    Hi, I am the beneficiary of a pending I-130. Adjusting from B2 visa.

    We had our AOS interview on 9/11.. The IO took my I-94 right away. Swore us in, went through the petition and the I-485, and asked questions from both my husband and me about each other (parents' names, my maiden name, each other's birthdays, how we met, how we got married and the like). We answered all his questions satisfactorily. He even said he didn't see any problem with our case, but his boss had the final say in every case.

    We then receive a notice for a second appearance. Instructions were to ask for the same IO; Reason: "I-485 Application"; and to bring with me: "USC spouse".. Signed by the Field Office Director.

    Would anybody know what this second interview could be about?

    Your help will be greatly appreciated!

  3. Are you sure it is an E1.

    They do not come with work authorisation.

    NonUSC entered on an E1, but he is now here on a work visa (I'm not sure if it's an H1B or H2B, will have to check with the spouse friend)

    Then E1 is irrelevant, current status is what matters.

    To go back to the original question, are the tax returns of the non-USC needed for the AOS? And the EAD? Thanks again!

    Yes we have gone through the guides, but did not see the non-USC's tax returns. If the USC is already earning enough for the I-864, does that mean they do not need to include the non-USC's tax returns in the AOS package? (They have only been married in February this year so they haven't filed a joint tax return yet).

    Also, do they need the EAD?

    My friend hasn't found VJ yet so I thought I would ask for her. I adjusted from a different visa so I was hoping to ask how the procedures are different.

    USC married her husband in February, and filed an I-130 for him. They received an NOA for it already (Her non-USC husband has been here on a work visa; she was not aware that she should've filed an I-485 concurrently).

    Non-USC husband entered the country on an E1, and was able to get a Work Visa while he was here. He has a Social Security number, and has been paying taxes.

    Question is: What additional documents have to be in the AOS package in this situation? Additional because I was hoping to know what other documents they need that are not on the list in the guides.. (Do they include work visa documents? Non USC's tax returns? The USC is earning enough to cover 125% above poverty level requirement)

    Also, is there a need to apply for an EAD if he is already here on a Work visa? (I previously read a member being advised to apply for the EAD just in case he becomes laid-off or something)

    Just when i thought i had all the ducks in a row, here is another question -

    Since I am filing my parents I-130 and I-485 concurrently (while they are here in US) and the supporting I-864 form, it seems that i need to send additional fees of ($70) for the domestic review of the I-864 form.

    "Affidavit of Support Review (only when AOS is reviewed domestically), Form I-864 : $70.00 " - text extracted from the Department of State website.

    Could anyone confirm if I am interpreting this correctly. please advise - who should i write the check to ? USCIS or Dept of State?

    I asked this question previously, and was told there was no need for the $70 if it's the USCIS (not the Department of State) reviewing the I-864. See this thread: http://www.visajourney.com/forums/index.ph...634&hl=BT78

    We did not send any $70 as we were advised, and had no problem with our application. Hope this helps. :)

    that a different ASC office in Dallas does not allow early walk-ins at all. I hope I get lucky.

    Hi Naksah,

    I had my biometrics done yesterday at the Dallas North office, it was pretty busy, and had to wait an hour and a half before I had my biometrics taken. (Better to get there early, I went there 1245 for a 1PM appointment. I learned later that it didn't matter what time your appointment was, they process on a first come, first served basis when you get to the ASC).

    I chatted a bit with the Technician taking my bio, and he told me he was actually from the Fort Worth office. I remembered your query, so I asked him if they took early walk-ins there. Unfortunately, he said they don't anymore because that ASC can get busy, and they turn away early walk-ins to prioritize those who are scheduled for that day only. Just an FYI. But who knows, maybe you can get lucky? Good luck, and practice smiling without teeth! :)

  9. Phew...got my 3 NOAs yesterday. I went online and created an account so now i can see all my cases online...Thank God and Thank you all VJ members. I am now waiting for my biometrics letter because i really want to do them early and get it out of the way.

    Congratulations on the Biometrics letter. I got mine earlier this week, scheduled for June 17. I will be out of town then so I tried going early (Saturday, June 6) with my appointment letter, but the USCIS-Dallas North office won't take early walk-ins :( I noticed you have the same field office, are you going to the same ASC? Hope everything works out for you,please post if they take yours? Thanks! :)

    Also, does the I-864 need its own copy of the passport or birth cert? (I thought it was a supporting document for I-485?)

  11. I-864 only REQUIRES copy of past years (2008) IRS return. A return is 1040 + Supporting evidence, in the case of self employed I believe Schedule c needs to be included.

    Each form needs to be able to stand alone, so attach a copy of passport or birth cert to each.

    Does the I-864 need its own copy of the passport or birth cert? (I thought it was a supporting document for I-485?)

    Also, do we have to send a $70 check for the 864? (USCIS website says the Dept of State "charges a fee of $70 when the Affidavit of Support is reviewed domestically. This does not apply when the Affidavit of Support is filed abroad.").. I am in the US filing for an AOS from B2.

    Will be including my USC husband's 2006 Federal Tax Return in filing our I-864. He filed this with his then-wife, and have both their incomes factored in the total income. What amount should we write down as reply to "My total income as reported on my federal tax returns for the year 2006" then? Will the amount listed in his federal tax return (which is the total of his and his ex-wife's incomes) be right? -- This will be different from the amount on his individual W2.. So which one will be appropriate for Question 25 please?

  13. Assembling our I-485 package, and tying loose ends now..

    Does an I-485 package (concurrently filed with I-130) require our Marriage Certificate and I-94? Didn't see them as document requirements in "I-485 instructions", but have been reading here on VJ that both these documents are being submitted with the AOS package specifically for the I-485.

    We do have the Marriage Cert with the concurrently filed I-130, and the copy of the I-94 with the Form I-765 we are applying for along with the I-485.

  14. It's a multi purpose form so there are lines/sections that may not apply to you.

    Both of you would fill one out, or at least we did when doing a K visa. I'd assume that you each fill one out for adjusting from any type of visa. They gotta have the basic bio for each person.

    Check out the sample forms link at the top of the page to get a sense of where you may leave blanks or put "N/A"

    Remember that it's a 4 page form (each page with the same info) so if you hand write something do all 4 pages. That would be a lousy thing to cause a delay.

  15. If you have the full Adobe Acrobat you can reduce the font size a bit and see if it fits. Or just leave blank and fill in by hand.

    If there is a lot of info then you would use a separate sheet, attach it to the form, and write "see attached."

    Taking advantage of your attention.. In filling out G325A.. does the petitioner (US citizen) need to fill out the "box outlined by heavy border" at the bottom of the form? I'm not sure because petitioner is not an *applicant*, nor does he have an alien registration number, right?

  16. We are filing our I-130 concurrently with Form I-485 (AOS).. Need help filling out Form I-130 please?

    Question 22 asks at which USCIS Office the Alien Relative (who is already in the USA) will "apply" for AOS.. Instructions says we file the I-130 and I-485 thru the USCIS Lockbox Facility in Chicago IL. Should we place that as the USCIS office where we will be applying for AOS? Or should we write the nearest USCIS office to our place of residence? (Assuming that is where we will have our Biometrics and follow-ups?).. Your help will be greatly appreciated!

  17. I am a Filipina who married a US Citizen. We are in the process of filing the Petition for Alien Relative. I have two first names. I was wondering if I may just use my first name (Maria), and drop my second first name (Belinda) in the application forms. Was hoping to use my maiden name as my middle name, and my husband's surname as my last name. (It gets confusing using two first names in US documents because they use my second name as my middle name). Would appreciate your advice on this matter. Thanks!

    unfortunately we are in the same boat... i do have 2 first names and when i got married or even when i was still single applying for ssn, the lady combined my 2 first name in one word (so weird). she said it doesnt fit or allow in their system... so when we filed for aos, we decided to drop my second first name and now im just using 3 names (first name. middle name which is my maiden name and last name which is my hubby's last name)

    But don't you have your two first names in your passport, other legal documents? Didn't that pose any problem?

    yes just my passport and nothing else that shows my other names on it. no legal documents (that has my maiden name) being use in the US after i got married and got my GC... i havent amend my passport yet to my married name and if i do im guessing its up to them what names they're gona put it on there... im not really using my passport here in the US (only if im travelling abroad)... my DL, SSN, GC, bank accounts and bills are all in the same name

    So you just dropped your second name and mom's maiden name? I was wanting to do the same thing with my AOS but I am worried because my birth certificate, passport, I-94 have my two first names... Some people here on VJ say you have to have something like a court order to change your name?

    once you're married you can choose a name you prefer. to use your husband's name or not etc... that's what the lady told me on the court/clerk/record office... plus when i applied for my AOS the one who helped us arrange our file advised us to do the same (dropping my second name and adapt phil tradition by using you maiden name as your middle name)... when i had my AOS interview the officer asked me what name should i use in the GC, so it was an easy answer for me...
