't want to have to go back and try to sort it by phone but they could not, pretending that maybe the homeland security could have wrote it wrong on my application and they had to see the name again and my birth certificate.

I went back it's the 4th time now...

they tought they had done it right and I spare you all the bullshit, I went home waited 1 week received my card which to me looked fine!

    now the fun part...

    2 week later

I went to the DMV to get my identity card.

I'm sorry miss XXXXX we can't find you in the system...

I go..." how come ? can you try with my old name?"

And of course she found me on that name but said she could not process it on my new name since I wasn't in the system and she said I might receive my card in 6 month!!

unless I can get a note from the SSN office or something...

SO I went back to the ###### ssn office for the 5th time now

At that time I think I start to know everyone in the damn place.

And talk to them and showed that my name was still showing up wrong, and even to them it was weird because in the system I was still Unknown XXXXX and now at this time My I-94 is about to expire

we are in April it's their fault and now they can't process it because it's gone bad.

So they had me show up and we try to explain what happened, they could see all the time we went in their office and the guy said that he had fix it and I should get a new card soon even though my thing expired.

I waited 2 week and got nothing so I called them back and they said they would look at it and give me a call back.

Today as of may 21 I received a call from them and they can't process my card because my I-94 is expired.. they are asking me if I can get another one which I know I can't...

How can so much Bullshit happen and them not be able to go and see in the process that I went 6 time to try to fix their error because that lady was new and put a blank space in her forms???

  10. Having your friend do the translation should be fine. I don't know what the VJ guide you're referring to, but just have them sign at the bottom a declaration that they've translated the document and have their identifying information there as well.

    http://www.visajourney.com/forums/index.ph...ge=translations

Per the USCIS, documents not in English must be translated. The policy states as follows:

"All documents that are in a language other than English must be submitted with a translation. The person translating the document must certify that the translation is complete and accurate and that he/she is competent to translate from the foreign language into English."

All translations must include a statement similar to the following:

    Certification by Translator:

I typed name , certify that I am fluent (conversant) in the English and

languages, and that the above/attached document is an accurate translation of the

    document attached entitled .

    Signature

    Date Typed Name

    Address

I just used my husbands last name for everything I filled out on AOS. My EAD and AP both have my new last name. Your marriage cert. will show your previous name, plus your husbands, therefore that alone will prove you have a new last name. I waited until I got my EAD in my married name before changing my SSN. After all, can't work until the EAD anyway. For some reason, I wasn't "updated" in their system, but the guy did it manually so I should be receiving my new card soon.

As far as transcribing goes. You DO NOT need another medical. Make sure the doctors understand that you've had one within the last year. I have read that some people have been getting RFE's for the medical not being transcribed, however, I did not do that, and my case is transferred to CSC. They may or may not RFE me on it. If I get approved, then I've saved some $$$ by NOT transcribing it. I guess it's a chance to take. If you get RFE'd for it, it shouldn't take long to do, and not hold up your case too bad.

Real sorry that I can't answer # 3 for you. Hope you get an answer for that soon.

    thanks :)

  11. 1. Just put your married name on all of your AOS paperwork. You'll want to get it changed it on your SSN first, though, which is what I did.

    2. As long as the doc understands that you don't need the full medical, $90 sounds about right. I almost got fooled by one civil surgeon who kept wanting to do a TB test on me, give me the full medical and charge me about $130. I argued for about 30 minutes with him before I took my paperwork and brought it to another civil surgeon who knew exactly what I needed and charged me $50 for the transcription. He recommended another Tdap shot, though because I only had two and he informed me that the USCIS/INS can get a bit picky about that.

    3. I think you'll have to have a certified translator with a stamp and everything. I got mine done in Taiwan.

    Hope this helps!

    Tina

    alright thanks :) sounds good

i found a place for the translator we will call and see how much they charge...

  12. Question 1

Where on my paperwork do I change my name for the AoS?

I have read somewhere that it will cost 300$ if I change it after...

If I remember, on the wedding certificate it didn't say anywhere that I am changing it. I do remember the lady at the wedding asking me if I wanted to change my name.. (to which I said yes and selected the name).

When I went for my SSN, they wouldn't allow me to change my name yet, since we hadn't received our marriage certificate yet, which we have now.

The question I'm asking now is that on the forms I'm currently filling for AoS, do I use my maiden name or married name?

Should I change it ASAP at the SSN office? Then use it everywhere, or can I use my married name on the AoS form before changing it at the SSN office?

    Question 2

My husband found a USCIS doctor near us and they'll charge us 90$ to transcribe the vaccination records to the I-693 and seal it..

    Does that sound right?

Do I even have to fill this form since I had my medical done in Montreal last November?

    Question 3

I found out I need to have a new translated copy of my birth certificate cause I didn't make any photocopy of the one I sent them..

We are going to ask a friend to do the translation for us (stupid that I can't do it myself).

Do I have to find a certified translator, or as long they sign the paper as the guide on VJ tell us to do should be okay?

    Thanks!~ :)

  13. It's okay that you couldn't change your name just yet. As long as your marriage licence has your name change on it, when you apply for AOS put your married name on the forms so your cards (EAD, AP and GC) have your married name on them. Changing your name AFTER AOS will cost you about $300 to get new cards with your new name. Your marriage licence acts as your name change document as well as proof of marriage for AOS purposes.

There is only ONE biometrics appointment as the biometrics you take for the EAD are used for the GC

As the EAD and AP (advanced parole.. used if you need to go home while AOS is pending) is free with AOS most people just fill those in too. It's not a lot of extra work and it's better to have than not have. Some peoples greencards have taken MONTHS to come, and at least if you have your EAD you can get a job if it does take this long. The AP should only be used if you have NOT exceeded your I-94 date by 180 days or more.

One reason people don't bother with EAD is because they get their GC so soon afterwards. This isn't in ALL cases though and like I said above, it's better to have than not have, just in case.

You are NOT permitted to work on a K1 unless you have an EAD. You will need the SSN as your "id number" so those two will be used together. Once you get your GC the EAD is useless. They typically take it at the GC interview so if you have a job you can ask for a stamp (though I've been reading that this is being done less and less).

If the medical form you're talking about is DS-3025 (here's an example: http://www.visa-talk.com/DOC/Medical-forms/DS3025.pdf you'll see in the bottom left corner it says DS-3025) this is the vaccination form that you need to send with AOS. Although the instructions say that if your shots were completed that's the only form needed, a lot of people have had RFE's asking for the form I-693 vaccination part to be completed. This doesn't mean you need a new medical, it means you simply need to take your vaccination form to the CS (picked from this list here: https://egov.uscis.gov/crisgwi/go?action=of...ffice_type=CIV) and have them check it, transcribe it into the I-693 for you, and tell you if you need any more shots (since I had my medical in July 09, the requirements have already changed so I MIGHT need new shots) and then they seal it in an envelope and you send that with your AOS.

I hope that answers your questions :D

    yes its good info thanks

  14. Sorry Ive been up so early my mind is jelly right now.

You need to do the biometrics regardless. They want to scan all the crevices of your finger tips for your green card :P (I know that sounds gross)

And I dont know what you mean about the medsy paper...?

I think now you can get away with just filling out 1 copy of G325a...but I was worried Ill get an RFE bec of it, so I photocopied it to have 4 copies.

medisys is where i went in montreal for medical they gave me a list of vaccination i had previously and that was up to date with USCIS requirement

  15. well as you say

GC take 4 months and EAD take 3 months

about the biometric part i don't see where it is required

so to make sure i won't do it

for the other question now is that piece of paper from medisys good ?

i still need to fill my 4 copies of G-325 and then i just put the paper with it ?

You came on a K-1 visa, that doesn't give you work authorization. You can file AOS and your EAD together..which are the next steps. Your visa will be mute as soon as you marry. You do have 90 days to do so...but that does not give you the ability to work.

    thanks for the info

  16. okay everything sounds good for us to wait

but it says it's free for some people here

    Filing Fee :

    $340

    Special Instructions :

If you filed a Form I-485, Application to Register Permanent Residence or Adjust Status, on July 30, 2007, or after, and you paid the I-485 application fee required, then no fee is required to file a request for employment authorization on Form I-765. You may file the I-765 concurrently with your I-485, or you may submit the I-765 at a later date. If you file Form I-765 separately, you must also submit a copy of your Form I-797C, Notice of Action, receipt as evidence of the filing of an I-485.

does it apply to us ?

    thanks for the info :)

  17. Aight so i went to get my ssn card today and i should receive it in 1 to 2 weeks

i couldn't adjust my name since the wedding document are back log as well for a minimum of 8 to 10 week!!

so i kept looking at the list today and now i see there is the I-765 (optional)

    for getting a EAD

i thought the ssn was exactly to work

anyway if i don't file for it i can't work until i get the green card right?

i thought my visa was enough to work till it expire at least

so it give me 3 months? then what when does this EAD can be used

    Also another question

Do i need to go to a civil surgeon if i have that paper from medisys ?

    *VACCINATION DOCUMENTATION MEDICAL WORKSHEET TWO*

    *For use in canada only*

    THanks!

  18. well first you can go get your SSN at a nearby office

you will need the wedding certificate and the 1-94 in her visa and the passport

while you are there you can bring other papers in case they need it and print out that form in the guideline

    im on the same step

we got married on the 09 january :D congrats

now im trying to understand all those paperwork guide cause i see some paper i already filled out and it confuse me...

  19.

Up until now I was totally fine with this interview. I was like, whatever, totally prepared, I have nothing to worry about. All of a sudden Im ridiculously worried.

I have no idea why. ARGH!

Please tell me Im not nuts and everyone goes through this

everyone stress :) but seriously it will be a breeze if you triple checked all your stuff

copie 3 time all your document as they may ask you a copie for some document (Even if you previously sent 2! thats what they did at mine)

make sure you got your Envelope and that its not a brown one cause i saw a lot of people getting the wrong one

and be there in time :D
