  1. Hello, I am asking this questions on behalh of my sister in law, she has the ability to apply for her I-485, she was granted asylum status (Form I-589). I believe she needs the follwing, if I am mssing anything please correct me, thank you in advance for any help

     

    • Filled out I-485
    • Filled out I-693
    • Biometics
    • Affidavit of continued physcial presence in the USA (written and prepared by the person applying)
    • Money order for the cost of the application 
  2. Hey people, my wife and I are getting ready to apply for citizenship, I will tell you what im sending, if you guys see im missing something please let me know. Thank you in advance

    1. N-400 with the filing fees $680.00 (Will be sending a cashiers check)
    2. Evidence of marriage: IRS papers, bills we have under both of our names, marriage certificate and letters from friends
    3. Copy of My birth certificate and passport to prove my citizenship
    4. Photo copy (front and back) of her Resident Card, 2 color passport photos with her A number written in pencil on the back

  3. Why do you keep saying "Officially married" when you said they got married in Costa Rico. Once she has adoption papers he can start filing for the whole family.

    All they had in Costa Rica was the ceremony, nothing official. In the eyes of the State she is still single.

    She did this because her lawyer said that was the best way to do it.

    the husband was not a US citizen at the time, only a legal perminant resident.

    I told her to marry him legally anyways while he became a citizen that way she could prove they had been married 2-3 years, that she could have filed a different visa but they didn't listen to me

  4. Entering on s tourist visa with the intention of adjusting to permanent residency is fraud.

    She can enter as a tourist and marry. No problem there. Her husband can then file a petition for her spousal visa.

    She can stay with him up to the validity of her tourist visa, as a tourist (no work). She will have to return to her home country once her visa is up and definitely for the interview. She can visit him on her tourist visa during the process as many times as she wishes, provided that she can satisfy the CBP person at the border that she will be going back home at the end of her visit.

    Thank you, that's exactly what I thought. Her lawyer is saying something else, which I told her sounded wrong and iligal.

    Your suggestion is exactly what I told her she should do, but she thinks I'm wrong

  5. Hello, if I am writing this in the wrong section please forgive me. I have question that hope you guys can help me with.

    Here is the scenario and plan that my friend has, she says she has talked to a lawyer and she said this will work but I'm not sure if it will

    We have a woman that lives in Costa Rica (Anna) she has a recently officially adopted a daughter (Esther). Official paper will take about three months to be given to her. She has been the kids "mother" for over 11 years but now it is official in the eyes of the law.

    Anna has a tourist visa, And has entered the US multiple times and has always left before the time she has been given, three years ago while on one of her trips she met a permanent resident of the US (Marcos) they fell in love the whole 9 yards and they got married in Costa Rica, nothing official just a ceremony with frieinds and family and the preacher.

    Marcos became an official US citizen about four months ago. (He is originally from Mexico, not sure if that makes a difference or not)

    Now that you have the information here is the question and plan.

    Plan A

    Once the adoption is official, Anna will take her daughter and attempt to get her a tourist visa, they will both then come to the US. Anna will then marry Marcos officially through the courts and submit whatever forms they will need in order to become permanent residence. Their lawyers told them that they could wait for the process in the US (need to know if this is true or not)

    Plan B

    The daughter is not granted the tourist visa so she must remain in Costa Rica, Anna comes to the US gets officially married and files the paperwork to become a permanent resident along with her daughter. Will the daughter have to remain in Costa Rica for the duration of the process, or will should be able to come to the US and wait for the process here.

    If any of this sounds ridiculous please forgive me, I am going based on information that her lawyer said would work but I am not 100% sure that it will.

    If neither of the options above work I assume that they will have to get married, and while the paperwork is being processed both the daughter and the mother will have to wait in Costa Rica

    im not sure, that why i was asking, i friend of mine flew to argentina and his passport was expiring three months after he returned and they didnt let him leave the US, i was just curios and safe. Dont want to get a call saying she has to say in CR lol

Good evening to all, i have a question, my wife will be visiting her family in Costa Rica, she has done this multiple times since she was gotten her Green card, the flight will be for 10 day and she is leaving on September 28 and returning on October 7, he Green card is set to expire on December 14, 2012, will she have any kind of problem either leaving or re-entering the United States?

    any help will be appreciated thank you

  8. My wife recently received her green card and is planning on visiting her family in Costa Rica.

    here are my questions:

    Here passport is under he maiden name so is her temporary license and social security card, BUT he green card in under her married name.

    When buying the plain ticket i assume i must buy it under her maiden name and when she travels she must have her marriage certificate with her just in case they ask why two different names appear.

    Aside from the marriage certificate is there any thing else she need to have when she travels/?

  9. Hey ladies and gents I have a quick question for you guys..

    On December 20 I checked my case status online and much to my surprise it said my Green card had been approved, to be more specific it the highlighted bubble was the "Card/ Document Production" one...

    I just checked it a few seconds ago and it went back towards the previous bubble:

    Post Decision Activity

    On December 22, 2010, we mailed you a notice that we have approved this I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS. Please follow any instructions on the notice. If you move before you receive the notice, call customer service at 1-800-375-5283.

    Im pretty sure it means that the Green card is on its way i just want to make sure lol, also will I have to go to an interview or once i get my green card is this whole ordeal finally over?

  10. I apologize if if posted this question in the wrong section, feel free to move it if im indeed incorrect.

    My wife moved to the United State, (Miami , Florida to be exact) from Costa Rica, and we are presently waiting for her green card to arrive, my question is the following she graduated from a University with her Bachelors degree (roughly 90 credit) her degree was for Business Administration with emphasis on accounting and financing, what are the step i would need in order to transfer her credits from Costa Rica over here???

    and on July 21 i recieved her Travel documents, lets hope the GC is soon to follow :dance:

    Construction field has sufficient number of workers - I doubt they will give out H1B for that field...

    well if he gets his papers he can work for my company i have a roofing company, and also his brother in law is an handy man type worker and he will be giving him work also

    My Wife's father is a Citizen of Costa Rica and was recently granted a Ten year (Tourist) visa by the US consulate, now he is interested in getting a work visa/permission to work here in the US, Will this be possible and id so what do we need to do?

  14. Whats up people im about to summit my Fiancee AOS package and even though i have read the instructions a million times I want a fresh set of eyes looking at what im sending (im sure we all could relate lol)

    Im not sending the Travel document form because she has no intent of leaving the country until her resedenci gets here.

    My last question is should I send an Cashiers check or Money order, I am making out the check to "Department of Homeland Security" and it will be in the amount of $1,010.00 (is the amount correct?) Also im a little confused as to where im suppose to mail the package, i live in Miami, Florida

  15. Hi guys i need a favor can someone post a phone number that i can call to talk to someone in regards to the following question, i have been getting different answers from different people.

    Here is the question

    My wife is from Costa Rica she arrived on December 29, 2009 we got legally married by the courts and church already, she also has her social security card (under her maiden name). My question is when filling out the forms i need to send out for the AOS which name do i use, her Madien name or my last name (she wants my last name).

    The people in the social security office and the city hall old me to send her papers with my last name and that once AOS sees the marriage certificate they will change it to my last name. Does this sound correct???

Hi i have already gone to the court house and stared the process to get legally married, they gave me a form in which i have to get signed by a notary to make the marriage official, the pastor that will be really marring is not a notary and im planning on have to ceromony later so we can plan it better.

    . My aunt is a notary will there be a problem if she signs the court documents? her last name is not the same as mines

    how do i go about changing her name (legally) to my last name?

    they told me in the court house that i have to go change it and the Costarican embassy here in Miami, but i called the embassy and they told me that they do NOT change the name on her passport even though she was married, she said the name you are born with is the name you die with.

    from what i have heard when i go get her SS card they will give her a card based on the name on her passport, and when i fill out the forms for AOS i would imagine i will have to fill out the application with her maiden name. so when she gets her green card it will come in her maiden name..

    once again how do i go about changing her name so that all her documents from here (Drivers lic, Credit card, SS etc are under her married name?

    sounds pretty easy the way you but it, the people i talked to on the phone were as confused as i was when it came to this lol,

    ok so when filling out the paper work for AOS, i used her married name then correct?
