  1. As the title says, we submitted our I-485. On the form I (the petitioner) had stated the reason for my not filing taxes for 2018 (the most resent tax year upon filing). I had been on worker's comp and that income is tax exempt. Per the form, I explained this and added more info in the additional space at the end as well as provided a letter from the Worker's comp provider (whom the checks had been issued) which showed the amount I was paid every two weeks and the period that I had been paid.

     

      The letter says that I do not meet the minimum requirements for the Affidavit of Support. Specifically not meeting the 125% of the Federal Poverty Guidelines. I am working now but own no property. I have met with the IRS and explained the issue. They then printed papers saying officially that I did not file taxes for 2018 - which to me seems to be useless as it provides no explanation.

     

    I have now asked my brother, whom is somewhat wealthy, has valuable property and businesses, to help sponsor my wife so we meet the financial requirements of the Affidavit of Support.

     

    MY QUESTION: How do I proceed? I read https://www.uscis.gov/greencard/affidavit-support which seems to read that a as a joint sponsor "you cannot combine your income with that of a joint sponsor to meet the income requirement.". I have read on these forums about co sponsor but could not find that language in the page above.

     

    Any help on how to do this would be appreciated.

  2. After sustaining a brain injury from a fall. I was on worker's comp for the entirety of 2018. My income was tax exempt and both my tax accountant and the IRS tell me I do not need to file. Now as my wife and I are filing for her AOS we are being asked for the tax papers from 2018 which I can not seem to get. Let me know if you need more info. Thank you in advance for any help you can offer.
