You are right that the death certificate is listed on the checklist, but like tax transcripts for those applying under the 5 year rule, or court disposition documents, or selective service status letters, which are also on the checklist, many people don't send these in with the application. The OP will be given the chance to present the death certificate at the interview if she doesn't send it in now.

    Thanks so much, that's a load off my mind. I already have my 10 year permanent resident card with conditions removed. I'm going to go ahead and mail my N-400 and have my marriage certificate when I go for my interview.

  2. I am applying for naturalization and have been a permanent resident for a little over 5 years. I am a widow and my path to permanent residency was marriage to a US citizen. Do I need to include a copy of my marriage certificate or is it sufficient to have a copy of the death certificate? I only ask because I just realized that all I have is a marriage license and never got the actual certificate and I'd like to get this in the mail. It sounds like from the instructions that I don't need the certificate as I am not currently married, but I don't want it sent back on a technicality.

  3. The letter reads (they are all identical) :

    The records of this Service indicate that you entered the United States as a conditional permanent resident on 2/25/2010. In accordance with section 216 of the immigration and Nationality Act you must file form i-751. Petition to Remove Conditions on Residence. Failure to do so may result in automatic termination of your status.

    It should also be notice that my husband passed away in May. I am aware that I am free to file whenever I choose but had not planned on filing until the 90 day window.

  4. Hello, I came to the US on a K-1 visa in July of 2009. I currently have a conditional permanent resident card.

    My husband passed away last month and I'm trying to decided where to go from here. I don't want to abandon my Permanent Residency after all the time and money I put into aquiring it but I would like to go home and spend some time with my family while I heal. Right now my intention would be to return to the USA next spring.

    I'm wondering if anyone knows if its possible to remove conditions without holding a residency in the United States as I will need to apply for the removal of conditions in November, when I would most likely be in Canada.

    Any thoughts would be greatly appreciated,

  5. Hello everyone,

    I'm currently getting ready and preparing for my interview on Dec. 13th. I just realized that I have submitted the original I-134 of my fiance and his tax returns as well as the original I-134F of our cosponsor in packet 3!! I read that I have to present the originals of all our documents at the interview.. I really hope I didn't make a big mistake. :unsure:

    If your concerned the easiest thing to do is bring a newly signed copied of the I-134's and copies of the tax returns.

    Correct me if I am wrong but photos are only needed for the petitioner and the fiance when initially filing, (129F, etc.) not children, right?

    Correct, your child needs only to be listed on the I-129f. You won't need passport photo's for the child until it gets to the consulate.

  7. I qualified for NVC without being employed and without a co-sponsor (I have rental property). I was concerned about not being employed for the interview (just relocated to a new state) so I asked my lawyer about this and they suggested I add a co-sponser. At the interview I had copies for my co-sponsor 2008 taxes she made over 60,000 a year and owns property over 300,000 and we received a BLUE SLIP. They asked for 3-years "CERTIFIED" copies from my co-sponsor (which is a 4506 form) which takes 60 days to received from the IRS. Why are they asking for this?

  8. I'm a college student and planning to propose and file my I-129f in December. Once I get the NOA2, I need to send my girlfriend the form about finances right? I134?

    Is it going to be a problem for me to show that I can support her? What should I include with this form?

    I've got a part time job, but I'm only making 600 dollars a month. I have about $5000 in savings. My mother, stepfather, and father can all support me to an extent. So how do I prove that? How much do I have to show that I can support my girlfriend?

    And how can I prove that? I think it says include tax forms and paychecks, but I haven't paid income taxes...ever. I've never made enough money, and I've also been Japan the last two years as a missionary (volunteer). My paychecks are direct deposit so what should I do?

    You will need a co-sponsor. You will include them on the I-134 and include their taxes.

  9. We have communicated through video SKYPE chat for the past 9 months (over an hour each night.) I made copies of our SKYPE chat history for the interview, a long with pictures, and a statement that I lived in China from August 2008 until March of 2009 in the same apartment complex as my fiancee. Since, I lived there, had over 130 pages of SKYPE history, and plenty of pictures, I thought this would be enough. We got a BLUE SLIP at the interview with the correspondence box marked. Here is what the box stated:

    Provide as much evidence of correspondence that you can, that demonstrates the development of your relationship, from initial stages until the current date. Examples include letters, remittance slips, e-mail, and chat sessions.

    So, my question is this, since we "communicated each night" through video SKYPE I did not send many emails. Has anyone had to explain this issue to the embassy?

    What can I do to provide more evidence of our correspondence if SKYPE is our main source of contact?

    Do you have anything more convincing from the "initial stages". Banks statements showing you were at the same place at the same time. A letter from your guys's landlord stated you both lived in the same aparment complex?

  10. We had a good laugh today - we went into our bank (Wachovia) to get a letter for the Removal of Conditions that we're about to send in. Just a simple letter stating our accounts, that both of us are account holders and for how long.

    The guy was friendly and willing to help but as soon as we uttered the words 'for immigration' - we jinxed ourselves. We carefully explained that it was simply to prove that we're in deed sharing things like bank accounts after 2 years of marriage.....I actually had to go into an explanation of ROC...he ended up having to phone someone, who said that they cannot just 'write a letter' because they've been sued before......uhm what???? I'm not asking you to state my income or my bank account balances or notarize it....sheesh. If they can't say that I have an account there - I mean who can?

    Anyway - so they can write us a letter but we had to sign something and he had to fax it and then they'll fax it back to the branch and we can pick up our super special letter...maybe Sat or Monday hopefully which hold up the process a few more days

    They can't even print a damn letter saying we're joint account holders.....what is the world coming to?????

    What about a bank statement from when your name was put on the account. Surely they cannot withhold bank statements.

    I finally finished getting all my paperwork together for my interview and faxed off the checklist to the Vancouver consulate today, was I supposed to fax just the checklist? Or all the documents too?

    Just the checlist. :) Congratz, if you e-mail them and ask for your interview date in my experience you can know as early as tomorrow.

  12. So I sent my I-485 out on the 12th of November.

    They received it last week (the 17th I believe)

    My I-94 expired last Saturday the 21st.

    I got married on the 22nd of September, but my wife got in a horrible car accident right after the honeymoon.

    So it took me a while to get the whole set together.

    Now what ? Do I wait ? Can I call them ?

    The check hasnt been cashed yet.

    They did receive it in time, but am I now illegal ?

    If I need to return to the Netherlands, my wife will have a lot of problems.

    I need to take care of her, and drive her places. Pick up her medicine and make sure she takes it.

    Get her doctors appointments scheduled and get her there and back.

    If I have to leave, not only would it financially destroy us, but I dont she can take any more bad luck.

    (its a whole list of consecutive bad things happening, and with her PTSD and depression she cant take any more)

    Please help. I dont know what to do and where to turn to, and the wait is driving me crazy.

    With the I-129F they cashed the check the day they received it. It's been a week and they still didnt try to get my money. Nor did I get a notice in the mail. We're pretty desperate and pretty much at the end of our emotional rope.

    There is no harm in calling, if your in the system than they will be able to pull you up by name and that should help lengthen your emotional rope. The number to call is 1.800.375.5283. that's the National Customer Service Center.

    Getting married satisfied the requirments of the K-1 and essentially voided the terms of the I-94. You are just fine.

    If it makes you feel any better my Package was received on the 12th and I didn't get my NOA1's until today.

  13. 1010$ for AOS not including the 6 passport photos you need if you also file the EAD and AP papers which most usually do.

    If your medical is no longer within the 1 year you can pay anywhere from 200- 400$ for a new medical.

    $1010 plus the fee for medical examination, is that all there is to pay to change the status? what about my husband, does he need to pay anything too? after AOS, what comes next and how much does it cost again if it cost anything? Thanks alot for ur answers.

    :yes: Thats the complete cost. 1010$ plus the medical and two passport pictures. After AOS there will be removal of conditions in 2 years, which gives you plenty of time to read up on it. Good luck!

  14. Yes the petitions will be split up so you need to send what each forms request for so doubles for most stuff. You need 4 passport photos, correct. If you send the AP as well then it would be 6 passport photos. For the marriage cert you only need a colour copy of the certified copy to send in, but you can send a certified copy if you want to instead.

    So, since we only sent 2 pics, how do we submit more pics?

    I also only sent two picture and I read the isntructions three times before I even began. They only asked for two pictures and the guide here only says to send two pictures so I'm very confident that only two pictures are required.

  15. At least one of ours is moving. My wife got her Bio Appointment in the mail, Nov 21st, 2009. We are scheduled for Dec 9th, 2009.

    Our daughter has had no update since the initial NOA :unsure:. At this point, all we can think of is that we made a mistake of some kind filling out her AOS :bonk: . So we wait...

    Update to this...

    Our daughter's Bio Appointment came in the mail, Nov 23rd :blink: although completely baffled, we are happy that hers is still moving! She actually got an appointment ahead of my wife for Dec 8th. We are gong to try to get both done at the same time.

    I guess we can skip the online updates for us, since they do not follow what is happening very well. Good luck, November filers!

    Similar situation here, my daughter isn't available in the online update system. My daughter's only four however and I'm sure I read that she won't get biometric's. You have to be 14 for that to be required. Maybe the just put children in the same file and once you're approved it's an automatic for them as well.

  16. Jauque!! How did the interview and POE go? How is life in the USA?

    POE was really simple, no hassle at all. About 5 hours of driving through Washington however and our car broke down. We kept humming and hawing about whether to fix it or just to fly back. In the end we decided to fly but it took a couple days to mail everything out of the van to Kansas and then to also find someone to take the van. I'd hate to start this whole thing with a vehicle abandonment charge.

    I'm so happy to be here however, finally! Now to get amrried and start AOS.

  17. All right, guys. This is it. I leave in the morning and will spend the next two days on a plane-but it'll all be worth it because I'll be heading toward Lamine. Please keep your fingers crossed and say a couple prayers for us on the 8th. I'm so terrified of the interview. I'll try to update as soon as possible, but the power outages are really bad in Dakar around this time of year, so no guarantee on posting while I'm in Senegal.

  18. Somehow the Royal Mail lost our Packet 3.....Ahhhh!

    I called the department of state about two weeks ago to find out of the packet 3 had been sent. They said it was sent out on the 10th of August however I still havent received it. I thought I would leave it another week or two just in case but I finally bit the bullet and called the £1.20 per minute phone line to the London embassy. It took them 7 and a half minutes (£9.40) to tell me that I would have to email them....

    Very frustrating indeed...

    That's very frustrating indeed. I think I called the same line once upon a time to be given a phone number to a recorded information line. I've always had good luck with emailing so hope that works for you!

  19. D-Day will be upon me soon, I keep going over and over all my paperwork. I'm pretty sure its all in order. I leave tomorrow morning at 5 am and I'm not at all sure that I'll be able to sleep I'm so excited. I feel liek I'm 5 again and it's christmas eve.

    My only real concern is how few pictures I have I have 7 total, 5 of him and my daughter and then 2 of me and him taken on my cellphone so their pretty blurry. I figure I will take a few more and have them developed on Monday.

    Any last minute tips?

  20. My last post until sometime in early september, leaving at 5 am to go pick up my fiance from the airport and then too Vancouver for the interview we go.

    I keep going over and over all of my stuff trying to make sure I'm not missing anything, I'm pretty sure that I'm good to go.

    So excited, I don't think I'll be able to sleep tonight, it probablly won't help that I've dranken at least 2 litres of diet coke today. :bonk:

  21. Attaya - I think your safe to do the interview without the medical information. Even if you book the interview now you have all the time between today and the interview for the doctor to get his act together. Even if he doesn't you can take the 221g (that's the paper that Lamine will get telling him to return with his medical results) and stuff it in the Doc's face. I wouldn't delay booking your interview and when this is all over I would report the doctor's butt. "Sit-In" is not foreign to me when I want results, 9 times out of 10 it will work.
