  1. My husband was convicted of a CMT three and a half years ago. He was sentenced to 2 months in prison for it, and came to visit me once here in the US on the VWP without checking "yes" on his landing card to having committed a crime. So, they got him on misrepresentation as well.

    with his conviction so recent in uscis terms and now the misrep charge you have a very mountainous hill to climb. to get a misrep overturned is very very hard but do able. i managed to get my misrep overturned.

    what was the cimt for.

    i think if you need some real help i would go the i2us.com much more info on there.

  2. I wish to thank everyone that joined in on our thread, I hope the updates have been of some help to you all.

    However now that I have obtained my CR1 Visa and have relocated to the USA (Social Security card was issued 2 weeks after arrival & Green card arrived after 3 weeks), I have so much to do in terms of getting a job, moving over financial & personal items, getting ready for christmas, sending out presents, looking for a house to buy etc etc... This leaves me without any time to be able to keep my spreadsheet up to date, therefore it is best that I stop trying to update it from now on, as I know that some people rely on my spreadsheet more than the USCIS website and unless someone else would like to take over the updating work, then this will be the last post I will make on this thread, I will still manage to keep in touch with those of you that have sent me personal messages though.

    If someone is willing to spend the time and do the updates to the spreadsheet, i am willing to train them and still host the spreadsheet file.

    I have been approved on monday just gone so I will be in San Antonio hopefully christmas eve with a bit of luck to see my son open his christmas presents for the first time ever. Good luck for the future all the best carl

  3. I am glad, as well, that your case did not get sent to the AAO. You cannot imagine what it feels like to know that you are swimming in a barrel with all of the drug dealers, rapists, child molesters, and human traffickers from across the globe who didn't make it through USCIS.

    I would like to know what we have done that is so bad that this has happened to us. I make no excuse for my husband's past crimes, nor does he. But the USCIS has made a serious error here. How in the Hell can you deem someone inadmissible because of non-CIMT arrests, particularly ones for which there is no evidence other than the applicant's honest admission of them!

    I love Ireland. I'm an artist and a writer. What better place for me than the Emerald Isle? If I could go, I would have been there already.

    I am so disappointed in this system right now that I can't even think straight. I'm sure everybody reading this will think that there has to be more to this story. There isn't. I'm wondering if it's time to go to the media or to demand a face-to-face meeting with my representative. Somebody should have to face my entire family & community and tell us why this is happening to us. What if I arranged a demonstration outside his office with everybody I know?

    Ideas welcome.

    the media would be good and a few high profile actors or actressess and maybe stonewall or anesty international could help i agree, we paid our dues for the crimes we committed but to the USCIS we are still as guilty as charged regardless of how long ago it was...

  4. I'm sorry, guys. You are not going to believe this.

    We are DENIED.

    I will explain as soon as I can see straight. Basically, there was a miscommunication between the Congressman's office & Washington. I have the actual letter in my hand, and yes, we were denied and charged with misrep.

    I'm beyond distraught.

  5. Oh I wouldn't do it because I was trying to save money - I'd only do it to save the headache of having to remove conditions two years later, and only then if it were a wait of a fortnight or so. At every step of the way we've been delayed inexplicably, and now this AP business (16 weeks today :crying: ), so I dread to think what'll happen next :unsure:

    It's the start of a new week - hopefully the embassy will finally issue an update and you'll all hear some good news :yes:

    my cr1 to ir1 happens just 2days after i come back from egypt i cant wait a week in the sun away from the bloody football although i did cheer when the usa scored i thought i was going to get lynched...

    Andrew is indeed correct... we have enjoyed hearing about your visa journey!! I am so happy to hear your wonderful news, I can't even begin to imagine what you must be feeling right now, but hopefully in the near future we will be able to :yes:.     well i called the embassy today and was told that they are currently working on cases from mid feb 2010

If you check back on page 16 of this forum you will see that with the case of C2C although the case was completed and closed,there was a dispute over the decision and if there is one it has to be cleared up by the head office in Washington.Still yes i do agree that the majority of cases are decided and end with Elliot cooks decision in london,so my case is just the odd one that needs further clarification.]

    did the woman you spoke to sound chinese if so she an idiot and my wife has had plenty of run in with her in the end my wife told she wanted to speak to her supervisior to try and get a straight answer which this woman seems inept in giving any straight answer to any questions. she also told my wife this whole process from start to finish would only take 4 months so i find the woman spouts complete ####### doesnt know her ####### from her elbow...

Well i phoned the embassy today to find out if our i-601 had been passed to DHS and was told still waiting for memo which we have been told for the last 3 weeks or so that is all that it was waiting for, so i phoned my wife Laury who got the same lunatic on the phone i got to be told that actually our i-601 is still sitting on somebody's desk under 2 other waivers that are before ours, so we are looking at at least another 2 or 3 weeks which will make it about 10 or 11 weeks since they have had it. The thing i don't get is the visa unit don't make the decision DHS do, We were also told that they don't have enough staff to deal with it all. My wife was told be the same woman several weeks ago that the whole process from start to finish 4 months lol...

  9. At least my post on this Forum is informational to others and tells people about the prospects of what to expect, as and when they have the interview at the embassy and if they have a CIMT against them, because I know we were not ready for this particular offence being pinned on us...

    So if you have something relevant to say about this topic or you have been through the same thing, then I and others will welcome your comments, :thumbs: however if you just want to make unclear and unwelcome remarks then please do as your offensive member photo states. :whistle:

    i was denied a visa for exactly the same thing. i was also denied for misrep which successfully overturned and now have refiled just waiting for dhs to make a decision. my wife even asked 3 and 4 star admirals and they had never heard the stupid phrase before

    No news here, except that the Embassy confirmed they received the check I sent over. I was worried because it hadn't been cashed after 2 weeks and the post office couldn't confirm delivery. I hated to call and risk being labeled a "pest," but I needed to know if everything had been received. It would completely suck to sit here patiently and then find out that everything was delayed because I was trying to be mannerly.

    The woman I spoke with was really nice, but cut me off mid-question to provide unsolicited details about how things would proceed from here. The jist of what she wanted to convey was that we should be patient because we are in for a long wait.

    Juuuuuuust wanted to find out if our check was received. :blink: It makes you realize that they must get pretty used to people calling to request a status.

    hi justj how long ago did he travel on the vwp and how many times i ask as i had cimt from 22.5 yrs ago and had misrep for traveling on vwp. the misrep got overturned by the aao and they also concluded that i am rehabed but they still wont give us a visa but we are now refiling instead of appealing against aao and it will at least be dealt with in London. : :unsure:

  11. i am in england my i-601 ha sjust been denied, i have crimes from over 20 years ago for cimt which the embassy said was ok but the reason for refusal of waiver was that due to the fact i tick the wrong box on i-94 in 2006. i went on holiday to see some friend in los angeles for week then returned to the uk. in the uk nobody i know knows what cimt is as it was created by the US goverment back in the 50's-60's. the emabassy have said we can appeal. who has to fill out the form i-290b is it my wife or myself. how long does it take and successful are they? thank you for any help.
