Unless someone with a green card is out of the country for one year or more, re-entry is no problem.
thanks alot.

could her husband stopped her re-entry even though she have the 10 yr gc and out of the country since january 2009? It is her PR/Green Card - her husband has no control over it. Does she plan to return to the US? (Extended stays outside the US could require a ReEntry permit.)
could he tell the uscis not to let her in???He can call but has no control over it.
thanks alot for the response, she doesn't have a re-entry permit could it be a problem?

Some states do not have income tax, which means a lot of people won't be able to provide state tax return documents which in turn means Federal tax transcripts are fine. That's all I sent with my N-400.
thanks for the reply

during the citizenship interview, do they look for state and federal tax? or just the irs / federal tax transcript will do without the state? ty

My wife received her Permanent Residence Card and now is filing for divorce. I thought her intentions were true and that she was really in love with me, but she told me it was just a business relationship for her to get into the US. I feel like I got scammed, is there anything I can do to stop this scammer?
make it sure she doesn't have enough evidence to proved she enter in good faith, that if she still need to remove condition , but if she already have the 10 yrs gc then just be prepared to moved on, good luck.

good job csc, thanks for my 10 yrs gc.

My fiancee arrived in the US three weeks ago. I was so excited, happy -- whatever, but now she wanted to go back home because she's homesick. She still wants to be engaged to me and promised me we're not giving up on each other. She's just not ready to get married right now. My question is, when she goes back to her country (Philippines) within the ninety days, will it be easier for us to go through another visa? I would appreciate any help. Thank you in advance.
try to get her a plane ticket / send her back to her country, i bet yah she will kneel down, cry and beg to stay, that's just part of some emotional drama drama.

me and my son was out of the country for 11 months... (mar 08 - feb 09) i didnt file any re-entry permit for its so expensive and just decided to stay there for 11 months (need re-entry is stayed 1 yr). when i got here in LAX, they asked me soo many questions like the reason of overstaying, financial income, any plans of another trip back to my country, etc.
so i would suggest not live there close to 1 yr.... better safe than sorry! i stayed in the Philippines for 1 yr and 9 months of course with a re-entry permit and that was the reason why i was denied with my naturalization application since ive been here in the US since 1999 and that resulted me filing i130 for my husband as a LPR which will take forever and half.
thank you for the reply mitch, very helpful.

CSC only please.
No VSC
nor VSC to CSC
because VSC and VSC -CSC are faster on GC arrival this time, most of their GC are produced in the east coast.
again, i will appreciate a purely CSC gc arrival response, thanks
-
if you are a CSC filers please report here as soon as you receive your green card so other's will have some idea when theirs could possibly come on hand too, thanks in advance, we'll appreciate it.

she doesn't have an extension letter nor a stamp in her passport.

http://www.uscis.gov/portal/site/uscis/men...00045f3d6a1RCRDMaintaining Permanent Residence You may lose your permanent residence status if you commit an act that makes you removable from the United States under the law in section 237 of the Immigration and Nationality Act. If you commit such an act, you may be brought before the immigration courts to determine your right to remain a Permanent Resident. You may be found to have abandoned your permanent resident status if you:
- Move to another country intending to live there permanently.
- Remain outside of the US for more than one year without obtaining a reentry permit or returning resident visa. However in determining whether your status has been abandoned any length of absence from the US may be considered, even if it is less than one year.
- Remain outside of the US for more than two years after issuance of a reentry permit without obtaining a returning resident visa. However in determining whether your status has been abandoned any length of absence from the US may be considered, even if it is less than one year.
- Fail to file income tax returns while living outside of the US for any period.
- Declare yourself a “nonimmigrant” on your tax returns
File a tax return this year? If not can be considered to have abandoned residency.
Moving to general immigrations forum, this does not have to do with removal of conditions.
while my friends removing of condition is on process just this past month she was out of the country and now VSC just sent her 10 yr gc on her aunt house, should her aunt send the gc to her thru fedex?
-
how long does it takes before a 10 yr greencard considered abandoned? my friend is out in the country for more than 6 mos, so can she still enter here in USA?, is it consider abandoned though?

Hi,
I have one more quick question for you experts that have been through all this and were successful. My wife and I are still happily living in Ecuador, but may consider applying for a Visa for her someday in the near future. I am wondering if most of you have used an Immigration Attorney or have just done it all on your own? If we do decide to use an Attorney, can anyone tell me more or less what it will cost? I just got a quote of around $5000.00. That sounds kind of high to me, but I really have no idea.
Thanks!!!!
3 yrs ago my hubby hired a lawyer for $1,400 plus the USCIS fees and in our case it was worth it just to impress the consul, though i had to check the papers that the lawyer prepared coz they messed up, if your case isn't complicated better do it yourself, save your buck.

VSC looks faster in GC arrival and CSC is still so slow, I wonder how fast they would go when they are done fixing their machines or if they will be over with this machine fixes blues.
is this correct?
