What do we do for the I-864 form if the petitioner has not filed taxes in a couple of years? He makes enough to support me but he has not filed his taxes recently.
As they stated, it's an option to show 3 yrs but most recent tax transcript from IRS and a letter from his present employer will do. Here's the catch, if he doesn't list last 2 yrs taxes he will need a good explanation why or he just back filed. If he didn't make enough prior 2 yrs earlier and someone claim him as depend don't worry, they just care his most 2013 and present income of which an official letter from his employer is required.

Received my passport and visa stamp today. I asked for immediate return. I thank the officer who made this possible.
Just gotten my airplane ticket. I leave August 1.
Now I have 14 days left to finish whatever it'll be over here. Nothing really.
Its finally over for me.

fyi paying the green card fee before leaving is NOT mandatory
it is for the production of the card and can be paid from the states as well
the 551 stamp in the passport is the equivalent of a green card good for a year
Yes it not a mandatory but they recommended a payment prior arriving in US. It would take the stress out by having GC & SS card arrived in your mailbox when arrived in US. It's totally at everyone wishes not to pay when or how but I know at the end you will have to cough up $$$ either way so why fight or makes thing complicate?.

Thanks. You're right. It makes sense for them not to know. My daughter looks like my grandmother. lol We always have facebook. I have to refrain from taking my backpack to the consulate. Need to find another bag. But yes, I'm fine and ready. I have nothing to think off beforehand and take the question as it comes. My son is starting the University this September. I'm so proud. There was a constant back and forth in papers too.
Sound good. You'll be right on time to pay for his tuition when coming back here as it around school is start.

Yeah. Its coming closer. Any plans for your MIL arrival. I say with me having filed an I-407 they see my being here was unexpected long. That I didn't carry anything with me. I sure have some pics in my purse. But as a single mother I'm the one behind the camera. hahah
I think photos is just optional if you have it great if don't it fine. Even if you shown photos, honest they wouldn't know how the petitioner look like anyway. You will do just fine. Make sure you paid the GC fee before leaving Germany.

I'm not sure about US Embassy at Germany requirements on interview for IR-5?, but Embassy where my MIL had interview required photos of mother & petition together, which is not on their checklist requirement or what to bring on interview date. It something we just asks others that had interview before us. Well I hope everything will go smooth on Tuesday interview and you will be soon united with your childrens.

Hi Sonjat, her interview has been approved and now awaiting for visa to be arrive in the mail. CO only ask her couple questions about her daughter & the co-sponsor ( of course me). Show few photos of her and her daughter together and that was all.
Good luck to you on Monday interview it won't be too bad as far as my understanding from my MIL interview.

The people I responded to only questioned what the route is. I seen on their timeline K-3 . It just wasn't necessary....

People in good marriage don't even have to worry about interview stuff after 2 years.
I was sharing an apartment with a friend and a friend of her was married to a USC for a year and they got into a dispute, seperated ect..... on the interview date she got an attorney but didn't help much she was ask to leave US.

Okay...than we have different opinion on this one.
My opinion is that the GC is conditional for 2 years (to proof that the marriage is bona fide)
People who divorce before 2 years lose their right to the GC (unless they can proof hardship (like abuse) in marriage and file for U5 visa...
Parents of US citizen receive unconditional GC. But this is solely my opinion.

Anyone going through IR-1, K-1, I-129F ..........will have 2 interview total. First one is the spouse (beneficiary) will be held at your country, second one will be here in US and this time both will need to be there. If your interview is approve, you are done and free willy from this point on. Neto you'll need to read others post carefully to avoid confusion.
That's right! and if a couple still married after 3yrs, LPR holder can apply form N-400 to become USC, counting from the date you received your temporary GC. Now if they get divorce after 3 years meaning he/she have 10 GC on hand, an LPR will have to wait 5 years before applying for his/her USC. If a couple divorce before 2 years, beneficiary will need to prove abuse or other legit statement to CO during interview to be eligible for 10 year GC otherwise i'm sorry she/he need to go back.
I saw this wierd couple at the time of my interview where a guy (must be usc, because he keep saying to his spouse good luck on your 10 GC) were with a new girlfriend and I assume ex-wife where with an attorney, CO interview them both seperately, not sure what the outcome were but she ( beneficiary ) and her attorney seem to be very happy when they came out.
7.1)...Please explain "Conditional Permanent Residency"?
A.. A two year Conditional Residency is granted to those who apply for Adjustment of Status based on marriage to a US Citizen. This two year period helps to deter visa fraud and marriages of convenience. During the "conditional" period, you still have all the rights of a Permanent Resident. Your status as a permanent resident expires at the end of this two year period unless you file for lifting of the conditional status.
7.2)..When do I become a Permanent Resident (conditional status removed)?
A..You become a permanent resident (conditional status removed) after approval of the I-751 "Petition to Remove the Conditions on Residence".
7.3) ..Okay, when do I file the I-751 to lift conditional status?
A..Option #1: If your passport is stamped with the I-551 at the adjustment of status interview, the stamp has the AOS approval date written on it. Your 2 year conditional period begins with that date. Ninety (90) days prior to the end of the conditional period, you and your US Citizen spouse will apply together for a removal of the "conditional" status by filing form I-751 together as a married couple.
Option #2: As is more likley the case now, the I-551 stamps are not automatically given at the conclusion of an AOS interview now due to namechecks and files moving around. Green Cards are routinely mailed to the beneficiaries within 4 weeks (if approved) or delayed by months due to name checks pending. The accurate date of your PR is printed on the front of the GC as 'Resident Since:".

Parent will automatically received permanent GC no question ask once they put a foot on US soil, unless one didn't pay the $165 fee
. She/he will have to wait for 5yrs counting on the date of receiving his/her GC before applying for his/her USC there is no way out of this one.

An attorney will not make anything go faster, but a reputable attorney will assure a-z process get done correctly and avoid RFE which cause delay and time.
I went through this process before 7 years ago, there's alot of forms, fees and process behind the scene that you need to go through before receiving pernament 10 years GC. If you don't know the process or which form to start out with call USCIS is your best option.

I did received response back from NVC after I questioned about my original marriage termination document. I printed it for interview, just in case its missing. I say I'm all set.

Yeah that is what you said last time when submitting DS230
. At this point I don't see anything else could be a problem with your interview and should be quick and smooth sailing. Only thing is you will face is a the inflation of airline ticket price during high peak season

Not sure but I remember embassy has stop put visa sticker on your passport, reason was you will lose entire page of your passport and for those that travel alot could be a problematic. So once you're approve, CO will give you back your passport and they will take self paid envelope from you and send the visa in the mail ( this will be up to Embassy schedule ).
IR-1 Will face lots of tough questions on most part of countries because of fraud, so be prepare for the most ridiculous question they will ask you and don't be shy answering them or get emotional with CO because they will denied your visa if they detect fraud. Interview doesn't stop there, remember you still have another interview once you arrived in USA and this time it will be with your hubby, likely questions they ask you before will be in record and if you answer differently than what your first interview you will have a problem and let me tell you these CO are highly trained how they ask those twisted questions.

I864 & DS230 payment you don't need to show them because NVC won't process our documents if it not paid. Just need to proof others payment that need to be pay at the time of interview. Embassy does not accept any payment, in the case that you do, you'll need to pay it at where they directed you to go and bring back the receipt as form of proof that you did pay.
In this scenario we already paid for everything else, except self return envelope for passport & visa. This must purchased by recommended carrier from your local embassy. GC fee payment should be pay when you has granted visa and prior travel to USA, thiis can be pay at online at travel.state.gov

Yes. I did the 407 in Frankfurt. Its written on it. I'm well prepared. (lol) Now this makes me wonder if I get my fathers death certificate back.
If you submitted original with photo copy yes you can request the original back. Death certificate you can get tons of them from hospital or local town hall.

It did on my 4 page appointment letter. I printed the page how the package supposed to look like.
I probably can get it a week in advance. YOU MIL is the Thursday before me. Pretty good.

I will call the embassy next week. I'm interested if they sell DHL express from within the embassy. Or maybe I get to pick up my passport in person after interview. The DHL envelope cost 25 dollars.
I don't recall they tell you it in the package 4 email and ask us to visit their website for further detail. I was in New Zealand and the whole deal work is, we need to buy a kiwi self post return evenlope on interview date (denied or approved) must buy one. You must get everything ......self return envelope with your beautiful name and address on it and of course paid stamp. Also you need to paid all related FEES at either bank or local government postal office prior coming to interview. All receipt required at time of interview to prove that you paid.

I'm pretty sure what they assigned for you is the soonest open avaliable date with an open window of 1 month minimum. The open pocket window is for beneficiary to have enough room for medical exam even though you already did it.
IR-5 should be smooth sailing.
IR-1 is much tougher and much more questions will be ask during interview.

I feel panick. Only 5 weeks away to interview. Didin't they know I have lots of time? I marked the day in red to make me truly nervous.
10 am is a good time. OMG...I'm beside myself.
Yeah...I don't need to worry about this document. It was a checklist requested one. They wouldn't have closed my case if they hadn't received it.
Can the officer still say "NO"?
If you feel panic/worry and have too much time on hands, just call NVC ask them if they received your RFE second divorce original paper. I know they did otherwise they wouldn't closed your case, but what the heck you have too loose here?. This will ease your mind and relax until your interview date come.
I don't see why they would reject IR-5 unless any person involved in the case had some sort of criminal records.

I thought IR1 & IR5 docs during NVC stage can be scanned and upload for HCM? Making sure to bring all original docs to interview.
