Lots of hurdles to overcome here. From what I read in your other thread, the notes in your friend's passport are the least of their worries.

Please, two issues, two individuals. If a person is faced with both issues, I will advise the immigrant to go home. Period.

Not only did your friend mislead and get a red mark against her if she does try to apply but she married a felon. Nobody on the internet can help her situation. I doubt a lawyer can. The situation she is in is not normal. Her husband being a felon is going to be her biggest problem, but the notes in her passport aren't going to help any either.

Common now! Yes, I posted two puzzles in recent past, but they are not related to one another. These are two independent problems facing two individuals. Why link them together? It seems to me like a bad assumption.

She overstayed twice.

No. She never overstayed at anytime. If she did, she wouldn't have been allowed in the third visit.

How did she come to US?

On spouse visa or fiancee visa?

Did these crimes occur after the fiancee\spouse visa?

Or did he lie in his application?

Because I thought the chance of someone with felonies that you mentioned

would not (easily) be able to sponsor someone for fiancee or spouse visa?

The woman was not sponsored by the husband (Felon), they met here in the US, and got married.

I think getting a lawyer would be a waste of money. In my opinion the best case scenario would be that they make him go back to his country and wait which is pretty common. There isn't a way out of the problems, the guy was dishonest to her and was involved in some kind of child porn or something. Those are two pretty big strikes.

The husband, an American citizen, is the convicted sex offender, not the wife, the immigrant.

I sure hope not. In general any felon will have a tough time getting anything done concerning immigration.

The spouse of the felon was not aware of the conviction before the marriage was consummated. Now she is stuck between AOSing and the marriage. The marriage is real, and AOS is important; what is the way out of these problems?

I want to know if a Felon convicted of SEX EXPLOIT MINOR 2ND DEGREE can successfully adjust status for a spouse. Please, your thought on this.

At no time did she overstay on the two previous visits, before the third the problematic "NO AOS/EOS/COS" visit. One is usually allowed 6 months maximum stay per visit to the US at the Port of Entry, and she did not stay beyond legally allowable duration. She only stayed about five months on each visit. Anyway, my questions are: Can she decide to ignore the "NO AOS/EOS/COS" notation on her passport, get marry here and attempt to AOS? What is the likelihood that she can successfully AOS despite the "NO AOS/EOS/COS" clause? Do you know anybody that successfully AOS despite the " NO AOS/EOS/COS" limitation?. I personally believe, she had never overstayed her welcome in the States, and not committed any offence so far. Her 2 years multiple Visa will expire in Nov.,2015, she fears it will not be renewed because of this obnoxious note, hence the thought (not decided yet) to stay and AOS.

She wants to do this now? Then she should have applied for a K-1.

AOS from a tourist visa is possible with spontaneous weddings. This doesn't quite sound like it ...

She never planned to stay beyond the allowed stay. The new development and the fear that her soon-to-expire Visa might no be renewed if she departs the US back to her home country, hence the impromptu decision to marry her fiance and AOS.

There are people who have successfully AOS'd with written notes by an IO. However there is no guarantee that she will be able to. They're on to her and how much time she's spending here. Best to spend some more time in her home country before she's outright refused entry.

Thanks for your timely response. So, you mean she could still adjust her status with the note on her passport? Do you know the legality or otherwise of the written note by the IO?

Hello, My friend really needs your help. Here is the story: My friend visited this USA on two occasions, She spent almost five months on each visits before departing the US back to her home country. On her third visit to America, she was stopped and questioned for several hours by an immigration officer at the Port of Entry, ATL. The immigration officer questioned her, why she stayed in the States for almost five months on her previous two visits, and now she came back on a third visit less than two months she departed America. She explained why she stay that long on the two previous visit, and why she came back again (just decided to have a long stay/rest). Well, to cut the story short, the immigration officer gave her 60 days to depart US, and wrote on her passport, "No Adjustment of Status, NO Extension of stay". What is the implication of these handwritten restrictions on her passport, incase she decides to get married to her fiancee, here in the US? I have a feeling that the renewal of her Visa will be denied, if she decides to return home. She wants to stay here in the state, marry to her fiance, and adjust her status. Can she defy the NOTE on her passport? Please, advise.
